HomeMy WebLinkAboutRESOLUTION 16-21RESOLUTION16-21APPROVINGTHEAMENDEDPLATOFAPORTIONOFLOTS3,4AND5OFLITTLEPROSPECTMOUNTAINADDITIONTOTHETOWNOFESTESPARKWHEREAS,anapplicationforanAmendedPlat,torearrangeandcombinethreelotsintotwolotsbyadjustinginternallotlineswasfiledbyMargueriteWest(owner/applicant);andWHEREAS,thepropertyislocatedapproximately1000feetwestoftheintersectionofStanleyCircleandStanleyAvenue,addressedas153WestonLane;andWHEREAS,theAmendedPlatwillcombineLot5BoftheD.WestMinorSubdivisionwithaportionofLot4ofLittleProspectMountainAdditiontotheTownofEstesPark,andadjustthecommoninternallotlinebetweenthePortionofLot3andPortionofLot4ofLittleProspectMountainAdditiontotheTownofEstesPark,resultinginLot5Bbeingeliminated,withLot3AandLot4AreconfiguredtobothbeincompliancewiththeminimumrequitedstandardsfortheE(Estate)ZoneDistrict;andWHEREAS,apublicmeetingwasheldbeforetheEstesParkPlanningCommissiononJanuary19,2021,attheconclusionofwhichthePlanningCommissionvotedtorecommendapprovaloftheAmendedPlatwiththefollowingfindings:1.ThisproposalcomplieswithapplicablesectionsoftheEPDC.2.Thisrequesthasbeensubmittedtoallapplicablereviewingagencystaffforconsiderationandcomment.Nosignificantissuesorconcernswereexpressedbyreviewingstaffrelativetocodecomplianceortheprovisionofpublicservices.3.TheEstesValleyComprehensivePlan’sCommunityWidePoliciesandFutureLandUseCodecategoryrecommendthesubjectpropertybedevelopedasE(Estate).Stafffindstheexistingresidentialzoninganduse,andtheproposednewlotconfigurationisnotinconsistentwiththerecommendationsoftheComprehensivePlan.4.Withinhundredeighty(180)daysoftheBoard’sapprovaloftheAmendedPlatapplication,thedevelopershallsubmittheplatforrecording.litheplatisnotsubmittedforrecordingwithinthishundredeighty-daytimeperiod,theapprovalshallautomaticallylapseandbenullandvoid.5.ThisisaPlanningCommissionrecommendationtotheTownBoard;andWHEREAS,apublichearing,precededbyproperpublicnotice,washeldbytheBoardofTrusteesonFebruary23,2021andatsaidhearingallthosewhodesiredtobeheardwereheardandtheirtestimonyrecorded;andWHEREAS,theBoardofTrusteesfindstheAmendedPlatcomplieswiththeapplicablerequirementsoftheEstesParkDevelopmentCode.
