Minutes of a Regular meeting of the Board of Trustees of the Town of Estes
Park, Larimer County, Colorado. Meeting held in the Town Hall in said Town of
Estes Park on the 22nd day of July , A. D. 19 63 _ at regular
meeting hour.

Absent: None
Minutes of the regular meeting held on July 8 read and approved as read.
Trustee Henry Dannels introduced the following entitled ordinance and moved
that it be passed and adopted onsecondreading:
AN ORDINANCE REGUTATING BUILDING AND ELECTRIC
WIRING IN THE TOWN OF ESTES PARK, COLORADO.
ADOPTING BY REFERENCE THE UNIFORM BUILDING
CODE, VOLUME I, 1961 EDITION AND THE NATIONAL
ELECTRICAL CODE, 1962 EDITION. AMENDING
SECTIONS 11.1 AND 11.5 OF THE MUNICIPAL CODE
OF THE TOWN OF ESTES PARK, COLORADO.
Trustee Richard Snart seconded the motion. Upon roll call the motion passed
by the following votes. Those voting "yes" Trustees Ronald Brodie, Henry
Dannels, William Grove, John Ramey, Carl Swanson and Richard Snart. Those
voting "no" none. Whereupon Mayor Clarence Graves declared said Ordinance
duly passed and adopted on second reading and ordered it numbered 241 and
published according to law.
Mr. Clifford Johnson, Chairman of the Chamber of Commerce Advertising Committee,
and Mr. William Rogers, of the Dunshee Advertising Agency, presented the 1963
Advertising Report. Trustee Richard Snart moved the report be accepted. Trustee
John Ramey seconded the motion. Upon roll call the motion unanimously carried.
Mayor Clarence Graves proceeded to conduct a public hearing on the re -zoning
of certain lands within the Reclamation Subdivision of the Town of Estes Park.
The Clerk read the legal publication advertising the date and time of the
public hearing. The Clerk also read the minutes of the Estes Park Planning
Commission meeting held in the Town Hall on June 21, 1963 at 4:00 P.M. Mayor
Graves asked if any written statements had been received supporting the proposed
re -zoning. The Clerk read a petition signed by twenty-one property owners
in the Reclamation Subdivision area supporting the proposed re -zoning. Mayor
Graves asked if there were any persons present who wished to speak in favor
of the proposed re -zoning. Mr. Norman Johnson of the U. S. Forest Service
explained the need for the re -zoning and also answered many questions in
regard to this subject. Mayor Graves asked if any correspondence had been
received opposing the proposed re -zoning. The Clerk replied he had received
no correspondence of this type. Mayor Graves asked if there were any persons
present who wished to speak in opposition to the proposed re -zoning. Mrs.
Florence Lutz, Myrtle Morgan and Mr. Horst spoke in opposition to any re-
zoning in the Reclamation Subdivision. After discussion of the above subject
Trustee Henry Dannels introduced the following entitled ordinance and moved
that it be passed and adopted on first reading:

ORDINANCE NO. 185 OF THE TOWN OF ESTES
PARK, COLORADO, RELATING TO ZONING
DISTRICTS AND ZONING CERTAIN LAND.

Trustee Carl Swanson seconded the motion. Upon roll call said motion passed by
the following votes. Those.voting "yes" Trustees Ronald Brodie, Henry Dannels,
William Grove, John Ramey, Carl Swanson and Richard Snart. Those voting "no" none.
Whereupon Mayor Graves declared said Ordinance duly passed and adopted on first
reading and ordered it numbered 242 and published according to law.
The Town Attorney, Ernest Hartwell, explained the need for the Town to enter into
a lease with the Estes Park Sanitation District in regard to the Country Club Manor
Sewer District. The Town Attorney, Ernest Hartwell, read and explained the lease
in detail. The Board of Trustees discussed the lease of the Country Club Manor
Sewer District lines. After the discussion Trustee John Ramey introduced the following
Resolution and moved that it be passed and adopted:

BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK, COLORADO:
That the Town of Estes Park enter into the proposed lease,
presented to the Board of Trustees, between the Town of Estes Park and the
Estes Park Sanitation District for the leasing of the sewer lines and
rights of way located within Country Club Manor Sewer District, and that
the Mayor and Town Clerk be and they are hereby authorized to execute said
lease on behalf of the Town of Estes Park, Colorado.
Trustee William Grove seconded the motion. Upon roll call said motion passed by
the .following votes. Those voting "yes" Trustees Ronald Brodie, Henry Dannels,
William Grove, John Ramey, Carl Swanson and Richard Snart. Those voting "no"
none.
Mayor Graves explained the previous work done in regard to an employees retirement
program. Trustee John Ramey introduced the following Resolution and moved that
it be passed and adopted:
RESOLUTI 0 N
WHEREAS, under the provisions of Article 2, Chapter 111,
Colorado Revised Statutes, 1953, the employees of municipal corporations
may become members of the Public Employees' Retirement Association with all
the rights and privileges and be charged with all the duties and liabilities
as provided in said article, and
WHEREAS, the Town of Estes Park, Colorado plans to appropriate
funds for the employer's payments to theretirement fund as provided in said
article, and
WHEREAS, the employees of said Town of Estes Park have expressed
their desire to participate in said retirement fund as provided in said article,
NOW, THEREFOR,

BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK, COLORADO:
That the Town of Estes Park apply for affiliation with the Public
Employees' Retirement Association as provided in Article 2, Chapter 111,
Colorado Revised Statutes, 1953, effective as of January 1, 1964, and that
the proper officers of the Town be and they are hereby authorized to perform
all acts necessary to obtain such affiliation and to comply with all
requirements, rules''and regulations of said"Article and Association upon
such affiliation, including the appropriation of sufficient funds for
the Town's participation in the retirement fund, as provided in said article;
That the employees of the Town of Estes Park be notified by
the Town Clerk that they may affiliate themselves with said association as
provided in said article, with membership to be effective January 1, 1964.
Trustee Ronald Brodie seconded the motion. Upon roll call said motion carried
by the following votes. Those voting "yes" Trustees Ronald Brodie, Henry
Dannels, William Grove, John Ramey, Carl Swanson and Richard Snart. Those
voting "no" none.
Mayor Graves informed the Board that the proposed ordinance in regard to
planning and subdivisions had now, after many months of study, been approved
by the Town Attorney, the Town Engineer, and the Secretary of the Planning
Commission. Trustee Ronald Brodie moved the proposed ordinance on planning
and subdivisions be referred to the Planning Commission for study and final
recommendations. Trustee Henry Dannels seconded the motion. Upon roll call
said motion carried by the following votes. Those voting "yes" Trustees
Ronald Brodie, Henry Dannels, William Grove, John Ramey, Carl Swanson and
Richard Snart. Those voting "no" none.
The Clerk presented the application of Richard F. Snart and Ted C. Jelsema, DBA,
Super Food Market for a renewal of a Retail Fermented Malt Beverage License.
Trustee Henry Dannels moved the application be approved. Trustee Ronald Brodie
seconded the motion. Upon roll call said motion carried unanimously.
Mayor Graves appointed Dale G. Hill, Town Clerk, to prepare the annual General
Fund Budget for 1964 and submit it to the Board of Trustees for approval. Mayor
Graves reminded the Trustees to prepare their individual committee recommendations
in regard to the proposed budget.
Trustee Henry Dannels, Chairman of the Water Committee, reported the Water
Department is considering making the water regulations more restrictive.
The Water Committee will not take any action until the end of this week.
Trustee John Ramey announced the Northern Colorado Fire Fighters Association
field day scheduled for Estes Park, August 19, has been cancelled.

Town Attorney, Ernest Hartwell, reported it was his opinion the Town does not at
the present time have the legislative authority to condemn old buildings. The
Board of Trustees instructed the Attorney to prepare an ordinance enabling the
Town to condemn unsafe buildings.
Mr. Ned Linegar spoke to the Board of Trustees in regard to illegal gambling
allegedly being conducted within the corporate limits of Estes Park. Mr. Linegar
said he would prepare a written report substantiating this and give it to Mayor
Graves. It was the opinion of the Board of Trustees that do illegal gambling will be
permittgd in the Town of Estes Park.
There being no further business it was regularly moved, seconded and carried that
the meeting adjourn.
