1. Committee Reports:
1.A. Minutes of the Public Works Committee meeting held May
16, 1991 were read. It was moved and seconded
(Dickinson -Barker) the minutes be approved, and it passed
unanimously.
B. Minutes of the Public Safety Committee meeting held May
23, 1991 were read. It was moved and seconded (Garrett -
Aldrich) the minutes be approved, and it passed
unanimously.
C. Minutes of the Light and Power Committee meeting held May
23, 1991 were read. It was moved and seconded (Aldrich-
Hix) the minutes be approved, and it passed unanimously.
2. Planning Commission - May 21, 1991.
A. Public Hearing: Annexation/Carriage Hills Addition (6th
and 7th Filings): Mayor Dannels declared the public
hearing open. Community Development Director Stamey
noted that annexation petitions executed by owners,
representing 74 of the 117 lots plus the Homeowner's
Association for the open space, have been submitted to
Board of Trustees - May 28, 1991 - Page 2
the Town. The proposed addition is contiguous with Town
boundaries, contains 109.68 acres, 117 platted
residential lots, 61 dwelling units, is urban in nature
and Town services are available. Plats of both filings
were displayed. Director Stamey reviewed a "Memorandum
of Understanding" between the Carriage Hills Planned Unit
Development Association, 6th and 7th Filings and the
Town, which outlined plans for providing Town services in
the areas of zoning, streets, snowplowing, water rates,
taxes, police protection, bike paths, open space,
building permit/inspection, and street lights. Town -
provided services will be provided through the General
Fund. If outlot D is dedicated to the Town as "open
space" it could be used for improvements such as
pedestrian and bike paths that are consistent with open
space; the Town would have the ability to modify the
ponds and drainage areas as necessary.
Both filings are currently under the Larimer County
zoning classification of "Estate P.U.D.", and it is
recommended "E-Estate" Zoning be designated.
There being no further testimony, Mayor Dannels declared
the public hearing closed.
1. Resolution #10-91/Annexation. Town Attorney White
read in full Resolution #10-91. It was moved and
seconded (Hix-Aldrich) the resolution be adopted,
and it passed unanimously.
2. Ordinance 10-91/Annexation. Trustee Aldrich
introduced, and Town Attorney White read in full,
an ordinance approving the annexation of certain
territory to the Town of Estes Park, Colorado, to
be known and designated as Carriage Hills Addition,
and moved it be passed and adopted. Trustee Hix
seconded the motion and it passed by the following
votes: Those voting "Yes" Trustees Aldrich,
Barker, Dickinson, Garrett, Habecker and Hix. Those
voting "No" none. Whereupon Mayor Dannels declared
the ordinance duly passed and adopted and ordered
it numbered 10-91 and published according to law.
3. Ordinance 11-91/Zoning. Trustee Garrett
introduced, and Town Attorney White read in full,
an ordinance zoning property within the Town of
Estes Park, known as Carriage Hills Addition, and
moved it be passed and adopted. Trustee Hix
seconded the motion and it passed by the following
votes: Those voting "Yes" Trustees Aldrich,
Barker, Dickinson, Garrett, Habecker and Hix.
Those voting "No" none. Whereupon Mayor Dannels
declared the ordinance duly passed and adopted and
ordered it numbered 11-91 and published according
to law.
It was moved and seconded (Garrett -Aldrich) the
Memorandum of Understanding between the Carriage Hills
Planned Unit Development Association, 6th and 7th
Filings, and the Town, be approved and it passed
unanimously.
B. Public Hearing: Amended Plat of Lot 38, Prospect
Mountain Subdivision, Don Spomer/Prospect Mountain
Development/Applicant. It was moved and seconded
(Aldrich-Hix) the public hearing be continued to June 11,
1991.

C. Public Hearing: Amended Plat of Lots 3, 4 and 5, Block
4, Second Amended Plat, Town of Estes Park, Lee and Molly
Kemper/Applicant. It was moved and seconded (Garrett -
Aldrich) the public hearing be continued to June 11,
1991.
3. Ordinance 12-91/Public Purpose Sign for the Estes Valley
Public Library. Trustee Hix introduced, and Town Attorney
White read in full, an ordinance authorizing a public purpose
sign for the Estes Valley Public Library, and moved it be
passed and adopted. Trustee Aldrich seconded the motion and
it passed by the following votes: Those voting "Yes" Trustees
Aldrich, Barker, Dickinson, Garrett, Habecker, Hix. Those
voting "No" none. Whereupon Mayor Dannels declared the
ordinance duly passed and adopted and ordered it numbered 12-
90 and published according to law.
