HomeMy WebLinkAboutORDINANCE 03-860 0 ORDINANCE NO.3-86 AN ORDINANCE AMENDING CHAPTER 14 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO,THE SAME PERTAINING TO BUILDINGS AND CONSTRUCTION INCLUDING THE ADOPTION OF THE UNIFORM BUILDING CODE,1985 EDITION WHEREAS,on the 28th day of January ,1986,the Board of Trustees of the Town of Estes Park held a public Hearing on the adoption of the 1985 edition of the Uniform Building Code; and WHEREAS,notice of said hearing was published as provided in Section 31—16—203,C.R.S.1973;and WHEREAS,prior to the adoption of the Uniform Building Code, 1985 edition,by reference,copies of said Code were submitted to the Board of Trustees of the Town of Estes Park. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.That Section 14.12.010 of the Municipal Code of the Town of Estes Park,Colorado,shall be amended to read as follows: 14.12.010 Uniform Building Code,1985—-—Adopted.The Uniform Building Code,1985 edition and Uniform Building Code Appendix,1985 edition,and the Uniform Building Code Standards, 1985 edition,issued by the International Conference of Building Officials,5360 South Workman Mill Road,Whittier,California 90601,except the sections or parts of sections thereof which are amended by this chapter,referred to in this title as the “Uniform Building Code”,is enacted,adopted by this reference, and incorporated in this chapter as if set out at length. Section 2.That Section 14.12.020 of the Municipal Code of the Town of Estes Park shall be amended to read as follows: 14.12.020 Exceptions to Appendix.The Uniform Building Code Appendix,1985 edition,is amended by the deletion of chapters 1, 12,and 53. Section 3.That Section 14.12.030 of the Municipal Code of the Town of Estes Park shall be amended to read as follows: 14.12.030 Section 304(a)and (b)amended———Building permit fees.The first paragraph of subsection (a)of section 304 and subsection (b)of section 304 of the Uniform Building Code are 0 Ct. amended to read as follows: “Section 304 (a).Building Permit Fees.The fee for each permit shall be as set forth in Table No.3—a except for M—1,R-1 and R—3 occupancies which shall be ten cents (100)per gross square foot for the work described including basements located therein.” “Section 304 (b).Plan Review Fees.When a plan or other data is required to be submitted by Subsection (b)of Section 302,a plan review fee shall be paid at the time of submitting plans and specifications for review.Said plan review fee shall be five cents (50)per gross square foot.” Section 4.That the Municipal Code of the Town of Estes Park shall be amended by the addition of 14.12.035 to read as follows: 14.12.035 Exceptions to Building Permit Fees.All other building permit fees and fees for inspection shall be as set forth in Table 3—a except there shall be no plan check required for projects submitted with a valuation less than $1500 or other projects not actually requiring a plan check. Section 5.That Section 14.12.040 of the Municipal Code of the Town of Estes Park shall read as follows: 14.12.040 Section 307 (a)amended ———Use or Occupancy. Section 307 (a)of the Uniform Building Code is amended to read as follows: “Section 307(a)——Use or occupancy.No building or structure of group A,E,I,H,B or R Occupancy,shall be used or occupied, and no change in the existing occupancy classification of a building or structure or portion thereof shall be made until the building official has issued a Certificate of Occupancy therefore as provided herein.” Section 6.The Municipal Code of the Town of Estes Park shall be amended by the addition of 14.12.045 to read as follows: 14.12.045 Grading Permits.Section 7003 of Chapter 70 of the Uniform Building Code Appendix,1985 edition,shall be amended to read as follows: A grading permit shall only be required for projects requiring development plan approval under the provisions of Section 17.72.090 of the Municipal Code where final approval of a development plan has been received but a building permit has not been issued and the applicant desires to grade or excavate a project prior to the issuance of a building permit. Section 7.That Section 14.12.050 of the Municipal Code of the Town of Estes Park shall read as follows: 14.12.050 Violation.A.It is unlawful for any person to violate any of the provisions stated or adopted in the Uniform Building Code. B.Every person convicted of a violation of any provision stated or adopted in the Uniform Building Code shall be punished as set forth in Section 1.20.020 of this code. 0 0 Section 8.That Chapter 14.12 of the Municipal Code of the Town of Estes Park shall be amended by the addition of 14.12.060 to read as follows: 14.12.060.Damages.Neither the Town’s Building Inspector, Town Engineer nor any other employee of the Town of Estes Park nor any person appointed or hired by the Town of Estes Park shall be liable in damages for any act and/or ommission by him pursuant to the duties and enforcement of the provisions of the Uniform Building Code. Section 9.The Board of Trustees of the Town of Estes Park, Colorado,herewith finds,determines and designates that this ordinance is necessary for their immediate preservation of the public peace,health and safety,in order to provide for uniform building codes;and whereas,in the opinion of the Board of Trustees,an emergency exists,this Ordinance shall take effect and be in force immediately after its passage,adoption and signature of the Mayor. Mayor I hereby certify that the above ordinance was introduced and read at a regular meeting of the Board of Trustees on the C?— day of ___________________, 1986,and published in a newspaper of general circulation in the Town of Estes Park,Colorado.
