HomeMy WebLinkAboutRESOLUTION 66-20RESOLUTION66-20APPROVINGTHEMOUNTAINWOODTOWNHOMESAMENDEDPLAT,TOWNOFESTESPARK,COLORADOWHEREAS,anapplicationforanAmendedPlat,toadjustaninternallotlinewithinaplatted‘TownhomeSubdivision”wasfiledbyGurungYogyesh,TianYingying,PoudyalParas,ShresthaSabir(owner/applicants);andWHEREAS,theMountainWoodTownhomesSubdivisionisrecordedintherecordsoftheLarimerCountyClerkandRecorderatReceptionNo.20180040665,onJuly5,2020;and,andlocatedwithinanRM(Multi-FamilyResidential)ZoningDistrict;andWHEREAS,abelowgradepatioforusebytheunitonLot2ofMountainWoodTownhomesSubdivisionwasconstructedandislocatedpartiallyonLot1ofMountainWoodTownhomesSubdivision;andWHEREAS,theAmendedPlatrearrangesaninternallotlineinordertocontainsaidpatioentirelyonLot2,withnootherchangestotheplatbeingproposed;andWHEREAS,apublicmeetingwasheldbeforetheEstesParkPlanningCommissiononOctober20,2020,attheconclusionofwhichthePlanningCommissionvotedtorecommendapprovaloftheAmendedPlatwiththefollowingfindings:Findings:1.ThisproposalcomplieswithapplicablesectionsoftheEstesParkDevelopmentCode.2.Therearenoadverseimpactscausedbythisslightadjustmentofaninternallotline.3.Thisrequesthasbeensubmittedtoallapplicablereviewingagencystaffforconsiderationandcomment.Noissuesorconcernswereexpressedbyreviewingstaffrelativetocodecomplianceortheprovisionofpublicservices.4.Withinsixty(60)daysoftheBoard’sapprovaloftheFinalPlatapplication,thedevelopershallsubmittheplatforrecording.Iftheplatisnotsubmittedforrecordingwithinthissixty-daytimeperiod,theapprovalshallautomaticallylapseandbenullandvoid.5.ThisisaPlanningCommissionrecommendationtotheTownBoard.WHEREAS,apublichearing,precededbyproperpublicnotice,washeldbytheBoardofTrusteesonNovember24,2020andatsaidhearingallthosewhodesiredtobeheardwereheardandtheirtestimonyrecorded;andWHEREAS,theBoardofTrusteesfindstheapplicantshavecompliedwiththeapplicablerequirementsoftheEstesParkDevelopmentCode. NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:TheMountainWoodTownhomesSubdivisionAmendedPlatisherebyapproved,ontheconditionthataddressesasshownontheAmendedPlatforlots1A,2A,3,4,5,6,7,and$beremovedbeforetheAmendedPlatisexecuted.DATEDthisV44-dayofUf12020.ATTEST:TnClerkAPPROVED—TOWNOFESTESPARKASTOFORM:TownAttorney
