Minutes of a ...regular meeting of the Board of Trustees of the Town of Estes
Pork, Larimer County, Colorado. Meeting held in the Town Hall in said Town of Estes Park
on the 14th day of April , A. D. 19. $,1 at regular meeting
hour.
Meeting called to order by Mayor Harry B. Tregent
Present: Mayor Harry B. Tregent Trustees: Robert E. Burgess, H. Bernerd
Dannels, Byron L. Graves,
Margaret Houston, Craig W.
Meusel, Robert E. Wagner
Also Present: Town Administrator -
Dale G. Hill
Town Clerk Joan Van Horn
Absent: None
Minutes of the regular meeting held March 24, 1981 were read and
approved as read.
Trustee Robert E. Wagner moved the following bills be allowed and
paid and the Clerk be authorized to draw warrants for the same.
(A certified copy of the bills read and allowed are on file in
the office of the Town Clerk under this date, and made a part of
the record of these proceedings by reference thereto.) Trustee
Graves seconded the motion and it passed by the following votes:
Those voting "Yes" Trustees Robert E. Burgess, H. Bernerd Dannels,
Byron L. Graves, Margaret Houston, Craig W. Meusel, Robert E.
Wagner. Those voting "No" none.
Trustee Robert E. Burgess, Chairman of the Light & Power Committee,
read the minutes of a meeting held April 2, 1981 and moved the
minutes be approved. Trustee Houston seconded the motion and it
passed unanimously.
Trustee H. Bernerd Dannels, Chairman of the Administrative
Committee, read the minutes of a meeting held April 8, 1981 and
moved the minutes be approved. Trustee Wagner seconded the
motion and it passed unanimously.
Trustee H. Bernerd Dannels, Chairman of the Public Works Committee,
read the minutes of a meeting held April 8, 1981 and moved the
minutes be approved. Trustee Wagner seconded the motion and it
passed unanimously.
Paul Kochevar, appearing on behalf of the First National Bank,
presented the First National Subdivision which is a boundary adjust-
ment of Lots 1, 2, 3, 5 & 6, of Lot 17, Block 10, Town of Estes
Park also known as Bauer Subdivision. Trustee Robert E. Wagner
introduced the following resolution and moved it be passed and adopted:
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK, COLORADO:
That the petition and plat of the First National Subdivision
are hereby approved and that the Mayor and Town Clerk are authorized
and directed to sign the plat.
Trustee Burgess seconded the motion and it passed by the following
votes: Those voting "Yes" Trustees H. Bernerd Dannels, Byron L.
Graves, Margaret Houston, Craig W. Meusel, Robert E. Wagner, Robert
E. Burgess. Those voting "No" none.
Trustee Robert E. Wagner introduced the following entitled ordinance
which rezones Lots 1, 4, 5, 6 of Lot 17, Block 10, Tom-"n of Estes Park
now known as Lots 1, 4, 5, 6 of First National Subdivision from R-2
Board of Trustees - April 14, 1981 - Page 2
to C-1. A public hearing on the rezoning was held on March 24,
1981. The Town Administrator read the ordinance in full and
Trustee Wagner moved it be passed and adopted on first and final
reading:
AN ORDINANCE AMENDING CHAPTER 17 OF THE
MUNICIPAL CODE OF THE TOWN OF ESTES PARK,
COLORADO, THE SAME PERTAINING TO ZONING.
Trustee Houston seconded the motion and it passed by the following
votes: Those voting "Yes" Trustees Byron L. Graves, Margaret
Houston, Craig W. Meusel, Robert E. Wagner, Robert E. Burgess,
H. Bernerd Dannels. Those voting "No" none. Whereupon Mayor
Harry B. Tregent declared said ordinance duly passed and adopted
and ordered it numbered #4-81 and published according to law.
Bill Van Horn, representing The Congressional Corporation, pre-
sented the final plat of the Amended Plat of Lots 10, 11, 12, 13,
14, 15, 16, 17 and portions of Lots 1, 6, 8 & 9, Elkhorn Estates.
