Trustee Robert E.Wagner moved the following bills be allowed and paid and the Clerk be authorized to draw warrants for the same.(A certified copy of the bills read and allowed are on file in the office of the Town Clerk under this date and made a part of the record of these proceedings by reference thereto.) Trustee Houston seconded the motion.The motion passed by the following votes:Those voting “Yes’Trustees Robert E.Burgess, H.Bernerd Dannels,Margaret Houston,N.T.Petrocine,Robert E. Wagner.Those voting “No”none. Trustee H.Bernerd Dannels,Chairman of the Public Works Committee, read the minutes of a meeting held December 16,1977 and moved the minutes be approved.Trustee Petrocine seconded the motion and the motion unanimously carried. Trustee Robert E.Burgess,Chairman of the Public Safety Committee, read the minutes of a meeting held December 22,1977 and moved the minutes be approved.Trustee Petrocine seconded the motion and the motion unanimously carried. Trustee Robert E.Burgess introduced the following resolution and moved it be passed and adopted subject to review of the agreement by the Town Attorney regarding word usage of “Chief” and “Sheriff”: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: That the Mayor and Town Clerk are hereby authorized and directed to sign the Reciprocal Police Aid Agreement by and between Fort Collins,Greeley,Loveland,Berthoud,Fort Lupton, Windsor,Larimer County,Weld County,and the Town of Estes Park. Trustee Dannels seconded the motion.The motion passed by the following votes:Those voting “Yes”Trustees Margaret Houston, Robert E.Wagner,N.T.Petrocine,H.Bernerd Dannels,Robert E.Burgess.Those voting “No”none. Minutes of a meeting of the Board of Trustees of the Town of Estes Park,Larimer County,Colorodo Meeting held in the Town Hall in said Town of Estes Park on the day of A.D.19....at regular meeting hour. Meeting called to order by Mayor Present:Mayor Trustees:U Also Present: Absent: The 1978 Advertising Agreement between the Estes Park Area Chamber of Commerce and the Town of Estes Park was submitted to the Board of Trustees for its consideration.The Board referred the agree ment to the Town Attorney for review and will reconsider it at its next regular meeting. Trustee N.T.Petrocine,Chairman of the Estes Park Planning Commission,read the minutes of a meeting held December 20,1977. Paul Van Horn appeared on behalf of petitioners Richard and Dolores Buck requesting to divide Lot 13,South Saint Vram Addition into two parcels containing 1.027 acres and .824 acres. Trustee H.Bernerd Dannels moved the lot split be approved sub ject to (1)the existing curb cut onto South Saint Vram Avenue from “Tract A”being vacated,(2)the access from Avalon Drive to “Tract A”being shown on the reproducible copy of the plat to be provided the Town,and (3)the 30’easement along the south pro— erty line of “Tract B”being designated a “Utility easement”to include electric power service.Trustee Wagner seconded the motion and the motion unanimously carried. A petition was submitted by Charles and Doris Herzog on behalf of Mountain States Cinema Corporation requesting a boundary line adjustment of Lot 3,Block 2,Town of Estes Park.This request proposes to transfer the southerly 1 feet of the northern 34 feet of Lot 3 to the Herzogs’portion of Lot 3 which would allow them enough land area to provide three of the four off—street parking spaces required for their building addition.Trustee Robert E.Burgess moved the lot split be approved.Trustee Wagner seconded the motion and it unanimously carried. Charles Herzog requested that he be permitted to pay the $750 fee in lieu of providing the fourth off—street parking space required for his building addition on Lot 3,Block 2,Town of Estes Park.Trustee Robert E.Wagner moved the request be granted. Trustee Burgess seconded the motion and it unanimously carried. Bob Copper submitted a request to pay the off—street parking fees in lieu of providing the nine spaces required for his new building at 162 West Elkhorn Avenue.Trustee Robert E.Burgess moved the request be granted.Trustee Dannels seconded the motion.The motion passed unanimously Trustee Robert E.Wagner,Member of the Estes Park Board of Adjustment,read the minutes of a meeting held January 4,1978. Light and Power Director Robert Dekker reported on various Platte River Power Authority activities including the progress of the Rawhide Power Plant project,the new PRPA office building,and transmission line construction,and also the 19—20%wholesale power rate increase which will go into effect this week. Meeting called to order by Mayor Present:Mayor Trustees: Also Present: Absent, Mayor Harry B.Tregent proceeded to conduct a public hearing on the proposed ordinance adopting the 1977 revised