Home My WebLink AboutRESOLUTION 63-20RESOLUTION63-20ARESOLUTIONSUSPENDINGUTILITYFEESFOR2020CAMERONPEAKFIREVICTIMSLOSINGELECTRICSERVICEWHEREAS,inOctober2020,theCameronPeakFireintheserviceareasoftheTown’sPower&CommunicationsEnterprisedamagedpublicandprivatepropertyandtheTown’selectricutilitydistributionsystem;andWHEREAS,somehomesandbusinessesweredestroyedordamagedandtheirelectricserviceisunavailable;andWHEREAS,pursuanttotheTown’sutilityrates,allcustomersarerequiredtopayminimummonthlyutilitytees;andWHEREAS,theBoardofTrusteesservesastheBoardofDirectorsfortheTown’sutilitiesandhastheauthoritytomodifyelectricchargesunderspecialcircumstances;andWHEREAS,theTownBoardofTrusteeswishestosuspendmonthlyminimumchargesforelectricityasprovidedinthisResolution.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:1.ThemonthlyminimumchargesforelectricityforTowncustomersshallbesuspendedforanycustomerwhosestructurewasdestroyedorisunsafeandwhoseelectricserviceisshowntobeunavailablefromtheTown,asdeterminedbytheUtilitiesDirectorordesignee.2.AnycustomerspecifiedinParagraph1mayrequestsuspensionofminimumchargesforutilityservicesbyprovidingawrittenrequestandafulldescriptionoftheirsituationtotheTown’sUtilityBillingDepartment.ThecustomershallberequiredtoprovidewrittennoticetotheTownoftherestorationofutilityservice.3.ThesuspensionoftheminimumchargesshallberetroactivetothefirstfullbillingperiodinNovember2020,andshallbeeffectiveuntilNovember1,2021,oruntiltheelectricserviceisinuse,asdeterminedbytheTown,whicheveroccursfirst.4.TheTownBoardconsiderstherulesandordersofthisResolutiontobejustandreasonable.
