ORDINANCE NO.20 -79
AN ORDINANCE AMENDING CHAPTER 12.20 OF THE MUNICIPAL
CODE OF THE TOWN OF ESTES PARK,COLORADO,THE SAME
RELATING TO PERMITS FOR CURB CUTS.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK,COLORADO AS FOLLOWS:
Section 1.That Section 12.20.010 of the Municipal Code of
the Town of Estes Park,Colorado is amended to read as follows:
12.20.010 Construction or Use —Permit Required.No
sidewalk or curb shall be constructed or reconstructed,and no
openings,driveways or cuts of any kind shall be made or enlarged
in any curb which is heretofore or hereafter constructed,without
first obtaining a permit from the building inspector.Every
permit for openings or driveways or cuts in any curb shall specify
the width and location of such openings,driveways or cuts,and no
permit shall be issued without first being approved by the board;
provided,however,that the building inspector may issue such
permits in all zoning districts except the C—l and C—2 zoning
districts,in accordance with such guidelines as may be
established from time to time by the board.
Application for a permit hereunder shall be made,and
the permit issued,prior to the issuance of a building permit.If
no application is made prior to the issuance of a building permit,
then so such application may be made until one year after the
issuance of a building permit.
Section 2.That Section 12.20.020 of the Municipal Code of
the Town of Estes Park,Colorado is amended to read as follows:
12.20.020 Construction—Conformance To Permit
Specifications.All sidewalks and curbs shall be constructed on a
grade,line and location established by the town engineer and
specified in the permit,shall be constructed of cemented
inorganic materials,such as concrete,brick and concrete block,
or any combination thereof,which material shall be securely
cemented in place.All curbs shall be constructed only of
concrete.No sidewalk shall have a surface irregularity greater
than one—fourth inch in ten feet.The surface of any sidewalk
shall have a degree of roughness at least equal to that of a
broomed concrete surface.
Section 3.The Board of Trustees of the Town of Estes Park,
Colorado,herewith finds,determines and designates that this
ordinance is necessary for the immediate preservation of the
public peace,health and safety,for provisions regulating
construction of curb cuts affect the public peace,health and
safety;and whereas,in the opinion of the Board of Trustees,an
emergency exists,this ordinance shall take effect and be in force

after its final passage,adoption and the approval and signature
of the Mayor.
