Upon roll call said moti on. was carried. by the following
vote: Yes, trustees Brodie, Casey, Lindley, Preston and.
Watson, No, Nome.
After reading the reply fromthe town attorney,
Hatfield Chilson, concerning a, claim for damages from. Leo
Tigto, Trustee Carey introducedthe following Resolution:

Minutes of a meeting of the Board of Trustees of the Town of Estes Park, Larimer
County, Colorado. Meeting held in the Town Hall in said Town of Estes Park on the
day of. A. D. 19 . at regular meeting hour.
Meeting called to order by Mayor
Present: 11,Aelyor Trustees:
RESOLUTION
WHEREAS, Leo Tighe has made demand upon the Town
of Estes Park for damages resulting from the flooding of
the basemont of hi a store from seepage from a sewer main
ownedand operated by the Town;
And WHEREAS, the said Leo Tighe has of fered. to
compromise said claim for the surn, of Seventy-five ($75.00)
Dollar's;
AND WHEREAS, the Town of Estes Park denies any
liabilityfor the damages, if any, resulting to 1M:r. Tighe;
AND WHEHEAB, the amount involved is small and
the parties desire to compromise said claim and avoid
litigation;
NOW, THEREFORE, BE IT RESOLVED, that the Town
of Estes Park pay. to. Leo Tighe the sum of Seventy-five
($75.00) Dollars in full settlement of all claims of
every kind and nature resulting to the said Leo Tighe
from the flooding of the basement of the Edtes Park Drug.
Store which occurredon or about February 12, 1940,
Whereupon Trustee Brodie moved. and Trustee Watson
secondedthe motion that said. rololution be passed and
adopted. Upon roll. call said motion. was carried by the
following vote: Those voting "Yes"; Trustees Brodie,
Casey, and Watson, Those voting to Trustee Preston.
Those not voting Trustee Lindley,
Mayor Rockwell submitted the names of thenewly
elected officers of The Estes Park Volunteer Fire Department
for approval of the Board. Trustee Preston moved. and Trustee
Watson seconded the motion that the following officers of
The Estes Park Volunteer Fire Department be, and are hereby
approved; M,J, Poling, Chief, Ronald C. Brodie, Assisant
Chief, Verne H. Fenton, Secrotary-Ereasurer. Uponroll
call said motion was carried by the following vote ; Yes,
Trustees, Brodie, Casey, Lindley, Preston. and Watson, NO,
None
Wallace. Merrick, F.W. Volpert and F.A. Heckandorf
appeared before the board and submitted conditional bids
and estimates on. widening the lower end of Anderson. Lane.
After considerable discussion, Trustee Watson moved and
Trustee Casey seconded the motion that the strcet and alley
committee be empowered to enter into a contract with F A,
Rackandorf on. a. cost plus 10% basis. Upon roll call said
motion was carried by the following vote; Yes, tructees
Brodie, Casey, Lindley, Preston and Watson, No, None,
Trustee Lindley introduced the following resolution:
RESOLUTION
WHEREAS, The Boulder-Oreeley Company has consented
to the construction of the Town's water main across a portion
of their property;

Present: Mayor Trustees:
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF ESTES PARK, COLORADO, that for and in. consider-
ation of the easement and right of way for said pipe line across
the lands of The Boulder -Greeley Company, the Town does here-
by give unto The .Boulder -Greeley Company, the right to one
tap on said pipe line for the purpose of obtaining water for
the use of The Boulder -Greeley Companyor its members, and
no charge shall be made for said tap; provided, however, that
The Boulder -Greeley Company shall pay for the water used from
said tap at the same rates as are now established or which
may be hereafter established by the Town for the use of waterL-
outside of the corporate limits of the Town of Estes Park)
and that said water so used shell he used under the same terms
and conditions and under the same regulations as are now or
may hereafter established by the Town for the use of such water.
Whereupon. Trustee Watson moved and Trustee Preston
seconded the motion that said resolution be passed and adopted.
Upon roll call said motion was darried by the following vote:
Yes, trustees Brodie, Casey, Lindley, Preston and Watson.
No, None.
There being no further business to come before the meeting
it was regularly moved, seconded and carried that the meeting
adjourn.
