Home My WebLink AboutRESOLUTION 06-21RESOLUTION06-21ALTERNATIVESFOR2020UNPAIDPARKINGCITATIONSWHEREAS,TownofEstesParkstaffandTrusteesacknowledgethat2020waschallengingyearformanywholivein,workinandvisitedEstesPark;andWHEREAS,theTown’sParking&TransitDivisionstaffarecontinuouslyworkingtoidentifycreativewaystobalancetheirregulatorydutywiththeircommitmenttoprovideoutstandingcustomerservice;andWHEREAS,section10.04.020oftheEstesParkMunicipalCodeauthorizestheTown’sParking&TransitManagertoreducetheamountchargedforparkingviolationfinestoincentivizeearlypayment;andWHEREAS,theTownofEstesParkwouldliketoofferalternativesforthosewishingtoresolveanunpaidparkingcitation.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1:TheParking&TransitManager,ortheManager’sdesignatedstaffmemberorcontractor,isauthorizedtoofferthefollowingalternativestopaymentofunpaidparkingcitationsthatwereissuedbetweenJanuary1,2019andDecember31,2020:a.SubmittalofareceiptshowingadonationbythecitedindividualtoanonprofitorganizationthatisbothlocatedwithinandthatprincipallyservestheEstesValley,asdefinedbythebytheboundariesofEstesParkSchoolDistrictR-3;orareceiptshowingthepurchasebythecitedindividualofagiftcardorgiftcertificatetoanybusinesslocatedwithintheTownofEstesPark,inanamountequaltoorgreaterthantheunpaidbalance.ReceiptsmustbedatedafterFebruary1,2021.b.ForcitationspaidonorbeforeMarch1,2021,paymentof50%oftheunpaidbalance.c.ExecutionofaninstallmentagreementinaformapprovedbytheTown,wherebytheindividualmustpaythefineamountininstallmentstobecompletednolaterthanDecember31,2021,andfullperformanceofsuchagreement.Section2:TheBoardfindsthatthealternativeuseoftherevenuesforgoneundersection1(a)ofthisresolutionwillassistlocalbusinessesandnonprofits,includingbyhelpingretainemployees.TheBoardfindsthatthisisforthepublicpurposeofprotectingtheeconomicandsocialvitalityoftheTownby(1)supportingemploymentforresidentsoftheTown,allowingemployeestocontinuetolivelocally,andultimatelytocontinuetocontributetotheTown’staxbase;and(2)supportingbusinessesintheTownthathave beendisadvantagedbytheCOVIDpandemic,andsupportinglocalbusinesses’abilitytostayinbusinessandcontributetothediversityofcommerceintheTownandtotheTown’staxbase.TheBoardfindsthattheresolution’spublicpurposesarebothsignificantandsubstantial,andjustifyforgoingthecollectionofthesefunds.TheBoardalsofindsthattheTownwillreceiveadequatereimbursementforitsfinancialcontributionsunderthisresolutionintheformofthesignificantandsubstantialpublicbenefitsdescribedabove.Section3:TheBoardrepealsallresolutionsorpartsofresolutionsinconflictwiththisresolution,butonlytotheextentofsuchinconsistency.DATEDthisZf5dayof________________,2021.TOWNOFESTESPARKMayor/ATTEST:TlerkAPPROVEDASTOFORM:TownAttorney
