Hix Trustee Mayor Dannels called a special meeting of the Board of Trustees to order at 4:18 P.M. Due to a scheduling conflict, the "show cause" liquor hearing dates previously set by the Trustees at their meeting held December 13, 1988 must be revised. Trustee Barker introduced, and Town Attorney White read in full, the following resolutions and moved they be passed and adopted: R E S O L U T I ON 23-88 WHEREAS, a written complaint by David R. Sauter was filed with the Board of Trustees of the Town of Estes Park on December 13, 1988, charging Nita S. Simmerman, dba MOUNTAIN MAN RESTAURANT, License No. 03-42194, with certain violations of the statutes of the State of Colorado and Rules and Regulations of the Colorado Department of Revenue, Liquor Enforcement Division; and WHEREAS, the Board of Trustees has determined that the charges stated therein are probably true; and WHEREAS, the Board of Trustees hereby determines that there is probable cause to believe that the aforementioned licensee has violated one or more of such statutes or rules and regulations; and WHEREAS, the Board feels it is necessary to hold a hearing and issue an Order to Show Cause why the aforementioned license should not be suspended or revoked due to the violations presented to the Board. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO: Section 1. That a public hearing shall be held pursuant to the provisions of Section 12-47-110, C.R.S., and Regulation 47-110.1, on Wednesday, January 11, 1989, at 1:30 P.M., in the Board Room of the Estes Park Municipal Building, 170 MacGregor Avenue, Estes Park, Colorado. Section 2. That the Town Clerk shall cause an Order to Show Cause and Notice of Hearing to be de- livered to the following: Board of Trustees - December 20, 1988 - Page two Nita S. Simmerman dba MOUNTAIN MAN RESTAURANT 366 East Elkhorn Avenue Estes Park, Colorado 80517 RESOLUTION 24-88 WHEREAS, a written complaint by David R. Simmerman, dba THE BACK FORTY, License No, 03-42194-002, with certain violations of the statutes of the. State of Colorado and Rules and Regulations of the Colorado Department of Revenue, Liquor Enforcement Division; and WHEREAS, the Board. of Trustees has determined that the charges stated therein are probably true; and WHEREAS, the Board of Trustees hereby determines that there is probable cause to believe that the aforementioned licensee has violated one or more of such statutes or rules and regulations; and WHEREAS, the Board feels it is necessary to hold a hearing and issue an Order to Show Cause why the aforementioned license should. not be suspended or revoked due to the violations presented to the Board.