edition of the “Model Traffic Code for Colorado Municipalities’.Chief of Police Robert Ault spoke in favor of adoption of the Model Traffic Code.No persons appeared speaking in opposition and no correspon dence was received regarding adoption of the 1977 edition of the Model Traffic Code.Mayor Harry B.Tregent declared the hearing closed. Trustee Robert E.Wagner introduced and the Clerk read in full the following entitled ordinance and Trustee Wagner moved the ordinance be passed and adopted on second and final reading: AN ORDINANCE FOR THE REGULATION OF TRAFFIC BY THE TOWN OF ESTES PARK,COLORADO,FOR THE PUR POSE OF PROVIDING A SYSTEM OF TRAFFIC REGULA TIONS CONSISTENT WITH STATE LAW AND GENERALLY CONFORMING TO SIMILAR REGULATIONS THROUGHOUT THE STATE AND THE NATION;ADOPTING BY REFERENCE THE 1977 REVISED EDITION OF THE “MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES”;REPEALING PENALTIES FOR VIOLATION THEREOF;AND AMENDING SECTION 10.04.010 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO. Trustee Burgess seconded the motion.The motion passed by the following votes:Those voting “Yes”Trustees Robert E.Wagner, Margaret Houston,H.Bernerd Dannels,N.T.Petrocine,Robert E.Burgess.Those voting “No”none.Whereupon Mayor Harry B. Tregent declared said ordinance duly passed and adopted and ordered it numbered 1—78 and published according to law. Trustee H.Bernerd Dannels moved that paragraph 3 on page 4 of the Town’s personnel policy entitled “Appeals’be amended according to Town Attorney Hartwell’s letter dated December 22,1977.Trustee Petrocine seconded the motion and it unani mously carried. Trustee H.Bernerd Dannels introduced the following Resolution and moved it be passed and adopted: BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: The Board of Trustees of the Town of Estes Park, Colorado,under the authority of Sections 31—15—101(1)(c), 31—15—302 (1)(b),31—15—702 (1)(a)(I),31—15—711 (1)(h), C.R.S.1973,as amended,and Sections 2.04.060 and 2.04.080, Estes Park Municipal Code,hereby approved that certain Contract between the State Department of Highways,Division of Highways, N?396 toftrn of Isles ]Oarh,Larimer County,Colorado,..sJ40fl4VY...3-0.ic.7S... Minutes of a meeting of the Board of Trustees of the Town of Estes Park,Larimer County,Colorado Meeting held in the Town Hall in said Town of Estes Park on the day of A.D.19...at regular meeting hour. Meeting called to order by Mayor Present:Mayor Trustees: Also Present: Absent: and the Town of Estes Park,Colorado,for the construction of a bridge and approaches on East Riverside Avenue at the Big Thompson River,a copy of which is attached hereto and made a part hereof by this reference,and hereby authorizes and directs the Mayor and Town Clerk to execute said contract on behalf of the Town of Estes Park,Colorado. Trustee Wagner seconded the motion.The motion passed by the following votes:Those voting ‘Yes”Trustees Robert E.Burgess, N.T.Petrocine,Robert E.Wagner,H.Bernerd Dannels,Margaret Houston.Those voting “No”none. The Town Clerk presented an application for a change in ownership of a Hotel and Restaurant liquor license from Colony Hotels,Inc. to United Hotel Management Company dba The Inn at Estes Park. Trustee N.T.Petrocine moved the change of ownership be granted. Trustee Dannels seconded the motion and the motion unanimously carried. Greig Steiner submitted an application for a 20’driveway from Lot 10,Block 18,Town of Estes Park,onto Virginia Drive. Trustee Robert E.Burgess moved the driveway permit be granted subject to (1)a stop sign and a “No Left Turn”sign being in stalled at the exit and (2)a 20 mph speed limit being established on Virginia Drive.Trustee Dannels seconded the motion and it unanimously carried. A request was received from various property owners for the Town to pave North Ridge Lane in Lone Pine Acres.Mayor Harry B. Tregent referred the request to the Public Works Committee. The Board considered a rezoning request referred by the Larimer County Planning Department to rezone Lots 3,4,and 5 of Block 8,Ferguson’s Subdivision to T-Tourist.The request,submitted by Danny Beaty,proposed to reestablish the T—Tourist zoning for the Triple R Cottages which existed prior to a rezoning to E— Estate in mid 1977.Trustee N.T.Petrocine moved the Board favorably recommend the rezoning to the Larimer County Planning Commission.Trustee Wagner seconded the motion and it passed unanimously. Trustee Robert E.Wagner introduced and the Clerk read in full the following entitled ordinance and Trustee Wagner moved the ordinance be passed and adopted on first and final reading: AN ORDINANCE AMENDING SECTION 2.52.020 OF THE MUNICIPAL CODE OF ThE TOWN OF ESTES PARK,COLORADO,THE SAME PERTAINING TO COMPENSATION OF MUNICIPAL JUDGES.
