Brodie Meeting called to order hy Mayor. Present Mayor Ronald C. Brodie Trustees: G.E. Caeey, Clarence Graves, Merl Morehead, Glen Swearingen, and George H. Watson. Absent: Trustee S.M. Hurd Also Present: Lee H. Tallent, Supt. of Worke Ekle.43 Verne H. Fanton, Town Clerk Minutes of the regular meeting held'on August 22nd, read and approved as read. Trustee Graves moved that the following bills be allowed and paid, and that the Clerk be authorized to draw warrants for same. Trustee Casey seconded the motion: Reo Motors Inc., supplies 12.73 E.P. Operating Expenses 949.43 Light & Power, Operating expenses 14,020.63 Upon roll call said motion carried by the following vote: Those voting "Yes" Trustees Casey, Graves, Morehead, Swearingen & Watson. Those voting 'No", none. Wm. E. Banks, Chief of Police and Officer J.L. O'Brien appeared be- fore the Board. Chief Banks informed the .Board that Trustee Hurd, as Police Commissioner had fired Officer O'Brien and that he would like the question clarified and definite as to who is to hire and fire all, Police Department employees, and that he was willing to abide by any decicion of the Board of Trustees. After each member of the Board hed expressed his opinion in discussion, Trustee Watson moved that the Board adopt a policy that no permanent Town employee, in any Department, be fired without a hearing before the Board of Trustees Trustee Swearingen seconded the motion. Upon roll call said motion carried by the following vote: Those voting "Yes" Trustees Casey, Graves, Morehead, Swearingen and. Watson. Those voting "No", none. As a result of the action at the last meeting, the Board considered the proposed light & power extension below Glen Haven. Mr. Chas. Herzog, Michael Marken, and Glen Prosser appeared bdfore the Board representing the E.P. Ch ber of Commerce. They informed the Board that the owner wanted possession of their present office space and porposed that the Town build a small building on the public parking lot and rent it to the Chamber. Mayor Brodie informed the committee to submit estimates of cost and the Board would consider the proposal at the next meeting. The Clerk reported that legal advice had been received concerning the application of Mr, W.G. Winters, whereupon Trustee Watson introduced the following Resolution and moved that it be adopted: RESOLUTION WHEREAS, W.G. Winters has purchased the South one-half(Si) of the Southwest quarter (SW) of Section Sixteen (16), Township Five (5) North, R;ngs. Seventy-three (73) West of the Sixth Principal Meridian, and has at this time no access to said premises from any public road; AND WHEREAS, the Town of Estes Park is the owner of a portion of the North one-half (Ni) of the Southwest quarter OW lying between the premises of W.G. Winters and the public road known as the Old Fall River Road, and the said W.G. Winters desires a right of way across the Towns property to said Old Fall River Road for ingress to and egress from said road to the South one-half (Si) of the Southwest quarter (SWi) of said Section Sixteen (16): NOW THEREFORE, BE IT RESOLVED, That the Town of Estes Park does hereby grant unto the said W.G. Winters, his heirp and assigns, a right of way across the lands of the Town of Estes Park,as follows: An easement for a right of way for ingress to and egress from the South one-half (S) of the Southwest quarter (SWi) of Section Sixteen (16), Township Five (5) North, Range Seventy-three (73) West of the Sixth PrincipaL Meridian, to and from the public road known as the Old Fall River Road, and which right of way shhil be twenty (20) feet in width, being ten (10) feet on each side of the following described center line: Beginning at the Northeast corner of the South one-half (Si) of the Southwest quarter (5Wi) of said Sectjon Sixteen (16); thence West ten (10) feet to the point of beginning; thence North to the Northerly line of the right of way of the Old Fall River Road. Present: Mayor Trustees: The Clerk informed the Board that the annual meeting of the stock -holders of the Estes Park Golf and Country Club would be held on October jrd, whereupon Trustee Graves moved that the Mayor be euthorized to re- present the Town and vote the stock owned by the Town. Trustee Swearingen seconded the motion. Upon roll call said motion carried by the following vote: Those voting "Yes" Trustees Casey, Graves, Swearingen and Watson. 'Those voting No none. The Clerk presented an application for a beer, wine and spirituous liquor license, for the Chez-Jay restaurant and bar, for the year 1950, signed by John A. Murphy, a new operator. After discussing the applicanta qualifications Trustee Graves moved that the application be approved. Trustee Casey seconded the motion. Upon roll call said motion carried by the following vote: Those voting "Yes" Trustees Casey, Graves, Swearingen and. Watson. Those voting "No" none. The Clerk informed the Board that he and the Mayor would meet with the County Commissioners and a representitive of the State Highway Department this week in a final effort to raise money for right of way for a new bridge at the East end of Elkhorn Ave. The Board authoriZed the Clerk to offer 1,300.00 of Town funds, toward the right of way, payable from gas tax receipts during1950. Water Superintendent Tallant reported that the mobile unit of the Town water thawing equipment would have to be replaced. , The Board authorized the purchase of either a used Ford Truck from Ted Finger Motor Co., or a new Reo truck from Reo Motors, Inc. There being no further business to come before the meeting, it was regularly moved, seconded and carried. that the meeting adjourn. Attest:
