Minutes of the regular meeting held March 13, 1967, were read and approved
as read.
The Clerk presented an application for a renewal of a Retail Fermented Malt
Beverage License in the name of J. P. Haller, dba Jax Snax, 336 East Elkhorn
Avenue, Estes Park, Colorado. The Clerk read the application and the ac-
companying Police report as follows:

Trustee Carl Swanson moved the application be approved. Trustee Ronald C.
Brodie seconded the motion. Upon roll call the following vote was recorded.
Those voting "Yes" Trustees Ronald Brodie, Carl Swanson, and Harry Tregent.
Those voting "No" Trustees Henry Dannels, William Grove, and N. T. Petrocine.
Town Attorney Ernest G. Hartwell's letter dated March 16, 1967 addressed to
the Board of Trustees was read by the Clerk. This letter was a legal opinion
on the Municipal Code of the Town of Estes Park, Sections 14.5-2 (a) and 14.5-3.
After considerable discussion, Trustee Henry Dannels moved the Town Board go
on record as having an intent to comply with the Supreme Court decision- the
case of the City of Colorado Springs vs. Grueskin, No. 21669. Trustee N. T.
Petrocine seconded the motion. Upon roll call the motion passed by the
following votes. Those voting "Yes" Trustees Ronald Brodie, Henry Dannels,
N. T. Petrocine, Carl Swanson, and Harry Tregent. Those voting "No" Trustee
William Grove. Mayor Pro Tem Ronald Brodie referred the study of the gaso-
line dumping ordinance to the Police Committee, and it was the suggestion and
opinion of the Council that the Police Committee shall meet with all of the
local station operators on Tuesday, April 4, at 4:00 p.m., for the purpose of
discussing the above mentioned ordinance.
A letter from Mr. G. Wayne Ballah, President of Big Thompson Meadows, Inc.,
dated March 17, 1967 was read to the Council. This letter offered the former
Joe Mills property for sale to the Town of Estes Park for $90,000.00. Mayor
Pro Tem Ronald Brodie referred this offer to the Public Buildings and Parks
Committee.
Mr. William E. Robertson appeared before the Board and requested permission
to cut the following streets at locations as shown on the Highway #34 Sewer
Extension Plan submitted this date: Grand Estates Drive, Hillside Lane,
and Vista Drive. It is requested that the street cut permit be issued to
the following persons: Fred Efken, J. W. Schlendorf, H. H. Schroeder, Bud

Hohnholz, and Wm. E. Robertson. Trustee Carl Swanson moved that the street
cut permit be granted as per the specifications submitted this date and that
the Street Superintendent be authorized to sign the permit. Trustee Harry
Tregent seconded the motion. Upon roll call the motion passed by the
following votes. Those voting "Yes" Trustees Ronald Brodie, Henry Dannels,
William Grove, N. T. Petrocine, Carl Swanson, and Harry Tregent. Those
voting "No" none.
The Clerk read a letter from Town Attorney Ernest G. Hartwell dated March
24, 1967, giving the legal opinion that the Town did not have the legal
authority to lease a portion of the street right of way known as Old Ranger
Road in Elkhorn Club Estates Addition to the Town of Estes Park, Colorado
for a sign designating the entrance to Elkhorn Club Estates. Trustee Carl
Swanson moved that the application to place an entrance sign in the above
mentioned road be denied. Trustee Henry Dannels seconded the motion. Upon
roll call the motion passed by the following votes. Those voting "Yes"
Trustees Ronald Brodie, Henry Dannels, William Grove, N. T. Petrocine,
Carl Swanson, and Harry Tregent. Those voting "No" none.
Mr. Ernest E. Altick appeared before the Board and requested permission
to use the street right of way located south across the river from the
First National Bank Building and the Estes Enco Service Station for edu-
cational exhibits of non-profit organizations and/or governmental sub-
divisions, all being free to the public. In general, the proposed land
use would become a stage for changing educational exhibits viewed from
the north side of the river. No permanent structures would be erected
and there would be no expense to the Town of Estes Park. Mr. Altick
stated a corral -type fence would be constructed and a foot bridge built
for access. Mr. Altick also stated he would give a right of way across
his property should the Town desire to develop this street right of way as
a public park. Mayor Pro Tem Ronald Brodie referred this matter to the
Street Committee.
Trustee Harry Tregent moved he be given permission as Chairman of the Street
Committee to negotiate the 1967 street oiling program. Trustee Harry
Tregent will submit final prices to the Board of Trustees for their final
approval. Trustee Carl Swanson seconded the motion. Upon roll call the
motion passed by the following votes. Those voting "Yes" Trustees Ronald
Brodie, Henry Dannels, William Glove, N. T. Petrocine, Carl Swanson, and
Harry Tregent. Those voting "No" none.
Trustee Carl Swanson, Chairman of the Public Buildings and Parks Committee,
reported on a meeting of the Public Buildings and Parks Committee as
itemized in their minutes of March 17, 1967 and moved the minutes be
approved and adopted. Trustee Harry Tregent seconded the motion. Upon
roll call the motion unanimously carried.
Trustee N. T. Petrocine, Chairman of the Police Committee, reported on a
meeting of the Police Committee as itemized in their minutes of March 15,
1967, and moved the minutes be approved and adopted. Trustee William
Grove seconded the motion. Upon roll call the motion unanimously carried.

on a meeting of the Light & Power Committee as itemized in their minutes
of March 20, 1967, and moved the minutes be approved and adopted. Trustee
Harry Tregent seconded the motion. Upon roll call the motion unanimously
carried.
There being no further business, it was regularly moved, seconded, and carried
that the meeting adjourn.
