Minutes of the regular meeting held May 23,1978 were read and
approved as read.
Trustee 11.Bernerd Dannels moved the following bills be allowed
and paid and the Clerk be authorized to draw warrants for the
same.(A certified copy of the bills read and allowed are on
file in the office of the Town Clerk,under this date and made
a part of the record of these proceedings by reference thereto.)
Trustee Wagner seconded the motion.The motion passed by the
following votes:Those voting “Yes”Trustees Margaret houston,
Jack T.Rumley,Robert E.Burgess,James 11.Swickard,Robert E.
Wagner,II.Bernerd Dannels.Those voting “No”none.
Trustee James II.Swickard,Chairman of the Public Safety Committee,
read the minutes of a meeting held May 25,1978 and moved the
minutes be approved.Trustee Burgess seconded the motion and it
unanimously carried.
Trustee Robert E.Burgess introduced the following resolution
and moved it be passed and adopted:
RESOLUTION
BE IT RESOLVED BY TIlE BOARD OF TRUSTEES OF THE TOWN OF
ESTES PARK,COLORADO:
That the Mayor and Town Clerk are hereby authorized and
directed to sign the agreement by and between the Town of Estes
Park and Wesley V.Metzler regarding animal impoundment.
Trustee Wagner seconded the motion.The motion passed by the
following votes:Those voting “Yes”Trustees Jack P.Rumley,
Robert E.Wagner,H.Bernerd Dannels,Margaret houston,James
II.Swickard,Margaret Houston.Those voting “No”none.
Trustee Robert E.Wagner introduced and the Town Administrator
read in full the following entitled ordinance and Trustee Wagner
moved the ordinance be passed and adopted on first and final
reading:
AN ORDINANCE AMENDING SECTION 17.12.070
OF THE MUNICIPAL CODE OF THE TOWN OF
ESTES PARK,COLORADO,TIlE SAME PERTAINING
TO IMPOUNDMENT OF DOGS.
Trustee Swickard seconded the motion.The motion passed by the
following votes:Those voting “Yes”Trustees Robert E.Burgess,
Margaret houston,James H.Swickard,Jack T.Rumley,H.Bernerd
Dannels,Robert E.Wagner.Those voting “No”none.Whereupon
Mayor Harry B.Tregent declared said ordinance duly passed and
adopted and ordered it numbered 13—78 and published according to
law.

Trustee James H.Swickard,Chairman of the Public Safety Com
mittee,also read the minutes of a meeting held June 12,1978
and moved the minutes be approved.Trustee Wagner seconded the
motion.Mr.Corky Rogers then made a presentation on his pro
posed shuttle bus and tour operation and asked the Town Board’s
cooperation in providing him the requested bus stops on Moraine
Avenue.Upon voting,the motion unanimously carried.
Trustee Robert E.Burgess,Chairman of the Light &Power Committee,
read the minutes of a meeting held June 1,1978 and moved the
minutes be approved.Trustee Swickard seconded the motion and it
unanimously carried.
Trustee Robert E.Burgess introduced and the Town Administrator
read in full the following entitled ordinance and Trustee Burgess
moved the ordinance be passed and adopted on first and final
reading:
AN ORDINANCE AMENDING SECTION 13.08.061W
OF THE MUNICIPAL CODE OF THE TOWN OF ESTES
PARK,COLORADO,RELATING TO TIlE RULES AND
REGULATIONS OF TIlE LIGHT AND POWER DEPART
MENT AND IMPLEMENTING AN OPTIONAL BUOGET
BILLING PAYMENT PLAN FOR CERTAIN RESIDENTIAL
ELECTRIC CUSTOMERS.
Trustee Houston seconded the motion.The motion passed by the
following votes:Those voting “Yes”Trustees Margaret Houston,
James II.Swickard,Robert E.Burgess,Robert E.Wagner,II.
Bernerd Dannels,Jack T.Rumley.Those voting “No”none.
Whereupon Mayor harry B.Tregent declared said ordinance duly
passed and adopted and ordered it numbered 14—78 and published
according to law.
Trustee Robert E.Wagner,Chairman of the Water Committee,read
the minutes of a meeting held June 8,1978 and moved the minutes
be approved.Trustee Rumley seconded the motion and it passed
unanimously.
Mayor harry B.Tregent conducted a public hearing on a proposed
rate increase for Cablevision of Estes Park.John Schott,
Secretary/Treasurer of Liberty Communication Company,appeared
speaking in favor of the $2.00 rate increase and also requested
the following:
1.Reduction or elimination of city franchise fee
2.Reduction or elimination of city pole rental fees
3.Reduction of system mileage
4.Approval of automatic rate increases or decreases in
future to annual rate of inflation percentage as
determined by the Denver area index

