Fenton, Town Clerk Absent: None Minutes of the regular meeting held on July 13, 19,59 read and approved as read. Mrs. Clair Noyes together with Mr. and. Mr3. Hal J. Earnhardt appeared. before the Board akin that the oard consider the annexation of a subdivision. located. on U.S. Highway #34 formerly known as the Magoffin Tract and now owned by Mr. Earnhardt.Following the explanation and. discussion, Trustee Dannels moved that the Board. consider the request for annexation favorably providing water service is extended to the subdivision from a designated point in Stanley. Heights Addition B and following the Highway #344 right-of-way to the proposed subdivision and pro- viding further that all required subdivision regulations are complied with together with the approval of the Local Planning Commission and subject to final approval of the Town Council, Trustee Brodie seconded the motion. Upon roll call. said motion. unanimously carried. The Clerk presented a petition and plat for the annexation of certain territory designated as Meyers Addition to the Town of Estes Park and stated that al1. legal requirements had been complied with regarding the annexation procedure. WEERZUPON Trustee Brodie introduced the following entitled ordinance and moved. that it be passedand adopted: ORDINANCE APPROVING THE ANNEXATION OF CERTAIN ITORY TO THE TOWN OF ESTES PARK, COLORADO TO OWN ARO DESIGNATED AS "MF0YER ADDITION TO THE TOWN OF ESTES PARK, COLORADO."' Said Ordinance was then, read in full. Trustee Grove seconded the motion. Upon. roll call said Ordinance'adopted by. the following vote: Those voting "YeeE Trustees Brodie, Dannels; Grove, Herzog and Ramey. Those voting No none. WHEIMTPON Mayor Graves declared said Ordinance adopted, ordered it numbered. 197 and published according to law. Mayor Graves reported that Er, George Noyes had. asked to purchase 4400 tons of rock material from the Fall River Power Plant grounds. The opinion of the Board being that this material would be needed by the Town in the future. Trustee Herzog. moved that the request be denied. Trustee Grove seconded the motion. Uponroll.. call said motion unanimously carried. The Clerk read the minutes of the regular meeting of the Local Planning Commissionheld on July 21, 1959. The minutes referred. to a public hearing conducted by the Planning Commission, regarding the re -zoning of the C. M. Fulton property located in Riverside Subdivision from R-2 Multiple Family District to. a 0-1 Commercial District and in which the Commission recommended that the above request in zoning be approved. Trustee Dannels moved that the Planning. Comrnissione recommendation be approved and that the ordinance be amended accordingly. Trustee Grove seconded the motion. Upon roll. call said motion. unanimously carried. Referring to the above minutes of the Planning Commission, the Clerk reported that the Commission had denied a request submitted. by Merl Morehead to re -zone Lots 7, 8, 9, 1 and 12, Block 2, Reclamation Subdivision from. C-2 Restricted Commercial to C-1 Commercial, Trustee Herzog moved that the recommendation of the Commission to deny the request be approved. Trustee Dannels seconded the motion.
