RESOLUTION53-20APPROVINGELKHORNLODGEFINALSUBDIVISIONPLATWHEREAS,anapplicationfortheElkhornLodgeFinalSubdivisionPlatwasfiledbyEastAvenueDevelopment,LLC,aTexasLLC(applicant);andWHEREAS,theElkhornLodgeFinalSubdivisionPlatproposesthirteen(13)lotsonaparcelapproximately18.58acresinsize,locatedwithinaCO(OutlyingCommercial)ZoningDistrict,withaMixed-UsePlannedUnitDevelopmentoverlay(ElkhornLodgePUD)alsoproposedforthesubjectproperty;andWHEREAS,thelotscreatedbyElkhornLodgeSubdivisionFinalPlatareproposedtorangefrom0.276to3.291acresinsize;andWHEREAS,apublichearing,precededbyproperpublicnotice,washeldbytheBoardofTrusteesonAugust11,2020andatsaidhearingallthosewhodesiredtobeheardwereheardandtheirtestimonyrecorded;andWHEREAS,theBoardofTrusteeshasreviewedandtakenadministrativenoticeofthetestimony,application,evidence,documentssubmittedatthehearing,andthecontentsoftheCommunityDevelopmentDirector’sfile;andWHEREAS,theBoardofTrusteesfindstheapplicantshavecompliedwiththeapplicablerequirementsoftheEstesParkDevelopmentCode.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:TheElkhornLodgeFinalSubdivisionPlatisherebyapproved,withthefollowingfindingsandconditionsofapproval:Findings1.TheFinalPUDandFinalPlataregenerallyconsistentwiththegoalsandpoliciessetforthintheEstesValleyComprehensivePlan.2.TheFinalPUDandFinalPlataregenerallyconsistentwiththegoalsandpoliciessetforthintheEstesParkDowntownPlan.3.TheFinalPUDandFinalPlatcomplywithapplicablestandardssetforthintheEPDC.4.Adequatepublicfacilitiesarecurrentlyavailabletoservetheproposedproject.5.Thisrequesthasbeensubmittedtoallapplicablereviewingagencystaffforconsiderationandcomment.Nosignificantissuesorconcernswereraisedbyanyreviewagency.
