Home My WebLink AboutRESOLUTION 03-89CRESOLUTION3-89WHEREAS,Section17.66.320(D)(2)oftheEstesParkSignCodeprovidesthatanysignwhichisnonconformingshallbebroughtintoconformanceorremovedwithinsix(6)yearsandsix(6)monthsfromthedateuponwhichthesignbecomesnonconforming;andWHEREAS,theColoradoCourtofAppealsinthecaseofRootOutdoorAdvertising,Inc.v.CityofFortCollins,759P.2d59,(Cob.App.1988)hasfoundthatthefive(5)yearamortizationperiodoftheCityofFortCollinsSignCodefornonconformingsignsisnot“justcompensation”underthetermsoftheFederalHighwayBeautificationActof1965andthe“OutdoorAdvertisingAct”oftheStateofColorado;andWHEREAS,thefindingbytheColoradoCourtofAppealsinsaidcaseisrelevantwithregardtoenforcementbytheTownofEstesParkoftheaforementionedsectionoftheEstesParkSignCodeasitrelatestononconformingsigns;andWHEREAS,onJanuary3,1989,theSupremeCourtoftheStateofColoradoagreedtoreviewthedecisionoftheColoradoCourtofAppeals,specificallythatpartofthedecisioninvolvingtheaforementionedamortizationperiodasitrelatestojustcompensationundertheaforementionedFederalandStateActs;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatitisinthebestinterestsoftheTownofEstesParkandthoseowningnonconformingsignswhichareormaybeduringthependencyoftheaforementionedcasebeaffectedbytheamortizationperiodoftheEstesParkSignCode;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkfeelsthatamoratoriumshouldbedeclaredwithregardtoallnonconformingsignsunderthespecificprovisionoftheEstesParkSignCodereferencedabove.NOWTHEREFORE,theBoardofTrusteesoftheTownofEstesParkfindsandresolvesasfollows:1.AllsignswhichnoworinthefuturebecomesubjecttoprovisionsofSection17.66.320(D)(2)shallnotberequiredtoberemovedpursuanttotheprovisionsoftheEstesParkSignCodeuntilsuchtimeastheColoradoSupremeCourthasissuedadecisionwithregardtotheabilityofamunicipalitytoamortizenonconformingsignsoveraspecificperiodwithouthavingtopayotherformsofjustcompensationfortheremovalofsaidsigns. 0&2.AnyotherprovisionoftheEstesParkSignCodewithregardtononconformingsignsisstillandwillremaininfullforceandeffectandshallbeenforcedbytheappropriateofficialsoftheTownofEstesPark.3.ThismoratoriumshallonlybeinaffectduringtheperiodnecessarytoallowtheColoradoSupremeCourttoissueadecisionregardingamortizationofnonconformingsignsoruntilfurtherresolutionorordinanceoftheBoardofTrusteesoftheTownofEstesPark.TOWNOFESTESPARKBy:_______MayorATTEST:44JTownClerk
