HomeMy WebLinkAboutORDINANCE 12-860 ORDINANCE NO.12-86 AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN TERRITORY TO THE TOWN OF ESTES PARK, COLORADO,TO BE KNOWN AND DESIGNATED AS SPRUCE LAKE ADDITION BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.That a Petition for Annexation,together with four (4)copies of the plat of said area as required by law,was filed with the Board of Trustees on the 3rd day of March,1986, by 100%of the landowners of the area proposed to be annexed, exclusive of streets and alleys. Section 2.The board,by resolution at a regular meeting on the 25th day of March,1986,accepted said Petition and found and determined that the provisions of Section 31—12—107 (1)(g), C.R.S.1973,were met. Section 3.That the Board of Trustees has determined that no additional terms and conditions are to be imposed on this annexation. Section 4.That the annexation of the following described area designated as SPRUCE LAKE ADDITION to the Town of Estes Park,Colorado,is hereby approved: A tract of land located in the W of the NEI and in the NEã of the NWA of Section 35,T5N,R73W of the 6th P.M.,Larimer County,Colorado,being more particularly described as follows: Considering the North line of the NE of said Section 35 as bearing N89°59’lO”W and with all bearings contained within this description relative thereto. Commencing at the Nk corner of said Section 35,as monumented by a General Land Office Brass Capped Pipe;thence along the East line of the NEA of the NWI of said Section 35,S01°04’02”W a distance of 1326.99 feet to the SE corner of the NE of the NWI of said Section 35,as monumented by a Pin and Cap No.6499, thence along the South line of the NWj of the NE of said Section 35,N89°19’43”E a distance of 48.31 feet to a point on the Easterly right—of—way line of Larimer County Road No.67 (Mary’s Lake Road),said point being the TRUE POINT OF BEGINNING: thence departing from said South line and along said Easterly right—of—way line,509°33’lO”E a distance of 141.14 feet; thence departing from said Easterly right-of-way line, S89°03’24”E a distance of 254.49 feet; 0 thence N02°55’15”E a distance of 41.28 feet; thence N21°04’05”E a distance of 79.25 feet; thence N05°11’53”W a distance of 31.91 feet to a point on the South line of the NWi of the NE of said Section 35; thence along said South line N89°29’43”E a distance of 315.01 feet; thence departing from said South line and along the East line of the W of the NWI of the Nfl of said Section 35, N01°07’40”E a distance of 734.43 feet to the centerline of the Big Thompson River; thence Westerly along the centerline of the Big Thompson River the following six courses and distances which are resultant chords between points on the centerline of said river: thence 589°42’49”W a distance of 49.23 feet; thence N75°08’32”W a distance of 229.91 feet; thence N67°21’17”W a distance of 258.95 feet; thence S35°02’23”W a distance of 285.90 feet; thence S07°13’59”W a distance of 216.87 feet; thence S83°21’35”W a distance of 229.14 feet to a point on the Easterly right—of—way line of Larimer County Road 67 (Mary’s Lake Road); thence departing from said centerline and along said Easterly right-of—way line the following four courses and distances: thence 193.64 feet along the arc of a curve concave to the Northeast,said curve has a delta angle of 18°33’14”,a radius of 597.99 feet and is subtended by a chord which bears S33°39’33”E a distance of 192.80 feet.(The PC of said curve has a radial bearing of 565°37’04”W); thence S42°56’lO”E a distance of 223.15 feet; thence S21°38’lO”E a distance of 88.12 feet; thence S0933’10”E a distance of 18.75 feet to THE TRUE POINT OF BEGINNING. The above described parcel contains 14.26 Acres more or less,and is subject to all easements,agreements and rights—of—way of record. Section 5.The Board of Trustees of the Town of Estes Park, Colorado,herewith finds,determines and designates that this ordinance is necessary for their preservation of the public peace,health and safety,in order to provide for immediate availability of municipal services to the annexed area;and whereas,in the opinion of the Board of Trustees,an emergency —2— *0 0 exists,this ordinance shall take effect and be in force immediately after its passage,adoption and signature of the mayor.