Trustee H. Bernerd Dannels introduced the following resolution
and moved it be passed and adopted:
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK, COLORADO:
That the final plat of the Amended Plat of Lots 10, 11, 12,
13, 14, 15, 16, 17 and portions of Lots 1, 6, 8 & 9, Elkhorn
Estates be approved and that the Mayor and Town Clerk are
authorized and directed to sign the plat.
Trustee Graves seconded the motion and it passed by the following
votes: Those voting "Yes" Trustees Margaret Houston, Craig W.
Meusel, Robert E. Wagner, Robert E. Burgess, H. Bernerd Dannels,
Byron L Graves. Those voting "No" none.
The Board of Trustees reviewed an application submitted by the
Estes Park Elks Home, Inc. for a transfer of ownership of the
Tavern Liquor License of the Edel Haus currently issued to Charles
and Mary Lou Baumhover. A letter from the Baumhover's attorney,
Neil E. Piller, dated April 10, 1981 was reviewed along with a
letter from the Town Attorney dated April 14, 1981. Harry
Schroeder, Andy Anderson and Mary Lou Baumhover briefly commented
on their interests in the liquor license. Trustee H. Bernerd
Dannels moved that a public hearing to consider the transfer of
ownership of the Tavern Liquor License of the Edel Haus from
Charles and Mary Lou Baumhover to the Estes Park Elks Home, Inc.
be scheduled for April 28, 1981 at 7:30 p.m. provided that the
possession of the property is determined by the Department of
Revenue. Trustee Graves seconded the motion and it passed unanimously.
An application for a change of ownership of the Beer and Wine
License of Vernon and Mary Lou Barrow dba Heidi's Hideaway to
Ulrich Buehler was reviewed by the Board of Trustees. (A former
application submitted by Celestino T. Furlan which was considered
by the Board of Trustees on February 24, 1981 was never completed.)
Trustee H. Bernerd Dannels moved the transfer of ownership be
approved. Trustee Wagner seconded the motion and it passed unani-
mously.
Trustee H. Bernerd Dannels moved the following liquor license
renewal applications be approved:
M.& K. Gregg dba Lazy T Motor Lodge
Collins et al dba Gatsby's
B. Medus dba Longhorn Liquor Mart
K. & Y. Miyauchi dba Fuji -Sun of Tokyo in Estes Park
Trustee Houston seconded the motion and it passed unanimously.
Mayor Harry B. Tregent recommended the following persons be
appointed to the Estes Park Board of Adjustment for three year
terms:

Margaret Houston, Jerry Lamson, Craig W. Meusel
Albert Sager, Robert E. Wagner
Trustee H. Bernerd Dannels moved the appointments be approved.
Trustee Burgess seconded the motion and it passed unanimously.
A request was submitted by John Elley for a 40' curb cut from Lot
14, Thomas Resubdivision onto Comanche Street which would serve
Lots 13, 14 and 15. Police Chief Ault recommended that the curb
cut be reduced to 30' with the addition of 5' turning radii.
Trustee Robert E. Wagner moved the curb cut be granted as recom-
mended by Police Chief Ault. Trustee Dannels seconded the motion
and it passed unanimously.
Several members of the Board of Trustees suggested that the
Building Inspector be allowed to issue all driveway permits.
Mayor Harry B. Tregent referred the matter to the Public Works
Committee.
A request dated April 8, 1981 was received from James A. Durward
to allow a Swedish group to perform singing and dancing on the
sidewalk in front of the Elkhorn West complex on June 23rd.
Trustee Houston moved the request be approved. Trustee Wagner
seconded the motion and it passed unanimously.
*****A request was submitted by James E. Sloan and Hank Fineberg for
two curb cuts onto Manford Avenue from Lot 19, DeVille Subdivision.
Chief Ault recommended that the 20' west curb cut be relocated to
60' from the west property line and that the 30' east curb cut
be allowed at 60' from the east property line. Jim Sloan appeared
and requested the west curb cut be allowed at a distance of 40'
from the west property line rather than 60'. Trustee Robert E.
Wagner moved that the two curb cuts be granted as recommended by
Police Chief Ault. Trustee Dannels seconded the motion and it
passed unanimously.
There being no further business, the meeting adjourned.
