Meeting held in the Town Hall in said Town of Estes Park on the 9th day of April , A. D. 19.31. at regular meeting hour. Meeting called to order by Mayor H. Bernerd Dannels Present: Mayor H. B. Dannels Trustees: Also Present: Gary F. Klaphake, Town Administrator Gregory A. White, Town Attorney Abie Donna Heifner, Deputy Town Clerk Absent: Vickie O'Connor, CMC Town Clerk Norbert L. Aldrich, David Barker, Milan A. Dickinson, Polly Garrett, David Habecker, George J. Hix Mayor Dannels called the meeting to order at 7:30 P.M. CONSENT CALENDAR: 1. 2. 3. Approval of Town Board minutes dated March 26, 1991. Bills. Liquor Licenses: A. Spur 66 Liquor Store, National Park Village South, Retail Liquor Store License - Renewal. B. P. S. FLOWERS, 243-247 W. Elkhorn Ave., Hotel & Restaurant License, includes Extended Hours - Renewal. C. Estes Valley Spring Fest, Ltd., Request Special Events Liquor License - Authorization for Clerk to post premises. It was moved and seconded (Aldrich-Hix) the consent calendar be approved, and it passed unanimously. ACTION ITEMS: 1. Committee Reports: 1.A. Minutes of the Light and Power meeting held April 4, 1991 were read. It was moved and seconded (Aldrich-Hix) the minutes be approved, and it passed unanimously. 2. Planning Commission A. Public Hearing: Vrain Addition, Co./Applicant. - March 19, 1991. Amended Plat of Lots 1 & 2, South Saint and Lot 1, Tibbetts Addition, Tibbetts & Mayor Dannels declared the public hearing open. Director Stamey briefed the Board on the Amended Plat. Paul Kochevar, representing the applicant, noted all Planning conditions had been met. Peter Wood, architect for the proposed development at the southeast corner of Community Drive and Highway 7, spoke in favor of the project. There being no further comment in favor of or in opposition to the Amended Plat, Mayor Dannels declared Board of Trustees - April 9, 1991 - Page 2 the public hearing closed. It was moved and seconded (Hix-Barker) the Amended Plat of Lots 1 & 2, South Saint Vrain Addition, and Lot 1, Tibbetts Addition be approved, and it passed unanimously. B. Public Hearing: Zoning for Lot 1 Tibbetts Addition - From County Zoning to R-M Multiple Family, Tibbetts & Co./Applicant. (Annexed February 26, 1991) 1. Ordinance #7-91. Mayor Dannels declared the public hearing open. Paul Kochevar, representing the applicant, noted the proposed ordinance modifies the Tibbetts Addition zoning to R-M Multi -Family Residential. Hearing no comment in favor of or in opposition to the proposed ordinance, Mayor Dannels declared the public hearing closed. Town Attorney White read the ordinance in full, and it was moved and seconded (Barker -Garrett) the ordinance be adopted, and it passed unanimously. Whereupon Mayor Dannels declared the Ordinance duly passed and adopted and ordered it numbered 7-91 and published according to law. C. Special Review #90-8 Trail Ridge Apartments, Tibbetts & Co./Applicant. Mayor Dannels declared the public hearing open. Peter Wood, architect, spoke in favor of the proposed development, noting that although Planning Commission members had expressed concern regarding the absence of a sprinkler system within the apartment complex, the buildings would be built according to Town code, which does not require such a system. Hearing no further comment in favor of or opposition to the proposed development, Mayor Dannels declared the public hearing closed. It was moved and seconded (Barker-Hix) Special Review #90-8 Trail Ridge Apartments be approved, and it passed unanimously. D. Public Hearing: Zoning Regulations: 1. Ordinance #8-91. Arterial Street Standards and Special Review Procedures. Mayor Dannels declared the public hearing open. Director Stamey reported that the Planning Commission recommended modification of the Arterial Street Standards, and Special Review language. The purpose of the arterial standards is to create a visual landscaped buffer along the Town's entryways. The special review language modifications remove some of the more subjective criteria and require more information from the applicant at the time of submittal. In other action, the Planning Commission recommended not to proceed with a separate Sport and Recreation District, and tabled proposed revisions to the Bed and Breakfast rules to allow for another study session. Trustee Habecker expressed concern regarding the requirement that the proposed 25' planting buffer on all arterial streets be irrigated and disagreed with the statement "avoid unnecessary damage to the natural environment through design adaptation to the particularities of the site". Administrator Klaphake expressed concern with respect to the Town's requiring a 25' front yard setback which might decrease the developable building space or eliminate the possibility of parking spaces in front of the site. Director Stamey noted that there are provisions within Section 17.24.020 which allow the Planning Commission to approve alternatives to the planting specifications, and which also allow for existing vegetation to be counted toward Board of Trustees - April 9, 1991 - Page 3 planting requirements. There being no further comment, Mayor Dannels declared the public hearing closed. Town Attorney White read the ordinance in full, and it was moved and seconded (Garrett -Aldrich) the ordinance be adopted, and it passed by the following votes. Those voting Yes: Trustees Aldrich, Barker, Dickinson, Garrett, Hix. Those voting No: Trustee Habecker. Whereupon, Mayor Dannels declared the Ordinance duly passed and adopted and ordered it numbered 8-91 and published according to law. 3. EPURA Appointment: It was moved and seconded (Hix-Dickinson) Gerald Swank be appointed fill the unexpired five-year term of Pieter Hondius, said term expiring September 15, 1993, and it passed unanimously. There being no further business to come before the Board, Mayor Dannels adjourned the meeting to Executive Session at 8:25 P.M. . . . . . . . . . Deputy Town Clerk Mayor
