A special meeting was oulzeu at the request of the Library Board for
the purpose of reviewing an ordinance to establish a Library
District.
Judy eooaey, Director/Estes Park Library: Ms. Hoxaey informed the
Board that the School Board will meet tonight to address this same
iaopo. The County Library Law is vague regarding procedures for the
formation of a Library oiatrict' Sherman and Howard, the Library's
attorney, and the county attorney differ on interpretation of this
law. The library was informed by the county on August un, 1986
that, in order for an increase of 1.5 to 2'8 mills to be placed on
the November 1986 ballot, the District would have to be formed this
week' If the District is not formed this week, the entire issue
will not come before the electorate before November 1988'

Trustees be appointed to serve with two members of the School Board'
This committee will appoint a seven member Library District opazd'
The present Library Board will serve until a District Board is
ogpoiuted'
In response to a question from Trustee aabenker, if the increased
mill levy question does not receive a positive vote from the
electorate in November 1e86, the rm^u and School Boards could meet
and decide whether to dissolve the District or allow it to remain at
1.5 mills, supplementing the library budget with Town zu"ua'
Responding to a question from Trustee Brown, ss' opoaer stated the
law does not define a limit for the committee to appoint a Library
District Board. Trustee nabeokez suggested waiting to appoint the
Board until after the November 1986 election.
Louis o'miozdau: mr' n'Riord=u stated this special meeting was
illesal' He also informed the Board that as Executive Director of
raxpayer`a rzoat, the burden of an increased mill levy to fund
library operations was unfair. altbomsu mr' o'Riordan is not
opposed to the Library District, he believes in waiting until
November 1988 to allow the pouIio to decide whether there should be
a Library oiatriot'
In reply to the legality of this special meeting and the ordinance
thereof, zmvo Administrator Hill replied that, according to Town
Attorney Grep white;
l) This special meeting is legal and the trustees have been duly
informed;
2} Attorney White has reviewed the document and finds it
acceptable;
3) Intergovernmental agreements are a legal function.

Leslie Kermath/Allenspark: Ms. Kermath asked if a lesser tax could
be imposed for people within the District who are outside the Town
limits and unable to use the library extensively. Ms. Clark replied
that it would not be legally possible to set different mill levies
within a District. Ms. Kermath also asked if it would be possible
for Allenspark to petition the newly formed Library District to
locate a branch library in Allenspark. Ms. Hoxsey answered in the
affirmative.
Margaret Gaskill: Ms. Gaskill stated that the Estes Park Women's
Club started the library and maintained it for a number of years.
They still work to financially support it and asked that the
Trustees consider adoption of this ordinance.
Lennie Bemiss: Ms. Bemiss stated the Town carries the major portion
of financial burden, whereas the county does not. That is why
equitable financial support through a Library District is
recommended. Ms. Bemiss urged the Trustees to vote for the
ordinance.
Carol Fulton: Ms. Fulton urged the Trustees to vote in favor of the
ordinance.
Trustee Brown commented that, due to the adequate show of support at
this meeting, the ordinance is worth considering, and it contains
adequate protection for the voters.
Town Administrator Hill read:
AN ORDINANCE ESTABLISHING THE ESTES VALLEY PUBLIC LIBRARY
DISTRICT AND REQUESTING THE LARIMER COUNTY BOARD OF COUNTY
COMMISSIONERS AND THE BOULDER COUNTY BOARD OF COUNTY
COMMISSIONERS TO SUBMIT THE QUESTION OF AN INCREASE IN THE
MAXIMUM TAX LEVY FOR SAID DISTRICT TO THE REGISTERED
QUALIFIED ELECTORS OF SAID DISTRICT
Mayor Dannels appointed Trustees Aldrich and Laing to serve on the
committee to appoint a Library District Board. Trustee Aldrich
moved for adoption of the ordinance, seconded by Trustee Brown.
Those voting Yes -- Trustees Aldrich, Barker, Brown, Laing,
Habecker. Those voting No -- none. Motion carried. Ordinance
adopted.
There being no further business, the meeting adjourned.
