Minutes of the regular meeting held May 27, 1986 were submitted
and approved.
Trustee Brown moved the bills, as presented, be allowed and paid
and that the Clerk be authorized to draw warrants for same. (A
certified copy of the bills presented and allowed are on file in
the Office of the Town Clerk under this date, and made a part of
the record of these proceedings by reference thereto). Trustee
Hix seconded the motion and it passed by the following votes:
Those voting "Yes" Trustees Aldrich, Barker, Brown, Habecker, Hix
and Laing. Those voting "No" none.
Minutes of the Light and Power Committee meeting held June 5,
1986 were read. Trustee Laing, Chairman of the Committee, moved
the minutes be approved. Trustee Brown seconded the motion and
it passed unanimously.
Minutes of the Firemen's Pension Board meeting held June 3, 1986
were read.
Mr. Bill Van Horn, representing the owners, presented the final
plat of Ricciardi Subdivision. The proposed lot split is located
at the southwest corner of MacGregor Avenue and U. S. Highway 34
By -Pass. Two lots are proposed with Lot 1 containing 4,822
square feet and Lot 2 containing 11,213 square feet. Existing
zoning is R-2 Multiple Family. The conditions pertaining to
separate sanitary sewer service lines and a 10' wide utility
easement for the existing natural gas line set by the Planning
Commission have been resolved. Trustee Brown moved the Ricciardi
Subdivision Final Plat be approved. Trustee Aldrich seconded the
motion and it passed unanimously.
Mayor Dannels declared a public hearing to continue consideration
of the Spruce Lake Annexation request. Upon a verbal request of
the owners, Trustee Brown moved the Spruce Lake Addition be
tabled to the next Town,Board meeting scheduled for June 24,
1986. Trustee Laing seconded the motion and it passed unanimous-
ly.
Trustee Hix moved Mayor Dannels be authorized to execute the
Agreement between the Westernaires and the Town for a Horse Show
scheduled June 13 and 14, 1986. Trustee Aldrich seconded the
motion and it passed unanimously.
Trustee Hix introduced, and Town Attorney White read in full, the
following Resolution and moved it be adopted:

NH[R[K3, the Town of Estes Park has received written notice from the
Boulder Daily Camera for the placement of newsracks on the public sidewalks in
Estes Park; and
WHEREAS, h Town has been approached by numerous otherpapers
including, but not limited to, the Loveland Reporter Herald, the Longmont
Times Call, the Estes Park Trail Gazette, the Denver Post, the Rocky Mountain
News and USA Today, indicating a desire to place newsracks upon the public
sidewalks in the downtown area; and
WHEREAS, the Town of Estes Park is considering an ordinance setting forth
the placement, construction and maintenance of newsracks within the downtown
area; and
WHEREAS, certain newspapers have indicated a desire to attempt to enter
into a voluntary understanding regarding the placement, construction and
maintenance of newsracks within the downtown area; and
WHEREAS, it is necessary to provide temporary locations for the placement
of newsracks in the downtown area on public sidewalks for an interim period to
determine whether or not a voluntary understanding can he reached concerning
said newsracks in the downtown area; and
WHEREAS, the Town had determined that it is in the hest interests of the
Town to provide temporary locations for placement of newsracks on public
sidewalks in the downtown area under the terms and conditions of this
resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF
l. The Town hereby authorizes the temporary placement of newsracks at
locations within the designated area as more fully set forth on
Exhibit A, attached hereto and incorporated herein by reference.
2. Each newspaper shall be allowed one (l) newsrack at each of the
locations.
3. Within such designated locations, no newsraok shall be chained,
bolted or otherwise attached to any Town -owned fixture or public way,
including but not limited to, street signs, street lights, benches,
planters, traffic control devices, concrete, brick or asphalt
sidewalks within the public right-of-way. Newsrackx may be
voluntarily attached or secured to one another. Where multiple
newsracks exist in a designated area, no newsrack may be placed or
maintained in any position other than next to another newsrack,
4. This temporary encroachment for newsracks within the designated
locations shall be in effect from June lO, 1986 through July 8, 1986.
