HomeMy WebLinkAboutRESOLUTION 15-21RESOLUTION15-21APPROVING1STAMENDEDPLATOFLOTS4AAND5AOFTHEAMENDEDPLATOFMOUNTAINMEADOWSUBDIVISION,TOWNOFESTESPARK,COLORADOWHEREAS,anapplicationforaPreliminaryandFinalAmendedPlatwasfiledbyTrailRidgeConsultingEngineersonbehalfofGregoryandSherialStarr(applicant/owner);andWHEREAS,theAmendedPlatwouldconsolidatetwoexistinglots,Lot4AandLot5A,bothofMountainMeadowSubdivision,asamended,of0.37and0.35acresinsize,respectively,intoonenewlot,Lot4B,of0.72acresinsize;andWHEREAS,apublichearingwasheldbeforetheEstesParkPlanningCommission(EPPC)onJanuary19,2021,attheconclusionofwhichtheEPPCvotedtorecommendapprovalofthePreliminaryAmendedPlatwiththefollowingfindings:1.ThisproposalcomplieswithapplicablesectionsoftheEstesParkDevelopmentCode(EPDC).2.Thisrequesthasbeensubmittedtoallapplicablereviewingagencystaffforconsiderationandcomment.Noissuesorconcernswereexpressedbyreviewingstaffrelativetocodecomplianceortheprovisionofpublicservices;andWHEREAS,theBoardofTrusteeshasreviewedandtakenadministrativenoticeoftherecommendationoftheEPPCandthetestimony,application,evidence,documentssubmittedatthehearing;andWHEREAS,theBoardofTrusteesfindstheapplicantshavecompliedwiththeapplicablerequirementsoftheEPDC.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:1.ThePreliminaryandFinalAmendedPlatsof1StAmendedPlatofLots4Aand5AoftheAmendedPlatofMountainMeadowSubdivisionareherebyapproved,withthefollowingconditionsofapproval:a.Within60daysfromthedateoftheBoard’sapprovaloftheFinalAmendedPlat,thedevelopershallsubmitthefinalsubdivisionplattotheTownforrecording.litheFinalAmendedPlatisnotsubmittedforrecordingwithinthis60-daytimeperiod,theapprovalshallautomaticallylapseandbenullandvoid.
