HomeMy WebLinkAboutRESOLUTION 50-20RESOLUTION50-20ARESOLUTIONAPPROVINGTHEAMENDEDPLATOFPORTIONSOFLOTS6,7,AND8,BLOCK1,OFTHESECONDAMENDEDPLATOFTHETOWNOFESTESPARKCOLORADOWHEREAS,anapplicationforanAmendedPlattorearrangeinternallotlineswasfiledbyThomasBeck,1WBeckArchitects(owner/applicant);andWHEREAS,theapplicantrequestsrearrangementofinternallotlinesforapropertydescribedasPortionsofLots6,7,and8,Block1,SecondAmendedPlatoftheTownofEstesPark;andWHEREAS,theAmendedPlatreconfiguresthesubjectlotsintoLot6A(0.074±acre)andLot7A(0.095acre),anddoesnotcreateadditionallotsorbuildingsites;andWHEREAS,apublicmeetingwasheldbeforetheEstesValleyPlanningCommissiononJune16,2020,attheconclusionofwhichthePlanningCommissionvotedtorecommendapprovaloftheAmendedPlatwiththefollowingfindingsandconditionofapproval:FindinQs1.ThisproposalcomplieswithapplicablesectionsoftheEPDC.2.Thisrequesthasbeensubmittedtoallapplicablereviewingagencystaffforconsiderationandcomment.Nosignificantissuesorconcernswereexpressedbyreviewingstaffrelativetocodecomplianceortheprovisionofpublicservices.3.NotingtheSecondAmendedPlatoftheTownofEstesPark,aswellasthesubjectproperty’sexistingusesandstructures,wereinplacelongbeforetheEstesValleyComprehensivePlanwasdraftedoradopted,stafffindstheexistinguse,aswellastheproposedfutureuseofthepropertyisnotinconsistentwiththerecommendationsoftheComprehensivePlan.4.Withinsixty(60)daysoftheBoard’sapprovaloftheFinalPlatapplication,thedevelopershallsubmittheplatforrecording.Iftheplatisnotsubmittedforrecordingwithinthissixty-daytimeperiod,theapprovalshallautomaticallylapseandbenullandvoid.5.ThisisaPlanningCommissionrecommendationtotheTownBoard.ConditionofApproval1.Labelingforthesubjectlotsshallberevisedtoclearlyreflecttheexisting,currentlotsofrecord.TheplatwiththisrevisedlabelingshallbesubmittedtotheCommunityDevelopmentDepartmenttobeincludedinthereportandrecommendationtotheTownBoardofTrustees.WHEREAS,apublichearing,precededbyproperpublicnotice,washeldbytheBoardofTrusteesonJuly28,2020andatsaidhearingallthosewhodesiredtobeheardwereheardandtheirtestimonyrecorded;and WHEREAS,theBoardofTrusteeshasreviewedandtakenadministrativenoticeoftherecommendationofthePlanningCommissionandthetestimony,application,evidence,documentssubmittedatthehearing,andthecontentsoftheCommunityDevelopmentDirector’sfile;andWHEREAS,theBoardofTrusteesfindstheapplicantshavecompliedwiththeapplicablerequirementsoftheEstesParkDevelopmentCode.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:TheParkSuitesAmendedPlat,beingPortionsofLots6,7,and8,Block1,SecondAmendedPlatoftheTownofEstesPark,isherebyapproved.DATEDthisZdayof-,2020.TOWNOFESTESPARKMayor/ATTEST:APPROVEDASTOFORM:TownAttorney
