Meeting held in the Town Hall in said Town of Estes Park on the.. day of.„,.,,, July , A. D. 19..36 at regular meeting hour. Meeting called to order by Mayor c• HP Present: Mayor C, N. Rockwell Trustees: Harry B. Boyd, G. E. Casey, C. Byron Hall, S. M. Hurd, Glen H. Preston, and E. R. Rivers. Clerk, Chas. F. Hix. Also present were Ab H. Romans, Town Attorney, and Judge F. W. Stover, Attorney for Mrs. Ethel S. Mills, executrix. Judge Stover and Ab Romans discussed the case of Town of Estes Park vs. Enoch J. Mills, and Alto the betite that had been given Mra. Ethel S. Mills, executrix of Estate of Enoch J. Mills, deeeeeed whereby the Town tendered her the sum of nine hundred dellerett900.'00} with the neticeto disconnect the Crags Hotel sewer from the Ton sewer within sixty days thereafter. Judge Stover explained that to disconnect the Crags sewer system during this Month would 'certainly work a hardship on the Mille Estate, and he -a -eked that this action be deferred on this notice until pending case between the Town and the Mille Estate be decided by the Supreme Court. Thereupon Mr. Rumens- stated that this would only delay the case further. Thereupon,- Trustee ffa11- moved and Trustee Casey seconded the motion that the Town Attorney be instructed nutty weit.on the out come of the suit now pending before the Supreme Court,- and that the Crags Hotel be disconnected after the sixty days have elapsed from the time .Mrse Mille wee —tendered the -nine hundred dollars and given the disconnection notice. Upon roll call said motion was carried by the following vote: Yea, Trustees Boyd, Casey, Hall, Hurd, Preston, and Rivers. Nay, none. Trustee Casey moved and Trustee Boyd seconded the motion that if the Mills Estate brings injunction suit against the Town enjoining the To 1 from disconnecting the Crags Hotel from the sewer system, that the Town Attorney shall not oppose a temporary injunction, that the Crags might operate the balance of this season without interferen Upon roll call said motion was carried by the following vote: Yea, Trustees Boyd, Casey, Hall, Hurd, Preston, and Rivers. Nay, none. e. Trustee Hall moved and Trustee Casey seconded the motion that the Water Superintend— ent be instructed to install a twenty barrel water storage tank on the water main running to the Madden and the Black properties. Upon roll call said motion was carried by the following vote: Yea, Casey, Hall, Hurd, Preston, and Rivers. Nay, none.
