AN ORDINANCE AUTHORIZING THE MAYOR TO SIGN AN
INTERGOVERNMENTAL AGREEMENT CREATING AN
EMERGENCY TELEPHONE SERVICE AUTHORITY IN
ORDER TO ESTABLISH AND OPERATE AN EMERGENCY
TELEPHONE SERVICE SYSTEM IN THE TOWN OF
ESTES PARK,COLORADO,AND IMPOSING AN EMERGENCY
TELEPHONE CHARGE UPON TELEPHONE ACCESS
FACILITIES WITHIN THE TOWN OF ESTES PARK:
AUTHORIZING SERVICE SUPPLIERS TO COLLECT
SAID EMERGENCY TELEPHONE CHARGES
WHEREAS,it would serve the public safety and welfare and be
in the best interests of the citizens of the Town of Estes Park
to participate in the organization,administration and common use
of a central emergency telephone service authority to aid the
timely dispatch of emergency service to citizens of the Town of
Estes Park;and
WHEREAS,pursuant to Colorado Revised Statutes Section
29—11—101,et seq 1973,as amended,the Town of Estes Park is
delegated the power to enter into agreements for the purpose of
providing emergency telephone service and is lawfully authorized
to impose a charge upon telephone subscribers within the Town of
Estes Park and to authorize telephone suppliers to collect said
charge;
WHEREAS,the Town of Estes Park desires to enter into an
intergovernmental agreement with other public agencies within
Larimer County to 1)establish a separate legal entity to be
known as an emergency telephone service authority which shall be
responsible for administering the operation of the emergency
telephone service program;and 2)define the manner in which the
participating public agencies will participate in the authority.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK,COLORADO:
Section 1.The Mayor is authorized to sign an
intergovernmental agreement creating an emergency telephone
service authority in order to establish and maintain an
emergency telephone service system in the County of Larimer,
Colorado.

Section 2.There is hereby imposed,pursuant to Colorado
Revised Statutes,Section 29—11—101,et seq 1973,as amended,
upon all telephone exchange access facilities within the Town of
Estes Park,an emergency charge in an amount of not to exceed 5O
per month or two per cent (2%)of the tariff rate as approved by
the Public Utilities Commission,whichever is less.Upon
recommendation of the Emergency Telephone Service Authority,the
Board of Trustees may,by resolution,raise or lower the
emergency telephone charge but in no event shall such charge
exceed the amount of 5O per month to each telephone exchange
access facility or 2%of the tariff as approved by the Public
Utilities Commission,whichever is less.
Section 3.Telephone service suppliers providing telephone
service in the Town of Estes Park are hereby authorized to
collect the emergency telephone charge imposed by this ordinance
in accordance with Colorado Revised Statutes,29—11—101 et seq,
1973,as amended.
Section 4.Portions of this ordinance relating to the
imposition and collection of telephone emergency charges shall
not be effective until the intergovernmental agreement creating
the emergency telephone service authority for Larimer County and
concerning the implementation of an emergency telephone service
system is signed by representatives of all parties to that
agreement.
Section 5.The Board of Trustees of the Town of Estes
Park,Colorado,herewith finds,determines and designates that
this ordinance is necessary for their immediate preservation of
the public peace,health and safety,in order to provide for
central emergency telephone service;and whereas,in the opinion
of the Board of Trustees,an emergency exists,this Ordinance
shall take effect and be in force immediately after its passage,
adoption and signature of the Mayor.