4. Liquor Licenses:
A. Public Hearing: Change of Class Liquor Application -
Estes Valley Recreation and Park District dba ESTES PARK
GOLF COURSE, 1080 S. Saint Vrain Ave., to a Hotel and
Restaurant License w/Optional Premises. Mayor Dannels
opened the public hearing. Richard Lyons/Attorney for
the Applicant, noted the Estes Park Golf Course presently
has a Beer and Wine License and outlined the reasons for
the proposed change to a Hotel and Restaurant License
w/Optional Premises. The clubhouse has been renovated to
include a full -service breakfast/lunch menu and a sample
menu was submitted. The optional premises portion of the
license will allow for a beverage cart with a designated
route, i.e. holes 1, 2, 3, 5, 6, 7, 9, 12, 13, 15. The
cart will operate from approximately April 1 through
October. It was also noted that a portable restroom
facility has been installed at the eighth hole.
The Board also heard testimony in favor of the
application from Stan Gengler/Executive Director of the
EVRPD, Delbert Hillman/Food Service Manager for the Estes
Park Golf Course, Al Marranzino/Estes Park, Al
Persons/Estes Park and Lou Canaiy/Estes Park.
A petition with approximately 140 signatures in favor of
the application was submitted by the District's attorney.
Town Attorney White submitted letters received from four
citizens in favor of the application.
There being no further testimony, Mayor Dannels declared
the public hearing closed. Trustee Aldrich moved the
Board of Trustees find that the reasonable requirements
of the neighborhood are not met by the present liquor
outlets in the neighborhood, that the desires of the
adult inhabitants are for the granting of this liquor
license, and that based upon the above findings, this
license be granted. Trustee Hix seconded the motion, and
it passed unanimously.
B. Application for Special Events Liquor Permit filed by the
Estes Valley Public Library District, 335 E. Elkhorn
Avenue. Al Persons/Estes Park spoke in favor of granting
this application and explained the permit will enable the
library to hold a two hour champagne gala at its grand
opening June 22, 1991. Noting that all proper
information had been submitted with the application, it
was moved and seconded (Aldrich-Hix) the application be
approved, and it passed unanimously.

5. Colorado Open Meetings Act - Report/Town Attorney White.
Town Attorney White read his May 8, 1991 memo to the Town
Administrator regarding the Open Meetings Law, as follows:
1. Regular and Special Town Board Meetings. All meetings of
the Town Board must be proceeded by a notice stating time
and place of the meeting, as well as an agenda, if
possible, posted in a public place at least 24 hours
prior to the meeting.
2. Executive Sessions. An executive session can only be
held during a regular or special meeting of the Board,
i.e. there must be a vote of two-thirds of a quorum
present at the meeting. The executive session must be
called for only specific items and no formal action may
occur at any executive session.
3. Committee Meetings. Committee meetings are subject to
the same requirements as those of Town Board meetings;
however, it is counsel's opinion that unanimous consent
of all committee members must be obtained to go into
executive session.
4. Other Meetings. A meeting of a public body is defined as
any meeting where three or more members of the Board are
present at which any public business is discussed.
5. Joint Meetings. Meetings of the Town Board with other
public bodies would also be subject to the open meetings
requirement.
6. Other Boards. The Planning Commission, Board of
Adjustment, Estes Park Building Authority, Fire Pension
Board, Police Pension Board and Estes Park Rooftop Rodeo
Committee are all subject to the provisions of the Open
Meetings Act. The requirements as to notice, minutes and
executive session apply to those particular bodies.
Town Attorney White also stated that, in reviewing the Open
Meetings Act, it is his opinion this Act will not have a
significant impact upon the way the Town has been conducting
its business, but cautioned the Town should be very diligent
in abiding by all of the terms and conditions of the Act.
Assistant Town Administrator Widmer stated the media should
plan to check the bulletin board on the wall outside the
Administration Offices for notice of special meetings.
There being no further business to come before the Board, Mayor
Dannels requested comments from the audience. Lou Canaiy/Estes
Park inquired regarding the Town of Estes Park's indebtedness.
Hearing no further comment, Mayor Dannels adjourned the meeting at
9:00 P.M.
