AN ORDINANCE AMENDING CHAPTER 13.08.060 OF
THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,
COLORADO, RELATING TO NEW BUDGET BILLING
PLAN REGULATIONS BY THE LIGHT AND POWER
DEPARTMENT OF THE TOWN OF ESTES PARK,
COLORADO.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
TOWN OF ESTES PARK, COLORADO:
Section 1. Chapter 13.08.060, Section C, be amended
to read as follows:
C. Billing Period: Except as herein provided,
meter reading will be accomplished as nearly as practicable
on a thirty day or monthly basis and bills for service will
normally be rendered twenty days after meters are read. Bills
for payment become delinquent within ten days thereafter and the
service subject to shut-off as provided under "Discountinuance
by town" in Section 13.08.040 B. If the department is unable
for any reason to gain access to read any meter, the consumption
shall be estimated based upon past usage.
Having in mind the seasonal nature of use by some
users, principally residential, the town reserves the right to
render monthly bills during periods of the year on a minimum
basis only and all billing for energy consumed during such
period may be accumulated. The town may at any time prorate
the accumulated consumption equally to the months covered by
such period and bill for such consumption if in excess of the
monthly minimum of the schedule.
Customers served under residential service rates
(with the exception of seasonal customers) who have 12 or
more consecutive months of billing history on the Town's
electric system and who have no notice of discontinuance
presently pending may elect, at their option, to apply for
a Budget Billing Plan beginning with any billing month. Any
customer electing the Budget Billing Plan will pay a monthly
amount equal to 1/10th of the total of his most recent twelve
months' bills. The levelized monthly payment shall be made
for eleven successive months with the twelfth month's payment
being a settlement amount equal to the difference between the
total of the prior eleven months' payments and the actual billings
for the twelve month period. If the settlement amount is a
credit balance the Town will issue a check to the customer in
the amount of the credit balance, or the customer may elect
to have the credit applied to future billings. If the
settlement amount is a debit balance owed by the customer the
total balance will be due and payable on the due date shown
on the bill for the settlement month.
Eligible customers may elect the Budget Billing Plan
at any time during a calendar year. After each twelve month
budget billing period, customers may elect to revert back to
normal billing or to continue the Budget Billing Plan for
another 12 months.
If a customer electing the Budget Billing Plan
fails to pay the budget billing obligation in any month, normal
collection procedures shall be applicable for the outstanding
budget billing amount, provided, however, that the customer
need only pay the outstanding budget billing amount to become
current and avoid termination. Upon termination of service of
a customer on the Budget Billing Plan, the customer is
subject to removal from the plan and the entire outstanding
amount of the account for actual usage shall be due and
payable.
The monthly budget billing amount will be adjusted
for changes in the Town's base rates, but will not be adjusted
for retail surcharge amounts authorized under Rate Tariff
Sheet No. 20.
Section 2. Except as herein specifically amended,
Title 13 and all ordinances or parts of ordinances of the
Municipal Code of the Town of Estes Park relative to the
Light and Power Department shall be and hereby are designated
to remain in full force and effect and are hereby ratified,
confirmed and approved.
