Mayor Dannels called the meeting of the Board of Trustees to
order at 7:34 P.M.
CONSENT CALENDAR:
1. Town Board minutes dated January 23, 1990.
2. Bills.
3.A. Beaver Point Market, 3.2% Retail Beer License, 911
Moraine Avenue - Renewal.
B. Gazebo Restaurant and Tavern, Hotel and Restaurant
Liquor License, 205 Virginia Drive, includes Extended
Hours - Renewal.
C. Mountainview Mini Mart, 3.2% Retail Beer License, 399
East Elkhorn Avenue - Renewal.
D. Roadside Productions, Inc., dba LONIGANS, INC.,
Tavern Liquor License, 110 West Elkhorn Avenue,
includes Extended Hours - Renewal.
Trustee Aldrich moved the Consent Calendar be approved.
Hix seconded the motion and it passed unanimously.
ACTION ITEMS:
Trustee
1.A. Minutes of the Public Safety Committee meeting held
January 25, 1990 were read. Trustee Garrett comment-
ed: 1 - Animal Control - that during the Month of
January, the Police Department received 19 reports,
issued 9 summonses, and gave 3 warnings; and 2 -
Parking - in an effort to encourage the tourist to
stay and shop in the downtown area, a new parking
proposal has been recommended. This plan is being
proposed for the 1990 summer season; if it is deemed
unsuccessful, the Committee will consider a
public/private partnership approach. Trustee Garrett
moved the minutes be approved, contingent upon an
amendment relating to "bollards" as follows: the
bollards remain in place on Elkhorn Avenue, and not
removed or placed selectively as recorded in the
minutes. Trustee Aldrich seconded the motion and it
passed unanimously.

B. Minutes of the Administrative Committee meeting held
January 29, 1990 were read. Trustee Hix moved the
minutes be approved. Trustee Garrett seconded the
motion and it passed unanimously.
C. Minutes of the Light and Power Committee meeting held
February 1, 1990 were read. Trustee Hix moved the
minutes be approved. Trustee Aldrich seconded the
motion and it passed unanimously.
C.1. Ordinance 2-90. Mayor Dannels opened a public
hearing to consider adoption of the 1990 National
Electrical Code. There being no persons speaking "in
favor of" or "in opposition to" adoption of the Code,
Mayor Dannels closed the public hearing. Trustee Hix
introduced, and Town Attorney White read in full, an
ordinance adopting the 1990 National Electrical Code,
and moved it be passed and adopted. Trustee Habecker
seconded the motion and it passed by the following
votes: Those voting "Yes" Trustees Aldrich, Barker,
Dickinson, Garrett, Habecker, and Hix. Those voting
"No" none. Whereupon Mayor Dannels declared said
ordinance duly passed and adopted, and ordered it
numbered 2-90 and published according to law.
D. Minutes of the Community Development Committee
meeting held February 8, 1990 were read. Trustee
Dickinson moved the minutes be approved. Trustee
Garrett seconded the motion and it passed unanimous-
ly.
2.A. Resolution 5-90. Town Attorney White briefed the
Trustees on a resolution extending the vested proper-
ty right time -period for Lot 2, Ayers Acres, Lake
Meadows Condominiums. Trustee Habecker declared a
potential "conflict of interest" and stated he would
not participate in discussion nor vote on this
resolution. Trustee Hix introduced, and Town Attor-
ney White read in full, the resolution extending the
time -period for a total of six (6) years (1/16/96)
for Lot 2, Ayers Acres, and moved it be passed and
adopted. Trustee Garrett seconded the motion and it
passed by the following votes: Those voting "Yes"
Trustees Aldrich, Barker, Dickinson, Garrett, and
Hix. Those voting "No" none. Those "Abstaining"
Trustee Habecker.
3.A. Resolution 6-90. Town Attorney White briefed the
Trustees on a resolution whereby the Town would agree
to transfer Estes Valley Public Library District
monies directly to the District. Town Administrator
Klaphake commented that the transfer date of April 1,
1990 referred to in the Agreement will require a
budget amendment, thus the actual transfer may not
actually occur on April 1, 1990. Trustee Habecker
introduced, and Town Attorney White read in full, the
resolution approving the Agreement between the Estes
Valley Public Library District and the Town whereby
the Town would agree to transfer Estes Valley Public
Library monies to the Estes Valley Public Library,
and moved it be passed and adopted. Trustee Hix
seconded the motion and it passed unanimously.
B. Ordinance 3-90. Town Attorney White also briefed the
Trustees on an ordinance approving a 99-Year Ground
Lease to the Estes Valley Public Library District for
the library building site. Trustee Aldrich in-
troduced, and Town Attorney White read in full, the
ordinance approving the ground lease, and moved it be
passed and adopted. Trustee Hix seconded the motion

and it passed by the following votes: Those voting
"Yes" Trustees Aldrich, Barker, Dickinson, Garrett,
Habecker and Hix. Those voting "No" none. Whereupon
Mayor Dannels declared the ordinance duly passed and
adopted, and ordered it numbered 3-90 and published
according to law.
Town Clerk O'Connor read a letter received from Connie Boschen
and Marcia Phillips expressing their appreciation to the Town
Board for their Award presented January 23, 1990 pertaining to
the 1989 Christmas Parade. There being no further business,
Mayor Dannels adjourned the meeting at 8:16 P.M.
