Meeting held in the Town Hall in said Town of Estes Park on the 24th day of____April A. D. 19._61._ at regular meeting hour. Meeting called to order by•Mayor ClarenceA, Present: Mayor Clarence A. Graves Trustees: Ronald C. Brodie, Andy Jones, Henry Darnels, William Grove, John Ramey, Richard Snart Also Present: Verne H. Tanton, Town Clerk; H. F. Miller, Town Attorney Absent: None Minutes of the regular meeting held on April 10, 1961 read and approved as read. Mr. Lee Byerly appeared before the Board and requested a variance from the Sign Ordinance for the instAJ1ation of a sign on the front of the National Park Hotel. Due to the fact that the State Highway Department exercises certain jurisdiction over Elkhorn Avenue, the Board suggested that the request be approved by the Highway Department and then presented to the Board at the next meeting. Trustee Jones reported that he and Trustee Grove had received proposals and had met with +several engineering firms regarding a proposed survey in order to determine the future use of the Town Dump including the possibility of constructing an incinerator. Trustee Jones reported that the Committee recommends entering into a contract with the firm of Williams & Woodward of Denver at a proposed cost of $2500 for the above service. Mr. John Williame appeared before the Board and reviewed the proposal. Trustee Jones moved that the Mayor and Clerk be authorized to enter into the above contract. Trustee Grove seconded the motion. Upon roll call said motion unanimously.carried. Mr. Merl Morehead appeared before the Board asking for an interpretation of the Zoning Ordinance requesting permission to install a coin,operated dry cleaning machine at the South St. Vrain Shopping Center. Following an explanation and the discussion, Trustee Dannels moved that the request be approved. Trustee Snart seconded the motion. Upon roll call said motion unanimously carried. Mr. Merl Morehead filed a written request for a hearing before the Board of Adjustment regarding the proposal to re -zone properties on the South St. Vrain from C-2 Restricted Commercial District, to a C-1 Commercial District. The Board of Adjustment, consisting of Trustees Dannels, Grove, Jones, Ramey, and Snart, agreed to hear the appeal on May 8 at 7:30 P.M. Trustee Jones being a property owner involved abstained from expressing any opinion. Mr. and Mrs. Frank Runs, together with Mr. Loeb of Denver and Mr. Charles Miller, appeared before the Board and spoke asking the Town to reconsider the application for a Liquor License that was denied at the regular meeting held on March 27th, 1961. Mayor Clarence A. Graves asked the Town Attorney to explain the legal status of this request. The Town Attorney, Mr. H. F. Miller, read the applicable State Statutes together with a Supreme Court Ruling and stated that in his opinion the Town Board could not consider the application of Mr. Frank Runs at this same location until the expiration of a two year period. In accordance with the applicants request and the discussion, Trustee Dannels moved that in addition to the above legal advice, the Town Attorney request any opinions regarding the matter from the State Attorney General. Trustee Snart seconded the motion. Upon roll call said motion unanimously carried. Mr. Hen Pearson together with Mr. Forest Williamson and Mr. Gene Brough, property owners of Little Prospect Addition, appeared before the Board and asked that the Town maintain and improve the street designated as Hyland Road. Mayor Graves asked that the Street Chairman, Trustee Ramey, meetwith the Street Superintendent and the property owners and try to arrive at a decision. Present: Mayor Trustees: Also Present: Absent: Mr. Paul VanHorn ha been ployed by the Town to make a survey of the river between the East Riverside Bridge and the South St. Vrain Bridge appeared before the Board and presented a Plat showing the minimum widths and the +,___.+;um river flow through the above area. The purpose of the Plat is to show the minimum river width that must be maintained in order to ace ate the ++ • um high-water flow to avoid possible f1... •- >,e. The Board instructed Mr. VanHorn to complete the Plat in final form to be filed with the Town. The Board also authorised Trustees Jones and Grove to negotiate with Mr. VanHorn for the preparation of a similar Plat of the river thr• other parts of the Town. Mayor Graves reported that the Local Civil Air Patrol Unit had asked permission for space to store a first -aid trailer at Stanley Park. The request was referred to the ding Committee for disposition. Trustee Brodie reported that the Light and Power C•+++++ ttee had again st ed the results of a survey made reg g the possibility of the Town operating a television boosterwatation. Following the review, Trustee Grove moved that due to the incomplete returns of the survey that the Town take no further action at this time. Trustee Dannels seconded the motion. Upon roll call d motion unanimously carried. Trustee Brodie read the minutes of the last regular meet y of the Light and Power C•+++.ttee and moved that they be accepted. Trustee Grove seconded the motion. Upon roll call said tion unanimously carried. Trustee Grove reported on the scheduled Civil Defense Alert sponsored by the state agency and to be held on Friday of this week. Meeting called to order by Mayor_ Clarence A. Graves,,,,, Present: Mayor Trustees: Also Present: Absent: Said Ordinance was then read in full. Trustee Ramey seconded the motion. The roll was called with the following results. Those voting"yes" and in favor of passing the Ordinance. Trustees Ronald Brodie, Andy Jones, Henry Dannels, William Grove, John Ramey, and Richard Snart. Those voting "no" none. Whereupon Mayor Clarence Graves declared said Ordinance duly passed and adopted and ordered it numbered 214 and published according to law. The Clerk reported that in accordance with Legal Publication the Local Planning Commission had conducted a Public Hearing and had recommended to the Town Board that certain lands within the Town be zoned, together with other certain lands to be re -zoned as itemized in the minutes of the regular meeting of the Commission held on April 18, 1961. Trustee Dannels moved that the Town Board hold a Public Hearing and consider the recommendation for zoning and re -zoning on May 22, at 7:30 P.M. Trustee Ramey seconded the motion. Upon roll call said motion unanimously carried. In accordance with the provisions of the Model Traffic Ordinance, No. 155, the Board set forth all parking restrictions to become effective May 27th, ordered the same to be on file, and made a part of these minutes by reference thereto. Trustee Jones moved that the above restrictions be adopted and approved. Trustee Brodie seconded the motion. Upon roll call said motion unanimously carried. There being no further business it was regularly moved, seconded, and carried that the meeting adjourn.
