Minutes of a regular meeting of the Board of Trustees of the Town of Estes Park, Larimer
Couy, Colorado. Meeting held in the Town Hall in said Town of Estes Park on the 22
nt
day of Jan' , A. D. 19 51 at regular meeting hour.
Meeting called to order by Mayor Ronald C. Brodie
Present: Mayor Ronald C. Brodie Trustees: Chas. Herzog, Merl
Morehead, Jess Poling, George H. Watson.
Also Present: Lee H. Tallant, Supt. of Works
Verne H. Fanton, Town Clerk
Absent: Trustee C.A. Graves, G.E. Casey.
Minutes of the regular meeting held on January 8th, read and
approved as read.
Water Superintendent Lee H. Tallant presented a proposed contract
as drawn by the Town Attorney, between the Town and Elanor E. and
Pester Hondius, dated January 22, 1951, for water service to a new
sub -division South West of the village. The contract was read in
full, whereupon, Trustee Poling moved that the Mayor and Clerk be
instructed to sign the contract on behalf of the Town. Trustee
Morehead seconded the motion. Upon roll call said motion carries
by the following vote: Those voting "Yes" Trustees Herzog, Morehead,
Poling and Watson. Those voting "No" None.
The Clerk presented a proposed contract, presented by the Bureau of
Reclamation, proposing that the Town lease from the Bureau, a power
line, extending from'Mary's Lake', to the East portal of the Adams
tunnel, in order that the Bureau may purchase power from the Town
at said East portal. Following the discussion, Trustee Watson
introduced the following Resolution and moved that it be passed
and adopted, subject to the approval of the Town Attorney.
RESOLUTION
WHEREAS, the United States is furnishing wholesale electric service
to the Contraotor under the provisions of Contract No. 181r-554, dated
May 12, 1947, which contract will expire December 31, 1958; and
WHEREAS, the united States owns and operates a seventy-two hundred
volt, three-phase distribution line in the vicinity of the East Portal
of the Alva B. Adams Tunnel, a feature of the Colorado -Big Thompson
Project; and
WHEREAS, it is economically desirable that the United States
obtain electric service from the Contractor at or near the Eaet Portal of
the Alva B. Adams Tunnel for station service purposes in lieu of
funnishing its own electric service; and
WHEREAS, the contractor desires to utilize a section of said
distribution line for the purpose of furnishing electric service to the
United States and to other customers in that general locality; and
WHE EAS, it is of economic benefit to the United States to grant
the contractor a license for the use of said distribution line, plus
facilities necessary to furnish electric service to the United States,
in lieu of advancing to the Contractor an amount to cover the cost of
an extension of electric facilities which would otherwise be required;
NOW THEREFORE, in consideration of the mutual covenants hereing
set forth, the parties hereto agtee as follows;
The United States does hereby grant to the Contractor license and
authority to use and operate that certain 7200 volt, 3 phase,
distribution line of the United States, said distribution line
consisting of conductors and etructors extending from the Eaet Portal
ofthe Alva B. Adams tunnel for approximately 1.2 miles to the point
of intereection with the electric distribution facilities of the
Contractor,and facilities necessary to provide electric service to
the United States near the East Portal of the Alva B. Adams Tunnel.
No equipment of facilities in addition to the said conductors,
structures, and facilities are to be furnished or provided by the
United States in connection with the privileges exercised by the
Contractor under this license.

Present: Mayor Trustees:
The license and authority hereby granted shall become effective
upon the date of its execution and shall remain in effect until terminated
by either party by written notice of termination given to the other party
sixty days in advance of the effective date thereof.
For and in consideration of the license and authority hereby granted;
(a) The Contractor shall patrol and inspect said distribution
line and facilities at regular intervals and agrees, at its sole
expense, to make all repairs and install and replace any structures,
conductors, and facilities required for the normal operation of the
line. The Contractor or hie duly authorized representative shall
have access at any time to the location of any and all parts of
said distribution line and facilites for the purpose of operating
and maintaining any parts thereof.
(b) The Contractor agrees to furnish electric power and energy
to the United States at a delivery point at or near the East Portal
of the Alva B. Adams tunnel, said power and energy to be furnished
under the terms of a purchase contract to be executed by the parties
hereto.
The Contractor hereby releases and agrees to indemnify and hold
harmless the United States, its officers, agents, and employees, on account'
of all damage or claims fro damage by whomsoever made, and of any nature
whatsoever arising out of or in any manner connected with this license or
the operations thereof.
This license shall terminate and all rights of the Contractor
hereunder shall cease without notice upon breach by the Contractor of any
of the conditions of this license, or of the doing by the Contractor of
any act inconsistent with the provisions hereof. No interest in this
license shall be transferred by the Contractor to any other party without
the written approval of the contracting officer. All rights of action for
breach of this license are reserved to the United States as provided by
Section 3737, Revised Statutes of the United States 41 U.S.C.A. 15.
No member of or Delegate to Congress or Resident Commissioner shall
be admitted to any share or part of this license or to any benefit
that may aries herefrom, but this restriction shall not be construed to
extend to this license if made to a corporation or company for its general
benefit.
In the exercise of the privileges granted under this license, the
Contractor shall not discriminate against any employee or applicant for
employment because of race, creed, color, or national origin.
Said Resolution was then read in full. Trustee Herzog seconded the
motion. Upon roll call said Resolution was duly passed and adopted by the
following vote: Those voting "Yes" Trustees Herzog, Morehead, Poling
and Watson. Those voting "No" None.
The Board authorized the Mayor to eign a license for right of way, with the
Bureau of Reclamation, being a part of a contract between the Town and the
Bureau, under date of January 10, 1949.
Trustee George Watson, together with Carl Bailey, gave a complete, detail,
report, with analysis and statements covering the operation of the Light
& Power department for the year 1950.
There being no further business, the meeting adjourned.
