ORDINANCE NO.—82
AN ORDINANCE VACATING A PORTION OF A
PUBLIC ROADWAY LOCATED IN THE TOWN OF
ESTES PARK,LARIMER COUNTY,COLORADO
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
TOWN OF ESTES PARK,COLORADO:
Section 1.That that certain roadway,more particularly
described as follows,to—wit:
An easement for a public road 14 feet in width
and adjoining the North line of a 16 foot easement
conveyed by a quit claim deed dated January 26,1954,
recorded February 16,1954,in Book 966 at Page 494
of the records in the office of the Clerk and Recorder
of Larimer County,Colorado.Said easement being 8
feet in width on each side of the following described
centerline:Commencing at the NE corner of the
sWl/4 of the NW1/4 of the NW1/4 of Section 31,Town
ship 5 North,Range 72 West of the 6th P.M.;thence
S 45°5l’E a distance of 67.05 feet to the point of
beginning;thence N 85°13’E a distance of 235.55
feet;thence N 85°lY’E a distance of 293.97 feet;
thence N 89°l2’E a distance of 60.0 feet to the NorthSouthcenterlineoftheNW1/4 of said Section 31.
The starting bearing for the above description was
taken from the North and South center line of the
NW1/4 of Section 31 as N 00°16’W according to the
Village Acres Subdivision plat and all bearings are
relative thereto;State of Colorado,County of Larimer;
is hereby vacated subject to the reservations set forth in
Sections 2 and 3 below.
Section 2.That an access easement for use of the
Town of Estes Park for access to the Town’s water treatment
plant on Prospect Mountain,such access easement more
particularly described as follows,to—wit:
An easement 14 feet in width and
adjoining the North line of a 16 foot easement con
veyed by a quit claim deed dated January 26,1954,
recorded February 16,1954,in Book 966 at Page 494oftherecordsintheofficeoftheClerkandRecorder
of Larimer County,Colorado.Said easement being Sfeetinwidthoneachsideofthefollowingdescribed

of the NW1/4 of the NW1/4 of Section 31,Township 5North,Range 72 West of the 6th P.M.;thence S 45°5l’

the North and South center line of the NW1/4 of
Section 31 as N 000161 W according to the Village
Acres Subdivision plat and all bearings are
relative thereto;State of Colorado,County of Larimer;
be,and the same hereby is,reserved unto the Town of Estes
Park.
Section 3.That any existing utility easements on
the property above—described in Section 1 to be vacated shall
be,and the same hereby are,reserved unto the Town of Estes
Park.
Section 4.The Board of Trustees of the Town of
Estes Park,Colorado,herewith finds,determines and declares
that owners of land abutting on said public roadway have
duly requested the Board of Trustees to vacate the same.
Section 5.The Board of Trustees of the Town of
Estes Park,Colorado,herewith finds,determines and designates
that this ordinance is necessary for the immediate preserva
tion of the public peace,health and safety,for the vaca
tion of streets affects the public peace,health and safety;
and whereas,in the opinion of the Board of Trustees,an
emergency exists,this ordinance shall take effect upon its
final passage,adoption and the approval and signature of
the Mayor.
PASSED BY THE BOARD OF TRUSTEES AND SIGNED this 9th
day of February ,1982.
