D. 191.° . at regular meeting hour. Meeting called to order by Mayor.„0...N...R.OQkWOLL Present: Mayor C.N RO ck ell Trustees: Guy W. AibriRht, Ronald C. Brodie, G.E. Casey, R.H. Lindley George H. Wats n, Absent: Trustee, Glen R. Preston This meeting was called for the purpose of discussing certain obstructions that were being built in Fall River at the West end of Elkhorn Avenue. The Town Attorney, Hatfield, Chilson, was present, and after considerable discussion, trustee Casey moved and trustee Lindley seconded the motion that the clerk be instructed to write the following letter to Vr. .E. Baldridge and to Mr. Ames J. Glendenning, and that a copy of same be incorprated into the minutes of this meeting® "At a special meeting of the Town Board held in the evening of Tuesday, April 30, 1 was instructed to write you concerning the building which you are now constructing across Fall giver near the Westerly end of Elkhorn Avenue. The Town Board believes that the construction of the piers in the channel of the river constitutes a grave hazard not only to private property, but also to the streets of the Town and particularly, Elkhorn Ave. The Town Board believes that the congestion of the channel of Fall River by the construction of the piers in the channel will cause the river to back up and overflow during times of high water, and when this occurs, the natural course for the overflow to take is along Elkhorn Avenue. The purpose of this letter is to advise you of the hazard which, exists and to further advise you that if the construction is carried out as you have planned, that the Town will expect you to save them harmless from any loss by reason of any overflow of the River which results from your construction." The above motion ras carried by the following vote, Yes: trustees, Albright, Brodie, Casey, Lindley and Watson. No: None.