5.Underground improvement requirements be paid by city
or increased rate.
There were no persons present speaking in opposition and no
correspondence was received regarding the rate increase.Mayor
Harry B.Tregent declared the hearing closed.Trustee II.Bernerd
Dannels moved the requested $2.00 rate increase be approved and
that future annual rate increasesfor inflation adjustments be
allowed based upon the month of July Denver Area Consumer Price
Index —“All Urban Consumers”section as published by the U.S.
Department of Labor.Trustee Rumley seconded the motion.The
motion passed by the following votes:Those voting “Yes”
Trustees II.Bernerd Dannels,Margaret houston,Jack T.Rumley.
Those voting “No”Trustees Robert E.Burgess,Robert it.Wagner.
Trustee James H.Swickard abstained with permission from the Board.
Mayor Harry B.Tregent proceeded to conduct a public hearing on
the adoption of the 1978 National Electric Code.There were no
persons present speaking in favor of or in opposition to the
proposed code and no correspondence was received regarding the
same.Mayor Harry B.Tregent declared the hearing closed.
Trustee Robert E.Burgess introduced and the Town Administrator
read the following entitled ordinance and Trustee Burgess moved
the ordinance be passed and adopted on second and final reading:
AN ORDINANCE FOR THE SAFEGUARDING OF PERSONS
AND PROPERTY FROM HAZARDS ARISING FROM TUE
USE OF ELECTRICITY WITHIN TIlE TOWN OF ESTES
PARK,COLORADO;ADOPTING BY REFERENCE THE
1978 EDITION OF TIlE NATIONAL ELECTRICAL CODE;
REPEALING ALL ORDINANCES IN CONFLICT TIIEREWITII;
AND AMENDING SECTION 14.20.010 OF TIlE MUNICIPAL
CODE OF TIlE TOWN OF ESTES PARK,COLORADO.
Trustee Swickard seconded the motion.The motion passed by the
following votes:Those voting “Yes”Trustees Robert E.Burgess,
Jack T.Rumley,Margaret houston,H.Bernerd Dannels,Robert E.
Wagner,James H.Swickard.Those voting ‘No”none.Whereupon
Mayor harry B.Tregent declared said ordinance duly passed and
adopted and ordered it numbered 15—78 and published according to
law.
The following entitled ordinance was introduced to the Board of
Trustees:

Trustee H.Bernerd Dannels moved the liquor license renewal for
Peter J.and Opal M.Calabrese dba Parlour Restaurant and Deli
be approved.Trustee Houston seconded the motion and it unani
mously carried.
Trustee Robert E.Burgess moved the request submitted by the
American Legion and Auxiliary to allow the Oglala Sioux Dancers
to use Bond Park on Tuesday,July 18th at 12:15 p.m.be approved.
Trustee Wagner seconded the motion and it unanimously carried.
Mayor harry B.Tregent conducted a public hearing on East Elkhorn
Addition petition for annexation.Attorney John Phipps appeared
on behalf of the owners of the proposed East Elkhorn Addition
speaking in favor of the annexation.He also submitted a mineral
extraction report to the Board of Trustees.Roger Thorp,
Architect,also appeared answering questions regarding the pro
posed development.There were no persons present speaking in
opposition and no correspondence was received.Mayor harry B.
Tregent declared the hearing closed.
Trustee Robert E.Wagner introduced the following resolution and
moved it be passed and adopted:
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF
ESTES PARK,COLORADO:
The Board of Trustees of the Town of Estes Park,after a
hearing on the Petition for Annexation filed by petitioner,
Elkhorn East,a joint venture,on May 16,1978,with the Town
Clerk of the Town of Estes Park,Colorado,for the annexation
of certain land described in said Petition,finds and concludes
that the property described in said petition is eligible to be
annexed because:
a)Not less than one—sixth of the perimeter of the
area proposed to be annexed is contiguous with the Town of Estes
Park,Colorado;
b)A community of interest exists between the area
proposed to be annexed and the Town of Estes Park,Colorado;
that said area is urban or will be urbanized in the near future;
and that said area is integrated with or is capable of being

integrated with the Town of Estes Park,Colorado;
c)There are no adult residents within the property
to be annexed at the time of this hearing;
d)None of the land proposed to be annexed is agricultural;
e)The area proposed to be annexed is provided or will be
within the reasonable near future provided with urban services;
f)No land of the territory to be annexed held in iden
tical ownership shall be divided into separate parts or parcels
without the written consent of the landowners thereof unless such
tracts or parcels are separated by a dedicated street,road or
other public way;
g)All of the owners of the property to be annexed have
signed the Petition for Annexation;
h)The annexation of the property described in said
petition will not result in the detachment of any area from any
school district;
i)An election under Section 31—12—107(2)C.R.S.1973,
as amended,will not be required,for the owners of one hundred per
cent of the area proposed to be annexed have signed said petition;
.1)No additional terms and conditions are to be imposed
by the Board of Trustees;
k)The area proposed to be annexed complies with the
applicable provisions of Section 31—12—104 and 31—12—105 C.R.S.
1973,as amended;
1)Upon the basis of the conclusions set forth in a
mineral extraction report submitted and prepared by a geologist
and a soil engineer,the Board of Trustees hereby finds and deter
mines that no known commercial mineral deposits are contained
within the territory to be annexed;and
having found that “EAST ELKHORN ADDITION”is eligible to
become annexed,the Board of Trustees of the Town of Estes Park,
Colorado,will undertake further annexation proceedings.
Trustee Houston seconded the motion.The motion passed by the fol

Trustee Wagner seconded the motion.The motion passed by the

E.Wagner,James H.Swickard.Those voting “No”none.
Mayor harry B.Tregent also conducted a public hearing on the
proposed C—i Commercial zoning of East Elkhorn Addition.
Attorney John Phipps,representing the petitioners,spoke in
favor of the zoning.No persons appeared speaking in opposi
tion and no correspondence was received.Mayor harry B.Tregent
declared the hearing closed.

moved it be passed on first reading:
