00ChapterI-POLICIESANDPROCEDURESA.GENERALSTATEM.1.PURPOSE.Thisdocumenthasbeendevelopedtoensurethatallwaterlines,pumpingstations,andotherappurtenancesprovideadequateandreliableserviceandareaccessibleandmaintainable.Thestandardsandspecificationspresentedhereinshallbeconsideredasminimumsinthatthedeveloper,engineer,orcontractornayincorporatemorestringentstandardsifhesochooses.CurrenteditionsofstandardssuchasASTM,AWWA,andANSIshallapplywherereferencedintheseDesignStandards.ItshallbeunderstoodthattheTownhasissuedthesestandardsviaitsstatutorypowertoregulatecertainactivitieswithinitsjurisdictionandisi2apartytoanycontractswhichmayexistbetweenthepersonsresponsibleforinstallationofthefacilities(developer,engineer,andcontractor).TheTownmay,atitsdiscretion,inspectthecontractor’sworkforthepurposeofqualitycontrolandmayperiodicallyadvisethedeveloperastoItsopinionwhethertheworkmeetstheseDesignStandards.TheTown’scostsfortheseinspections,includingovertimepayifrequired,willbeseparatelybilledtothedeveloperiftheyexceedthefeeschedulepresentedinSection3.3.Thedeveloper,throughhisengineerandcontractor,isresponsibleforadherencetothestandardsestablishedbytheTown.TheTownwillnotusuallyshutdownajobforpoorworkmanshiporuseofimpropermaterials.Ifthewaterdistributionfacilitiesdonotmeettherequirementsestablishedherein,theTownwilluseitsregulatorypowerstorefuseownershipandmaintenanceresponsibilityforthefacilities,denythedeveloperpermissiontopurchasetapsorconnectthemtothedistributionsystem,orrefusetoreleasethedeveloper’sbond.FurtherdetailsregardingtheseproceduresmaybefoundinSectionsBthroughD.2.RESPONSIBILITIES.a.PublicWorksDirector.ThePublicWorksDirectorisdesignatedbytheTowntoexerciseallauthorityonbehalfoftheBoardofTrusteesinaccordancewiththeseDesignStandards.ThePublicWorksDirectorshallhavetheauthoritytoassignaTownRepresentative(s)tocheckanyandallwater-relatedworkinareassubjecttothisdocument.ThisIncludesallmaterials,equipment,excavation,bedding,backfill,andstructures.ThePublicWorksDirectorshallhavethesoleauthoritytoissue,inwriting,anydeviationfromtheprovisionscontainedintheseDesignStandardsorchangestoanypreviouslyapprovedwaterlinedesigndrawings.(ESTESPARK,COLORADO)(WATERUTILITYPOLICIES)(ANDSTANDARDS)I-i 00Ub.TownRepresentative.Whenandasrequired,thePublicWorks[1DirectornayassignaTownRepresentative(s)todetermineifthematerialsfurnishedandworkperformedareincompliancewiththeseDesignStandards.TheTownRepresentativemaybeanemployeeoftheTownorarepresentativeoftheTown’sconsultingengineeringfirm.BasedonobservationsbytheTownRepresentative,thePublicWorksDirectornayadvisethedeveloperonmattersregardingdefectivematerialsand/orworkmanship.c.Developer.Thedeveloperisresponsibleforsecuringallapprovals,paymentoffees,adherencetotheseDesignStandards,andallotheraspectsrelatedtoinstallationofwaterdistributionfacilities.ThedevelopershallretainaprofessionalengineercurrentlyregisteredinColoradoandacontractorlicensedinLarimerCountytotheextentnecessarytomeettherequirementsspecifiedherein.ForallwaterdistributionfacilitiesthataredeededtotheTownforownershipandmaintenance,thedeveloper’swarrantyresponsibilityisasfollows:(1)Allworkmanshipandmaterialsshallbewarrantedbythedeveloper(viathecontractor)foraperiodofoneyear(365days)fromthedatethattheProvisionalAcceptanceLetterisissuedbytheTown.Anyrepairorreconstructionperformedduringthewarrantyperiodshallbewarrantedforaperiodofoneyear(365days)fromthedateofacceptancebytheTownofsuchrepairorreconstruction.U(2)NothinginthepreviousparagraphconcerningthewarrantyperiodshallestablishaperiodoflimitationwithrespecttoanyotherobligationwhichthedeveloperhasundertheseDesignStandards.IftheworkisdefectiveanddoesnotmeettherequirementsoftheDesignStandards,theTowncaninitiateproceedingsforthedevelopertorepairtheworkevenifthewarrantyperiodhasexpired.Insummary,thereisnotimeperiodregardingdefectivework.Theestablishmentoftimeperiodsrelatesonlytothespecificobligationsofdevelopertocorrectthework,andhasnorelationshiptothetimewithinwhichhisobligationsundertheseDesignStandardsnaybesoughttobeenforced.URepairworkshallcommencenolaterthan48hoursafterthedeveloperisnotifiedbytheTown.Ifthedeveloperorcontractordoesnotrespondinatimelymanner,theTownmaydotheworkorcontractwithotherstodotheworkandbillthedeveloperforactualcosts.U(ESTESPARK,COLORADO)(WATERUTILITYPOLICIES)(ANDSTANDARDS)1-2U Q.0d.Engineer.TheengineerisaprofessionalengineerwhoiscurrentlylicensedintheStateofColorado.HeisresponsibleforpreparationofdetaileddrawingsandspecificationsinaccordancewiththeseDesignStandards.Theengineer’scontractissolelywiththedeveloper,andtheTownisnotapartytoit.e.Contractor.WaterdistributionfacilitiesshallonlybeinstalledbycontractorslicensedtodobusinessinLarimerCounty,Colorado.Allconstructionworkshallbeinaccordancewithapprovedcontractdocumentsasdefinedherein,signedbythePublicWorksDirector.Noworkmaycommenceuntilthecontractdocumentshavebeenapproved.Thecontractdocumentsarealegalinstrumentbyandbetweenthedeveloperandcontractor.TheTownisnotapartytothisagreement.ThecontractorshallfurnishallreasonablefacilitiesandaccesstotheTownRepresentativeforthepurposeofobservingthematerialsandworkmanshipusedinconstruction.ThecontractorshallprovidetheTovnwithatleast24hours’noticeinorderthataTownRepresentativecanbemadeavailableifthePublicWorksDirectordeterminesthatoneisneeded.3.EFFECTIVEDATE.TheseDesignStandardsareeffectivebyResolutionNo.15-89,adoptedbytheBoardofTrusteesonJuly1,1989.TheseDesignStandardssupersedeallpreviouseditions.4.REVISIONS.TheseDesignStandardsmayberevised,amended,oraddedtofromtimetotime,andsuchrevisions,amendments,andadditionsshallbebindingandoffullforceandineffectwhenadoptedbyresolutionbytheTownBoard.5.LEGALREQUIREMENTS.TheseDesignStandardsshallapplytotheinstallationofallwaterdistributionfacilitiesservedbytheTown.NoconstructionactivitiesshallcommenceuntilthePublicWorksDirectorhasapprovedthecontractdocuments.NotwithstandinganyvariancefromtheseDesignStandardsthatoccurredorwasauthorizedinthepastorthatmaybeauthorizedinthefuture,theTownwillnotberestrictedorlimitedintheexerciseofitslawfulpowers.Noaction,directorindirect,ofanypersonwhoisinviolationoftheseDesignStandardsshallcontinueafterdiscoveryofsuchviolation.Theactualcostofthemeasuresneededtocorrectdefectivework,regardlessofwhensuchdeficiencyIsdetected,shallbetheresponsibilityofthedeveloper.6.INTERPRETATIONOFTHEDESIGNSTANDARDS.Whennecessary,interpretationofanysectionofthisdocumentshallbemadeinwritingbythePublicWorksDirector,andhisinterpretationshallbebindinguponallpersonsaffectedbythedecision.(ESTESPARK,COLORADO)(WATERUTILITYPOLICIES)(ANDSTANDARDS)1—3 00B.FEES.U1.PLANTINVESTMENTFEE.ThePlantInvestmentFee(PIF)reflectstheTown’scosttodeliverwaterupondemandandisnotameasureoftotalannualwaterconsumption.ThePIFisbasedonatapsizeandafeeassociatedwitheachtapsize.ThecurrentPIFratesnaybeobtainedbycontactingthePublicWorksDepartment.Exceptforseparatewaterdistricts,theTown’sPIFshallbepaidbeforeanyserviceconnectionscanbemadetothedistributionsystem.ThetapsizefordeterminationofPIF’sisestimatedusingequivalentfixtureunits.Theseequivalentfixtureunitsarebasedonthenumberandtypeoffixturesinthebuilding.Theequivalentfixturevalueunits(FVU),tappingfees,andmonthlywaterratesarelistedinChapter13.32,Title13oftheTown’sMunicipalCode.0Oncethenumberofequivalentfixtureunitshasbeencomputed,thetapsizefordeterminingthePIFshallbecalculatedasfollowsat60psi:NumberofEquivalentFixtureUnitsPIFTapSize(in.)Ii90—160160—3601—1/2360—6402Over640DeterminedbyTownbasedondesignusingpotablewaterpipingdesignmethodfromAWAM22Manual.NOTE:11BasedontheTown’sinterpretationofAWAM22andtheirexperience,thesefixtureunitcountsarethemaximumallowable.ItistheOwner’sresponsibilitytoensurethatthesesizesarehydraulicallycompatiblewithhisdevelopment.11Theminimumtapsizeshallbe3/4inchesandsingle—familyresidences,multi—familyresidences,commercial,andothercustomersshallusetheabovedescribedfixturevalueunitprocedureforestimatingtapsizefordeterminationofPIFs.Actualinstalledtap,serviceline,andmetersizemaybelargerthanthePIFtapsizerequiredifalargertapispaidforci(ESTESPARK,COLORADO)(WATERUTILITYPOLICIES)(ANDSTANDARDS)1-8 00orifrequiredforfirefloworotherfactors.AnyincreaseinthePIFtapsizemustbeapprovedbythePublicWorksDirectororAssistantPublicWorksDirector.Innocaseshallasmallertap,serviceline,andmetersizebeallowedthanthePIFtapsize.2.MONTHLYSERVICECHARGES.ThecurrentmonthlyservicechargesforconnectedandstandbytapsmaybeobtainedbycontactingthePublicWorksDepartment.3.OTHERFEES.BeforethePublicWorksDirectorwillapprovethecontractdocuments,planreviewandinspectionfeesmustbepaidinaccordancewiththefollowingschedule:TypeofPlanReviewWaterLineFeeInspectionFee**BuildingServiceLine$25.00$25.00/serviceconnectionMainExtension*$30.00/OOlinearfeetoflineifrequiredbyPublicWorksDirector*Becausethelevelofeffortwillvaryfromjobtojob,actualcostswillbeseparatelybilledtothedeveloper.**Minimuminspectionandtestingfeeisbasedononeserviceconnectionor100linearfeetofline.C.LINEEXTENSIONPOLICY.1.PURPOSE.ThepurposeofthissectionistoensurethatwaterdistributionfacilitiesinstalledintheTownofEstesParkareadequatelysizedandinstalledinamannersuchthatthefacilitiesareaccessibleandmaintainable.ItshouldbenotedthatprivateservicelineswillnotbeacceptedforownershipandmaintenanceresponsibilitiesbytheTown.2.APPLICABLEPROVISIONS.Thislineextensionpolicyappliestoalllandsubdivisions,PUDs,oranyotherdevelopmentrequiringapublicwaterlineand/orotherpublicwaterdistributionfacilitiestobeextendedtoservethedevelopment,Includingcondominiunization.Lineextensionswillbepublic.Nolineextensionwillbeprivate.Alltheprovisionsofthispolicyarenotrequiredforprivateservicelines.PersonsdesiringtoinstallserviceconnectionsarereferredtoChapterII,SectionB,andChapterIII,SectionFforfurtherinformation.(ESTESPARK,COLORADO)(WATERUTILITYPOLICIES)(ANDSTANDARDS)1-9 00UThedeveloperisresponsibleforallcostsoftheminimumrequiredpipeUsize(either6—inchor8—inchasperSectionC.3.d.(4),unlessthedevelopmentunderconsiderationrequiresthatlargerlinesbeconstructed.TheTownwillnotinitiallypayanyoversizingcosts;thedeveloperisresponsibleforallinitialcosts.AttheTown’sdiscretion,ifalargerthanminimumpublicwatermainisrequired,theTownmayreimbursethedeveloperthatamountinexcessofthecostoftheminimum—sizedpipe(6—or8—inch)andtherequiredvalves,PRVs,andotherminimum-sizedappurtenances.TheTownwillnotpayfortheminimumpipesizecostofanylineextendedthroughvacantland.Atitsdiscretion,theTownmaychoosetopayoversizingcostsforlinesextendedacrossinterveningvacantland.Theminimumpipesizecostofanylineextendedacrossinterveningvacantlandwillbedeterminedbythe“WaterlineExtensionAcrossVacantLandPolicy,”seeSectionBofthischapter.ReimbursementiscontingentontheTown’savailablefunds.TheContractorshallbearthecostofincreasinglinesizeswhenfundsarenotavailable.Thecostofotherfacilitiessuchaspumpingstationsandstoragetanks,thatareoversizedtoserveareasoutsidethedevelopmentinquestion,willbereviewedonacase-by—casebasis.2.REIMBURSEMENTPROCEDURE.Thirty(30)daysafterthePublicWorksDirectorhasissuedtheWaterlineExtensionandOversizingAgreement,theTownwillreimbursethedeveloperusingthefollowingprocedure:a.Basedontheactuallengthofpipeandnumberofvalvesinstalled(certifiedbyaprofessionalengineerregisteredintheStateofColorado),thedeveloperwillbereimbursedthedifferenceintheoversizingmaterialcost.TheTownwillusecurrentinvoicestodetermineoversizingmaterialcost.b.CalculationofreimbursementamountsforpublicwaterdistributionfacilitieswillbeperformedbythePublicWorksDirectoronacase—by—casebasis.Ii3.WATERLINEEXTENSIONANDOVERSIZINGAGREEMENT.TheWaterlineExtensionandOversizingAgreementisgenerallyapplicableforadevelopmentwithintheTownonlandthatiscontiguoustodevelopedlandwithintheTown.Allcostforoversizinglaterallinesfromthemainorwithinadevelopmentshallbebornebythedeveloper.ThereshallbenoreimbursementfromtheTown.TheWaterlineExtensionandOversizingAgreementistheofficialdocumentbywhichtheTownanddeveloperagreeontheconditionswherebythewaterdistributionfacilitiesshallbecomeapartofthedistributionsystem.ThisdocumentisinitiatedindraftformaftertheEngineeringFeasibilityReporthasbeenapprovedbythePublicWorksDirector.ItwillbesignedandissuedinfinalformbythePublicWorksDirectorafteralltherequirementsofSectionsCandDcontainedhereinaremet.ThestandardWaterlineExtensionandOversizingAgreementU(ESTESPARK,COLORADO)(WATERUTILITYPOLICIES)(ANDSTANDARDS)1-16U 3.TransferofFacilities.AftertheTownhasexecutedthisAgreement,ownershipandmaintenanceresponsibilityforthefacilitieswilltransferfromtheDevelopertotheTown.Beforesuchtransferwilloccur,theDevelopershalldelivertotheTownagoodandsufficientbillofsaleforthewaterdistributionfacilities.Theconveyancemuststatethatthefacilitiessoconveyedarefreeandclearofanyclaimsorlienswhatever.TheDevelopershallalsodeliveranyrequiredeasementsandsaideasementsmustbeproperlyrecordedwiththeLarimerCountyRecorderpriortosubmissiontothePublicWorksDirector.4.OperationandMaintenanceofFacilities.Afterthewaterdistributionfacilitieshavebeentransferredandsubjecttotheprovisionsofthewarranty,theTownwillhavefullresponsibilityforoperationandmaintenanceofthefacilitiesandtheactualcostsincurredinconnectiontherewith.TheTownagreestoallowconnectiontothefacilitiesinaccordancewiththeRulesandRegulationsofTownofEstesPark.5.Indemnification.TheDeveloperherebyagreestoholdharmlesstheTown,itssuccessorsandassigns,againstanyandallliability,loss,ordamagetheTownnaysufferasaresultofclaimsorjudgmentsagainstitunderthemechanics’lienlawsoftheStateofColorado,oronaccountofdefectivematerialsandworkmanshipusedtoinstallthefacilities.Saidindemnificationshallinclude,butnotbelimitedto,courtcosts,damages,repaircosts,andreasonableattorney’sfees.6.EnforcementAgreement.TheDeveloperandTownacknowledgeandagreethatthisAgreementmaybeenforcedinlaworinequitybyadecreeofspecificperformance,damages,orsuchotherlegalandequitablereliefasmaybeavailabletoeitherparty.7.SurvivalfObligations.TheprovisionsofthisAgreementshallbedeemedtosurvivethetransferofthewaterdistributionfacilitiesandshallbebindinguponthesuccessors,transferees,andassignsoftheparties.8.Assignments.TheDevelopershallnotassignitsrightsordelegateitsdutiesunderthisAgreementwithoutpriorwrittenconsentbytheTown.9.ReimbursementExtensionOverVacantLand.TheTownwillnotreimbursetheDeveloperforextendingthelineoverthevacantland.Ifduringa10-yearperiodanotherpartytapsintothewatermaincrossingthevacantland,theTownwillcollectanddetermineappropriatepaymentfromthatpartyandreimbursetheDeveloper.Tenyearsafterthedateofthisagreementnopaymentsforreimbursementwillbecollected.(ESTESPARK,COLORADO)(WATERUTILITYPOLICIES)(ANDSTANDARDS)3-2 Qb.Construction.SeedingshallbecompletedbetweenApril1throughNovember15,andnoseedingshallbedoneduringperiodsofhighwinds,excessivemoisture,snowcover,frozenground,andwhengroundcannotbeworkedasdeterminedbytheTownRepresentative.Seedingperformedduringthesummermonthsshallbewateredsufficientlysoastoestablishasubstantialstandofgrass.Seedshallbeappliedattherateof50poundsofliveseedperacre.Seedshallbeappliedwithadrillorcultipackertypeseedersuchthatitisspreadovertheareaandburledanaveragedepthof1/4to1/2Inch.Strawornativehaymulchshallbeappliedafterseedingatarateof2tonsperacreandshallbecrimpedinmechanically.23.SETTLEMENT.TheContractorshallberesponsibleforallsettlementofbackfill,fills,andembankmentswhichmayoccurwithinoneyearfromprovisionalbytheTown.TheContractorshallmake,orcausetobemade,allrepairsorreplacementsmadenecessarybysettlementwithin30daysafternoticefromthePublicWorksDirector.24.0FF-ROADCONSTRUCTION.Becauseofscenicimpacts,alloff-roadconstructionshallbedonewithextremecaretominimizeerosionanddamagetoexistingvegetation.Restorationofvegetationshallbedoneafterbackfillingandcompactionarecompleteandsurfaceisbroughttofinalgradeandshallconformtotheplantingpriortobeingdisturbed.25.MAINTENANCEOFTRAFFIC.Contractorshallconducthisworktointerfereaslittleaspossiblewithpublictravel,whethervehicularorpedestrian.WheneveritIsnecessarytocross,obstruct,orcloseroads,driveways,andwalks,whetherpublicorprivate,Contractorshallprovideandmaintainsuitableandsafebridges,detours,orothertemporaryexpedientsfortheaccommodationofpublicandprivatetravel,andshallgivereasonablenoticetoownersofprivatedrivesbeforeinterferingwiththen.SuchmaintenanceoftrafficwillnotberequiredwhenContractorhasobtainedpermissionfromtheownerandtenantofprivateproperty,orfromtheauthorityhavingjurisdictionoverpublicpropertyinvolved,toobstructtrafficatthedesignatedpoint.InmakingopencutStreetcrossings,Contractorshallnotblockmorethanone—halfofthestreetatatime.Wheneverpossible,Contractorshallwidentheshoulderontheoppositesidetofacilitatetrafficflow.(ESTESPARK,COLORADO)(WATERUTILITYPOLICIES)(ANDSTANDARDS)111-13
