RECORDOFPROCEEDINGSPublicSafetyCommittee—April23,2003—Page2thegrantofstatutoryauthoritytorequiretherevocationofadriverslicenseforanythingotherthanthoseoffensessetforthinSection9.20.010oftheMunicipalCode.AchangeinthestatestatuteswouldbenecessaryfortheTowntohavetheauthoritytopassanordinance.ChiefRichardsonrecommendedthatanydiscussionwithstatelegislatorsincludethefollowinglanguage:possessionorbeundertheinfluenceor—thislanguageisidenticaltounderagedrinkinglanguage.TownAdministratorWidmerstatedthatTrusteeBarkerservesontheCMLPolicyCommitteewhereissuestobepresentedtotheStateLegislaturearedetermined.Followingdiscussion,theCommitteerecommended“DriversLicenseSuspensionforPossessionandUseofaControlledSubstance”bepresentedduringaTownBoardmeetingtodeterminesupport.CrimeAnalysisReportonVandalism.CSODennisvanderAvoort,CrimeAnalysisExpert,conductedananalysisutilizingspot”mapstoascertaintheprobabilitythatcriminalswillstrikeagainwithintheareathatcoversE.ElkhornAve.andBigThompsonAve.,fromRiversidePlazaeasttoLonePineDrive.Pursuanttothedata,extrapatrolandregularchecksonE.Elkhorn-BigThompsonAve.arerecommendedbetween8:00p.m.-3:00a.m.,particularlyonMondayandTuesday,andSaturdayandSundayevenings.Extraattentionbetween10:00p.m.-12:00midnightinthe500-1000BlockofBigThompsonAve.isalsorecommended.Discussionfollowedconcerningprofilingandconfirmationthatthesecrimeshavegenerallyinvolveddestructionofproperty.ChiefRichardsonaddedthattheDepartmentisusingallavailableresourcestosolvethesecrimes,andthatthisstudywillproveinvaluable.TheCommitteecommendedCSOvanderAvoortforthepresentationandcompletenessofthestudy.PedestrianFlagPilotProject.TownAdministratorWidmerconfirmedthatstaffhasreplacedtheflagsforthethird,andmostlikely,thefinaltime.Alessexpensiveversionoftheflagmayberesearched.McDonald’sParkingLotIncident—Report.Sgt.RosebriefedtheCommitteeonthisrecentincidentthatoccurredintheMcDonald’sRestaurantParkingLot.Itwasreportedthatagunwasbeingwaivedaboutbyjuvenileoccupantsinavehicle.Allon-dutypersonnelresponded;officershandledtheincidentinaprofessionalmanner;andthevehicleandoccupantsweresecured.Mgr.Bartramconfirmedthatthetapesverifythatalthoughtheinformant’sEnglishwasbroken,themessagewasclearandDepartmentstaffverifiedhandmotionsthataccompaniedtheverbalreport.FourSheriffsOfficers,1StatePatrolOfficer,andlocalon-dutyEPPDofficersresponded.AsearchuncoveredaBEpistolandsuspecteddrugsanddrugparaphernalia;twopersonswerearrestedduetothesuspecteddrugs.However,astheEPPDwasplacedinabackuproleintheirjurisdiction,ChiefRichardsonwillbediscussingthisincidentandprocedurewiththeSheriffsDept.,andanyadditionalinformationwillbesharedwiththeCommittee.FIREDEPARTMENT.MutualAidAgreementwithPRPA—RequestApproval.ChiefDormanreportedthatPRPAisrequestingthecurrentAgreementberevisedtoincludeaprovisionauthorizingthefirechiefsoftherespectivepartiestheauthoritytoestablishwrittenprotocols,plansandprocedures.TownAttorneyWhitehasreviewedtheMOU.TheCommitteerecommendsapprovaloftherevisedMutualAidAgreementwithPRPAaspresented. RECORDOFPROCEEDINGSCommunityDevelopmentCommittee—July3,2003—Page2theeventandtheywerecommended.4.MiniatureHorseShowJune18-22,1gtyrevent.Showgrowth(exhibitorsandanimals)isnotexpectedtochangeoverthenextcoupleofyears:however,itisnon-taxingforstaff.5.NewShowOfficeBuilding.TheTopHandsOrganizationfundedthisbuildinganditwasinitiatedforthe12nightrodeosandworkedextremelywell.PursuanttoTrusteeHabecker’ssuggestion,aporchwasaddedtoimprovethearchitecture.AppreciationwasexpressedtoTopHandsfortheirmotivationinimprovingthefairgroundssite.Action.AssistantTownAdministratorRepolapresentedtheStanleyParkRevitalizationPlanReportdatedJune,2003.OneoftheTownBoard’s2002-2004GoalswasareviewoftheStanleyParkMasterPlan.TheGoalTeam,consistingofTrusteesHabeckerandNewsom,andstaffmembersBrandjord,Hinze,Joseph,Marsh,PickeringandRepola,conductedanevaluationofthevariousreportsandplanswrittenonthefairgroundsovertheyears,includingtheoperationsandmarket(bothcurrentandpotential).MinorrecommendationswererecommendedinthePlanbyAttorneyWhitetoensurecompliancewiththeStanleyParkDeed.Concerningbudget,staffwillmanagethemajorityofthemasterplanningprocess.l-wever,theneedtoretainprofessionalservice..suchasanengineertoassistwithdraftingaplantoaddressexistingsurfacedrainageissuesisanticipated.Thisportioncanlikelybedelayeduntilthe2004Budgetbaseduponprogressmadeintheplanningprocess.Staffnotedthat±$2.5Millionhasalreadybeeninvestedinthesite.Thereportaddressedthefollowing:>RevitalizationPlan>OperationDescriptionVision>ObjectivesServices/Product>MarketAnalysis>Strategy/Implementation>Summary>Attachments.ChairmanDoylennotedthattheTownhasbeenagoodstewardofthisproperty,andreinvestmentshouldbecontinued.TrusteeHabeckernotedhispleasureinworkingonthisGoalTeam,wheretheTeamfocusedontheStanleyParkDeed,desiredaPlanforthebenefitoftheentirecommunity,notedthatthissiteisagatewayproperty”,anditshouldbedevelopedinanattractivemanner,beliefthatthereturnforinvestmentshouldbetremendous—aunique,holisticapproachwasutilizedinpreparingthisPlan.Followingreview,theCommitteeacknowledgedreceiptoftheReport,andrecommendsapprovaloftheStanleyParkRevitalizationPlanaspresented,understandingthebudgetimplicationsthereof.0 StanleyParkRevitalizationPlanOperationDescriptionStanleyParkisamulti-usesitelocatedalongU.S.Highway36inEstesPark,CO.TheparkconsistsofseveralparcelsoflandownedandoperatedbyvariousgovernmentalentitiesincludingtheTownofEstesParkandtheEstesValleyRecreationandParksDistrict(EVRPD).TheEVRPDportionofthepropertyincludessixtenniscourts,twosoftballfields,onebaseballfield,twocoveredpicnicshelters,oneplayareaincludingvariouspiecesofequipment,afenceddogpark,andaconcretetrailthatconnectstheareatotheLakeEstesTrail.TheStanleyParkFairgroundsisaforty-twoacre(moreorless)eventfacilitylocatedonthewesternportionofthisarea(AttachmentA).Thepropertycontainsseveralbuildingsvalueatslightlymorethan$2.2million(accordingtoaninsuranceappraisal).Thefacilityservesresidentsandvisitorsalikeprovidingcultural,historical,recreationandentertainmenteventsandopportunities.AtthenorthwestcorneroftheFairgroundsaretheTown-operatedSeniorCitizens’CenterandEstesParkAreaHistoricalMuseum.VisionIn1936,F.O.Stanleydeededfifty-fouracrestotheTownofEstesParkforuseasapublicparkandrecreationarea.ThedeedpermitstheTowntomakeimprovements,provideentertainment,andrentthelandforsuchuses,asitdeemsappropriate.furthermore,accordingtothe1936deed(AttachmentB):“The...describedlandisherebyconveyedtothesaidTownofEstesParkforusebysaidTownsolelyasapublicparkandrecreationgrounds.TheTownshallhaveflailcontrolanduseofsaidpremisesforsuchpurposesandmayimproveandbeautifysaidlandstocarryoutsuchpurposes.TheTownmayconstructsuchimprovementsthereonassaidTownmaydeemnecessaryandproperforthecarryingoutofthepurposeshereinspecified.TheTownmaypermitsuchlandstobeusedforpublicentertainmentuponsuchtermsandconditionsandforsuchrentalasitmaydeemproper..4 TheconditionsunderwhichtheFairgroundsatStanleyParkweredeededtotheTown,areconsistDatwiththeTown’sstatedrnis3ion.Specifically:“ThemissionoftheTownofEstesParkistoplanandprovidereliable,high-valueservicesforourcitizens,visitorsandemployees.Wetakegreatprideensuringandenhancingthequalityoflifeinourcommunitybybeinggoodstewardsofpublicresourcesandournaturalsetting.”Historically,thepropertyhasbeenapopularsiteforvariousequestrianeventstoincludehorseshowsandtheannualRooftopRodeo.Thoughthesetypesofeventscontinueeventoday,theTownseesthefairgroundsashavingthepotentialtobecomethecenterofcommunityactivity.Theacreageofthefairgroundsissufficienttoprovidefacilitiesandspaceformultiple,simultaneousanddistinctivelydifferentuses.ConsistentwiththeconditionsoftheStanleydeed,theTowndesirestoimprovethefairgroundstoprovideforvariouspublicpurposesofarecreationalorentertainmentnature.Furthermore,giventhetourism-basedeconomyofEstesPark,suchimprovementsanduseswouldcomplimentthecommunity’sofferingsforvisitors.ObjectivesTheFairgroundsatStanleyParkiscurrentlyunderutilizedandinneedofrepair.Thisdocumentproposesaspecificframeworkfortransformingthefacilityfromalimitedseasonalusepropertytoadynamic,multi-usecampusforusebyresidentsandvisitorsyear-round.Theprimaryobjectivesaretoprovidesites/facilitiesthatenhancecommunityactivities,eventsandusesthatfitoneofthefollowingtwogeneralcategories:•Entertainment•RecreationFurthermore,consistentwiththecriteriasetforthinF.O.Stanley’sdeed,theFairgroundsmayhostcertaineventsthatgeneraterentalfeesandrelatedrevenue.Suchfee-basedusesshallprovideincometooffsettheoperatingexpensesoftheproperty.05 Services/Product:TheFairgroundsatStanleyParkCurrentTheFairgroundsatStanleyParkhostsavarietyofeventsduringthemonthsofJunethroughmid-September.During2002,fairgroundeventsgeneratedrevenueof$453,063whileexpenseswere$622,982(AttachmentC).Eventsandusesin2002included:•WoolMarket•Hunter/JumperHorseshow•JuneRodeoseries•RooftopRodeo•MiniatureHorseshow•LongsPeakScottishllrish•ArabianHorseshowfestival•AntiqueShowFromtheJuneWoolMarkettorodeosinJuneandJulyalongwithvarioushorseshowsthroughoutthesummer,theFairgroundsatStanleyParkprovidesentertainmentandculturalactivitiestobothresidentsandvisitors.Thegroundsareideallyuitedforeventsfeaturinganimalsofvarioussizes.Additionally,thegroundsarepartoftheLongsPeakScottish/IrishfestivalheldeachSeptember.ThisparticulareventspansthegroundsofboththeEVRPDandTownproperties.Therearemanyattributesofthispropertythatmakeitidealforthesevariouseventsanduses.StanleyParkoffersfacilitiesandgroundsconsistingofmultiplevenuesforvarioustypesofactivities.Overtheyears,StanleyParkhasbeenapopularlocationforequestrianactivities.Thepropertyincludesvariousbuildingsandarenasthatprovideanidealsettingforhorseshows,competitionsandrodeos.Currentfacilitiesallowforhousingapproximately500horsesinfixedstallsofvarioustypes.Inaddition,combinationsoffixedandportablestructuresareusedtoaccommodateofficialsandstaffofhorseshowsandfestivals:Finally,asix-foothighchainlinkfenceenclosesamajorityofthepropertyprovidingaperimeterforeventsoranenclosureforlargeanimalssuchasrodeostock.Inadditiontohorseshows,StanleyParkfacilitiesareidealforothertypesofanimalevents.Theabundanceofopenspacecanbearrangedtoaccommodatevariousanimalshows.Currentnon-horseeventsconsistprimarilyoftheannual“WoolMarket”whichincludesllamas,alpacas,sheepandvariousotherfiber-producinganimals.Thestalls,6 arena,barnsandsupportbuildingscanbe.madetofitvariousconfigurationsandsizesofshows.MissedOpportunitiesDuring2002andearly2003,theFairgroundshashadtoturndownthirteeneventswithpotentialattendanceofupto11,000persons.Eventsnotheldforvariousreasonsincludingfacilitylimitationswere:•DogShow(winter/i50-250•WinterCarnival(winter/i000-attendees)1500)•Arts/CraftShow(winter/500-•BrierHorseShow(spring’150-750)300)•CarShow(summer/500-1000)•EPTradeFair(spring/500-75O)•RV&BoatShow(winter/500-•EPSnowSeries(winter/i000-1000)3000)•KarateCompetition(winter/i50-•4-HSmallAnimalShow250)(winer/50Q-600)•EPTrainShow(winter/500-750)•VolleyballTournament•Dollshow(winter/500-750)(winter/500-600)Withoneexception,eacheventwasseekinganindoorlocation.TheoneexceptiontothisrequirementwastheCarShowthatrequiredalargepavedlot.ProposedTheFairgroundsatStanleyParkiscapableofaccommodatingvariousotherusesbeyondcurrentofferings.Theopenspace,facilitiesandneighboringoperationsareidealformanyrecreationalandentertainmentuses.Inaddition,withimp:ovement,manyothereventsandusesarepossible.Possibleuses/eventsinclude:•Festivals•Tradeshows•Concerts•Picnicfacilities•Fieldsports•Passiveathleticuses(Frisbee,•Vehicleexpos/showskiteflying,etc.)7 TheexistingperimeterfenceprovidescontrolledaccesstotheFairgroundsmakingadmissioneventsidealforthislocation.Thismakesfestivals,concertsandotherpay-per-attendeeeventsfeasibleonvariousportionsorallofthegrounds.Theseeventscanalsotakeadvantageoftheon-siteconcessionstandoperatedbyaprivatevendorundercontractwiththeTown.Withimprovements,thegroundscanbemodifiedtoaccommodatevariousathleticandpassiverecreationaluses.Largegrassyareascanhostseasonalrecreationalactivitiessuchasyouthsocceraswellasvariouscampsorcompetitionsforotherfieldeventssuchaslacrosse,football,etc.PastproposalshaveincludedasoccerfieldinthenortheastcornerofthepropertytocomplimentcurrentfieldsontheEVRPDpropertytotheeast.Thevarietyofindoorvenuesandopenspacesarealsoidealfortradeshowsandculturalfestivals.FromrecreationalvehicleexpostoeventsliketheLongsPeakScottishHighlandFestival(acurrentuser),thepropertycanbesetuptoaccommodatethousandsofdailyvisitstomultipledisplayandperformancevenuesatStanleyParkFairgroundsandsurroundingvenues.Thesesamecharacteristicsmakethepropertyagoodlocationfc’ruseshighlightingotherattractioi1slikecarandantiqueshowsaswellastheexistingmuseum.MarketAnalysisTheStanleyParkFairgroundshaslongbeenapopularsiteforvariousequestrianshowsandactivities.Thismarketsegmenthasundergonenoticeablechangeoverthelastdecade,butcontinuestoprovideviablebusinessopportunitiesforthefacility.However,themarketforrecreationandentertainmentuseshasyettobedeveloped.ThemarketconditionsandcompetitionisdescribedfurtherbelowwithadditionaldiscussionoftheimpactofvisitorstotheFairgrounds.TofurtherestablishtheFairgroundsatStanleyParkinthismarket,theSpecialEventsManagerandBusinessDevelopmentDirectorshallannuallydevelopactionplanstoattractandretainbusiness.8 Anongoingeffortisunderwaytoidentifycurrentandpotentialcustomerneeds.Areascfcon3iderationincludetheneedforseasonalandyear-roundfacilities.Inaddition,improvementstoexistingopenspacesmustaddresstheneedforcoveredopen-airfacilities,pavedsurfacesandgrassyareastofacilitateathleticandpassiverecreationactivitiesinadditiontotraditionalequestrianuses.CurrentMarketConditionsKeymarketindicatorsandcommentsfrompotentialusersshowthatthecompetitionfromthenewfacilitiesatLarimerCounty,Greeley,JeffersonCounty,andDouglasCountyhashadlittleeffectontheviabilityoftheStanleyParkFairgrounds’bookings.CustomersidentifyEstesParkasamajorvariableinmakingtheirfinaldecision.Thoughtheothernewfairgroundshavenicer,moremodem,facilities,thecustomerseesEstesParkasamuchmoredesirableandmarketabledestination.ThecustomerwouldliketoseeimprovementstotheStanleyParkfacility,butstillfeelthatthesettingisastrongsellingpoint.ShowmanagersarecallingEstesParkatafasterpacenow,thaninthepast.TheFairgroundsatStanleyParkturnedawaymorebusinessthisyearthatanyyearbefore(see“MissedOpportunities”above).0CompetitionTherearefourprimarycompetitorstotheFairgroundsatStanleyPark:LarimerCounty,Greeley,JeffersonCountyandDouglasCounty.Thesepropertieshost(orsoonwillinthecaseofthenewLarimerCountyfacility)eventsandcustomersthataresimilartothoseservedbyourfacility.However,thesefacilitiesarealsodifferentfromthefairgroundsatStanleyPark.Eachpropertyfacesauniquesetofstrengthsandweaknesses.ThemajorweaknessesofthenewLarimerCountycomplexcenterontheinabilitytoprovideamethodforthecustomertodealwithonepersoninmakingshoworeventarrangements.Atypicalshowmanagerhastodealwiththearenamanager,parkingmanager,foodconcessionaire,andfairgroundsmanager.Inaddition,costsareveryexpensive.Greeleyhasdonethenicestjob,buildinganewbarnthatfillstheneedsofmostoftheirusers,atanaffordableprice;thechallengeforGreeleyisthelocale.JeffersonCountyhascreatedafive-yearplanof09 improvementsthatarewinninggoodreviewsfrombothusersandthecommunity.However,JeffersonCountymustsubsidize80%ofthcostsofthisoperation.Alongthesamelines,DouglasCountyprovidesasubsidyofapproximately82%toitsfacilityinCastleRock.However,beingthefastestgrowingcountyinthenation,moneyisnotamajorissue.DouglasCountyprovidesthefacility,includingtheneweventarena,freeofchargetomostusers.ThesubsidiesforbothDouglasandJeffersonCountiesareintherangeof$800,000peryear.Bothfacilitiesproducerevenuesofaround$150,000.Spending&VisitationsIn2002,Fairgroundvisitors,exhibitorsandshowmanagersspentover$4.9millioninEstesPark.Fromthe11