AN ORDINANCE AMENDING CHAPTER 14 OF THE
MUNICIPAL CODE OF THE TOWN OF ESTES PARK,
COLORADO, THE SAME PERTAINING TO BUILDINGS
AND CONSTRUCTION
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF
ESTES PARK, COLORADO:
Section 1. That Section 14.08.020 of the Municipal Code
of the Town of Estes Park, Colorado, is amended to read as
follows:
14.08.020 Use of mobile home. It is unlawful for any
person to use a mobile home, as the same is defined in Section
17.28.060 of this code, outside the R-3 mobile home district,
for any purpose whatever, except as follows:
A. The use of a mobile home as a temporary construction
facility during the construction of a building on the premises
upon which the mobile home is located. Any such use of a mobile
home shall not begin before the issuance of a building permit
for the building being constructed, and shall be discontinued
upon the expiration or revocation of such building permit, or
ten (10) days after the issuance of a certificate of occupancy
for the building, whichever sooner occurs. No business or commer-
cial activity which is not directly related to the construction
of the building shall be carried on in such mobile home.
B. The use of a mobile home for temporary use by any non-
commercial entity for a noncommercial purpose. Said entity shall
submit a request outlining the nature of the use of the mobile
home, the location of the use, and the duration of the use, to
the Board of Trustees. No such mobile home shall be placed or
used until approval of the request by the Board of Trustees. In
approving the request, the Board of Trustees may make such
recommendations, requirements, and conditions as are necessary
to protect the health, safety and welfare of the town.
Section 2. The Board of Trustees of the Town of Estes Park,
Colorado, herewith finds, determines and designates that this
Ordinance is necessary for their immediate preservation of
the public peace, health and safety, in order to provide for
uniform building and construction; and whereas, in the opinion
of the Board of Trustees, an emergency exists, this Ordinance
shall take effect and be in force immediately after its passage,
adoption and signature of the Mayor.
