HomeMy WebLinkAboutRESOLUTION 07-8700RCPTN#8703220106/04/8710:48:53#OFPAGES—2FEE—$6.00MRODEN3ERER,RECORDER-LARIMERCOUNTY,COSTATEDOCFEE$.00RESOLUflONNO.7-87WHEREAS,StanleyAdditiontotheTownofEstesPark,CountyofLarimer,StateofColoradoisasubdivisionwithintheTownofEstesPark,Colorado;andWHEREAS,saidadditionhasbeensubdividedintofivetracts;andWHEREAS,Chapter16.12oftheMunicipalCodeoftheTownofEstesParkregulatesthesubdivisionofrealpropertywithinthetheTownofEstesPark;andWHEREAS,ithascometotheattentionoftheTownofEstesParkthatportionsofTract4and5ofStanleyAdditiontotheTownofEstesParkhavebeendeededfromtherecordownerofthepropertytoanotherentitywithoutanyfilingwithorapprovaloftheTownpursuanttoChapter16.12oftheMunicipalCodeoftheTownofEstesPark,thesamerelatingtosubdivisionofrealpropertywithintheTown;andWHEREAS,theBoardofTrusteeshasreviewedthissituationandhasdeterminedthatthedeedingofthepropertyrepresentsaviolationofChapter16.12theMunicipalCodeoftheTownofEstesParkasitrelatestosubdivisionofrealpropertylocatedwithintheTown;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkherebydeclaresthedeedingoftherealpropertyanillegalsubdivisionofpropertylocatedwithintheTownofEstesPark.NOWTHEREFORE,beitresolvedbytheBoardofTrusteesoftheTownofEstesPark,Colorado,asfollows:1.OnIpril28,1986RobertT.SmithandKatherineS.SmithdeededtwoseparateportionsofTract4ofStanleyAdditiontotheTownofEstesParktoFiuityPerformance,Inc.,aColoradoCorporation.SaidWarrantyDeedwasrecordedintheofficeoftheClerkandRecorderofLarirnerCounty,ColoradoonMay12,1986,ReceptionNumber86024051.2.OnMay8,1986RobertT.SmithandKatberineS.SmithdeededaportionofTract5ofStanleyAdditiontotheTownofEstesParktoEquityPerformance,Inc.,aColoradoCorporation.SaidWarrantyDeedwasrecordedintheofficeoftheClerkandRecorderofLarimerCounty,ColoradoonMay12,1986,ReceptionNumber86024052.3.ThedeedingoftheaforementionedrealpropertywithoutcoirplyingwiththeapplicableprovisionsofChapter16.12oftheMunicipalCodeoftheTownofEstesParkisanillegalsubdivisionofsaidproperty.