eventsthatwereheldattheFairgroundsatStanleyParkmorethan25,000peoplevisitedEstesPark,eitherattendingorparticipatinginanevent(seeAttachmentC:Fairground2002IncomeandExpense).Astheeconomycontinuestostruggleandreacttotheconditionsaroundtheworld,eventsaretheoneareawhereattendancewasconsistent.Itbecomesclearthatinorderforourtourism-basedeconomytogrowandflourishcontinuedinvestmentintheeventfacilitiesattheFairgroundsisamust.Strategy/tmplementationStanleyParkFairgroundsshallbecomeacenterforcommunityactivitieshighlightingrecreationandentertainmentuses.Toaccomplishthisvisionanddeterminetheappropriatefee-baseduses,varioustasksshallbeundertaken.Severalofthesestepscanbeaccomplishedsimultaneouslyandbystafffromvariousdepartments.Ultimately,abalanceshallbestruckbetweenthevariouscommunityusestoprovidethegreatestbenefitforthecommunityingeneral.Suchusesshallbedeterminedbaseduponappealtoallusers(asdeterminedbytheprocessesoutlinedundertheTacticssectionbelow).Thisplansetstheparametersforthetypesofusesthatarepossibleandwithintheexistingdeedrequirements.10 consideredbytheTRCwithoutpublicnoticebeinggivenpursuanttosection24-6-402(2)(c).22.Uponinformationandbelief’,everyTRCmeetingconsideringtheProjectwasconductedwithoutthetakingofanyminutesasrequiredbySection24-6-402(2)(d).23.Uponinformationandbelief,everyTRCmeetingconsideringtheProjectwasconductedbehindc]oseddoorsinviolationofSection24-6-402(2)(b).24.AsaresultofbeingdeniedtheopportunitytoattendtheTRCmeetingsandtovoiceobjectionstotheProjectpriortoitsapproval,Plaintiffhassufferedeconomicandnoneconomicinjury.WHEREFORE,PlaintiffrequestsasitsFirstC]aimforRe]iefthatthedecisionoftheTRCinthismatterberendered“nullandvoid”pursuanttosection24-6-402(8),andthatreasonablecostsandfeesbeawardedpursuantto24-6-402(9).SECONDCLAIMFORRELIEF(LackofJurisdictionandAbuseofDiscretionUnderRule106(a)(4))25.TheallegationsofparagraphsI-24aboveareherebyincorporatedbyreference.26.TheTRCexceededitsjurisdictionandabuseditsdiscretionbyallowingdevelopmentinthe“buffersetback,”andbyfailingtomitigatetheeffectsonPlaintiff’shome“tothefullestextentpossible,”asisrequiredundertheMasterPlan.27.UnderC.R.C.P.106(4),thedecisionofanybodyexercisingquasi-judicialfunctionsmaybereversedbytheDistrictCourtifthatbody“hasexceededitsjurisdictionorabuseditsdiscretion.”28.TheMasterPlanexpresslydirectsthattheTRCmustgivetheOverlookParcel“specialdevelopmentconsideration...toensurethatdevelopmentimpacttoalladjacenthomessites,particularlythosetothenorth,ismitigatedtothefullestextentpossible.”MasterPlanat33(emphasisadded).29.Inanefforttoensuresuchmitigationtakesplace,theMasterPlanndatesthattherebea“minimumbuffersetback”of50feeta]ongthenorthernedgeoftheOverlookParcel.MasterPlanat35.A“buffersetback”prohibitsallconstruction,includingbuildings,otherstructures,roadways,drivewaysandwalkingpaths.30.Uponinformationandbelief,ataminimum,theProjectasapprovedbytheTRCallowsforaroadway,drivewayandwalkingpathinthebuffersetbackinclearviolationoftheprovisionsoftheMasterPlan.31.TheTRClacksthejurisdictionandauthorityundertheMasterPlantoallowconstructioninthebuffersetback,andthereforeabuseditsdiscretioninapprovingtheProject.03D0166-4-