5. This approval for temporary encroachment for newsracks shall not
affect any newsraok presently placed within the designated area. No
other npwsruck shall be placed within the designated area without
prior approval of the Town Board other than as specifically
authorized by this Resolution.
Mr. Dean Lehman, Reporter Herald, stated his firm was in
agreement with the Resolution and that he was encouraged by the
possibility of various newspaper companies voluntarily reaching o
compromise with the rvwo' By passing the aesolotioo, rn~n
Attorney White advised a historic precedent would not be ==tab-
liobed' Trustee orm*o seconded the motion and it passed unani-
mously.
Ms' Judith H000ey, Director, Estes Park Public: presented
an Ordinance establishing the Estes Valley Public Library oio-
trict' Chairman of the Board Elaine oostmark and Chairman of the
aoiluims Committee Tucker Wood were also praseot, By approving
the Ordinance, two questions would be added to the ballot for the
general election scheduled November 4, 1986;

1. Shall the proposed Estes Valley Public Library District,
Counties of Larimer and Boulder, which shall include all
property within the boundaries of the Park School
District R-3, be established as a library district?
2. If the proposed Estes Valley Public Library District,
Counties of Larimer and Boulder, is established as
provided in Question #1, shall the legislative body of
each county be authorized to increase the maximum tax
levy from 11/2 mills to not more than 3 mills for the
establishment and maintenance of public libraries?
If approved, revenues could be received in March or April, 1988.
Trustee Laing introduced, and Town Administrator Hill read in
full, the first reading of the Ordinance and moved it be adopted:
AN ORDINANCE REQUESTING THE LARIMER COUNTY BOARD OF
COUNTY COMMISSIONERS AND THE BOULDER COUNTY BOARD OF
COUNTY COMMISSIONERS TO SUBMIT THE QUESTIONS OF THE
ESTABLISHMENT OF THE ESTES VALLEY PUBLIC LIBRARY
DISTRICT AND OF AN INCREASE IN THE MAXIMUM TAX LEVY FOR
THE PROPOSED DISTRICT, IF ESTABLISHED, TO THE QUALIFIED
ELECTORS OF THE PROPOSED DISTRICT
Trustee Habecker seconded the motion and it passed by the follow-
ing votes: Those voting "Yes" Trustees Aldrich, Barker, Brown,
Habecker, Hix and Laing. Those voting "No" none.
Trustee Aldrich introduced, and Town Attorney White read in full,
the following Ordinance and moved it be adopted:
AN ORDINANCE MAKING THE USE OF SKATEBOARDS UPON PUBLIC
SIDEWALKS OR STREETS WITHIN THE TOWN OF ESTES PARK,
COLORADO, UNLAWFUL
Trustee Hix seconded the motion and it passed by the following
votes: Those voting "Yes" Trustees Aldrich, Barker, Brown,
Habecker, Hix and Laing. Those voting "No" none. Whereupon
Mayor Dannels declared said Ordinance duly adopted and ordered it
numbered 11-86 and published according to law.
Trustee Hix moved the Town Clerk be authorized to post the
premises located at 1010 West Elkhorn Avenue advertising two
"Special Events" Liquor Applications submitted by the Estes Park
Elks Home for events scheduled July 19 and September 6, 1986.
Trustee Aldrich seconded the motion and it passed unanimously.
The Estes Park Elks Home also submitted a request to modify the
premises located at 1010 West Elkhorn Avenue. The request
included relocating the bar and enlarging the premises to include
the parking and picnic area presently leased by the Elks Club.
Trustee Hix moved the modification of premises application
submitted by the Estes Park Elks Home be approved. Trustee Laing
seconded the motion and it passed unanimously.
Following completion of all agenda items, Mayor Dannels reported
the "Tregent Park Dedication Ceremony" would be held Wednesday,
June 11, 1986 at 11:00 A.M.
There being no further business, the meeting adjourned.
