Rumley,Margaret Houston, H.Bernerd Dannels,James II.Swickard Also Present:Town Administrator Dale G.Hill Absent:None Mayor Harry B.Tregent reconvened this meeting from its original date of May 9,1978. Minutes of the regular meeting held April 25,1978 were read and approved as read. Trustee Robert E.Burgess moved the following hills be allowed and paid and the Clerk be authorized to draw warrants for the same.(A certified copy of the bills read and allowed are on file in the office of the Town Clerk under this date and made a part of the record of these proceedings by reference thereto.) Trustee Swickard seconded the motion and upon roll call the motion passed by the following votes:Those voting “Yes”Trustees Robert E.Burgess,H.Bernerd Dannels,Margaret Houston,Jack T.Rumley, James H.Swickard.Those voting “No”none. Trustee H.Bernerd Dannels introduced the following resolution and moved it be passed and adopted: RESOLUTION OF RESPECT WHEREAS,on the 5th day of May,1978,death brought to a close the active life of Rollen Sutter;and WHEREAS,Rollen Sutter has,through his constant efforts towards the betterment of our community,earned the heartfelt affection of all our citizens and neighbors;and WHEREAS,his service to the Town of Estes Park during his lifetime here has been most outstanding; NOW ThEREFORE,BE IT RESOLVED that the Mayor and Board of Trustees,by this resolution and public record,recognize the influence of Rollen Sutter upon our community,recognizing further that his death is an irreplaceable loss to the Town in which he worked and won deep respect and affection. BE IT FURTHER RESOLVED that this resolution of respect be sent to his family in recognition of his place in this community. Trustee Houston seconded the motion.Upon roll call the motion passed by the following votes:Those voting “Yes”Trustees H. Bernerd Dannels,Jack T.Rumley,James H.Swickard,Robert E. Burgess,Margaret Houston.Those voting ‘No”none. Meeting called to order by Mayor Present:Mayor Trustees: Also Present: Absent: Mr.Sutter’s death.Trustee Burgess seconded the motion and upon roll call the motion unanimously carried. Mayor Harry B.Tregent proceeded to conduct a public hearing re garding the application for a hotel and Restaurant License sub mitted by Gatsby’s of Estes Park,Ltd.for 116 West Elkhorn Avenue (Upper Floor).Robert Mobus and Lee Kemper spoke in favor of the liquor license.No persons appeared speaking in opposi tion and no correspondence was received.Mayor Harry B.Tregent declared the hearing closed. Trustee James H.Swickard moved the Board of Trustees finds that the hotel and Restaurant licenses already granted in this locality or area are inadequate for the reasonable requirements of the neighborhood,and that the desires of the inhabitants at this time are that this license application be granted;and that the license is granted.Trustee flannels seconded the motion and upon roll call the motion passed by the following votes:Those voting “Yes”Trustees Margaret houston,Robert E. Burgess,Jack T.Rumley,James H.Swickard,11.Bernerd flannels. Those voting “No”none. Mr.Eric Eidsness,Director of 208 Areawide Planning,presented the 208 Water Quality Plan to the Board of Trustees.He explained that implementation of the plan would be local involving the Town of Estes Park as well as the Sanitation Districts.Technical assistance would be available from the Larimer—Weld Council of Governments staff.Public hearings on the plan will be held at the Inn at Estes Park on June 14th and in Loveland on July 27th. Trustee James H.Swickard,Chairman of the Public Safety Committee, read the minutes of a meeting held April 27,1978 and moved the minutes be approved.Trustee Burgess seconded the motion and upon roll call the motion unanimously carried. Trustee Jack T.Rumley,Chairman of the Code &Sanitation Com mittee,read the minutes of a meeting held April 27,1978 and moved the minutes be approved.Trustee Burgess seconded the motion and upon roll call the motion unanimously carried. Trustee H.Bernerd flannels introduced and the Town Administrator read in full the followingentitled ordinance and Trustee Dannels moved the ordinance be scheduled for public hearing on June 13, 1978 and passed on first reading: MT ORDINANCE FOR THE SAFEGUARDING OF PERSONS AND PROPERTY FROM HAZARDS ARISING FROM THE USE OF ELECTRICITY WITHIN THE TOWN OF ESTES PARK,COLORADO;ADOPTING BY REFERENCE THE 1978 EDITION OF THE NATIONAL ELECTRICAL CODE; REPEALING ALL ORDINANCES IN CONFLICT THERE WITH;AND AMENDING SECTION 14.20.010 OF THE MUNICIPAL CODE OF TIlE TOWN OF ESTES PARK, COLORADO. Trustee Robert E.Burgess introduced and the Town Administrator read in full the following entitled ordinance and Trustee Burgess moved the ordinance be passed and adopted on first and final reading: AN ORDINANCE AMENDING SECTIONS 14.12.020, 14.28.060 AND 14.28.100 OF THE MUNICIPAL CODE OF ThE TOWN OF ESTES PARK,COLORADO, TFIE SAME PERTAINING TO BUILDING PERMITS, PERMITS FOR MOVING BUILDINGS WITHIN THE TOWN,WATER CONNECTION FEES AND FOUNDA TION REQUIREMENTS. Trustee Swickard seconded the motion and upon roll call the motion passed by the following votes:Those voting “Yes” Trustees H.Bernerd Dannels,Margaret Houston,Jack T.Rumley, James H.Swickard,Robert E.Burgess.Those voting “No”none. Whereupon Mayor Harry B.Tregent declared said ordinance duly passed and adopted and ordered it numbered 10—78 and published according to law. Trustee H.Bernerd Dannels introduced and the Town Administrator read in full the following entitled ordinance and Trustee Dannels moved the ordinance be passed and adopted on first and final reading: AN ORDINANCE AMENDING CHAPTER 14.20 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO,PERTAINING TO ELECTRICAL CONSTRUCTION REQUIREMENTS. Trustee Rumley seconded the motion and upon roll call the motion passed by the following votes:Those voting “Yes” Trustees Margaret Houston,Jack T.Rumley,James H.Swickard, Robert E.Burgess,H.Bernerd Dannels.Those voting “No”none. Trustee Margaret Houston read the minutes of the Policemen’s Pension Board meeting held April 27,1978. Trustee Margaret Houston also read the minutes of the Firemen’s Pension Board meeting held April 27,1978. Trustee Jack T.Rumley,Chairman of the Estes Park Board of Adjustment,read the minutes of a meeting held May 10,1978. Trustee Margaret Houston,Member of the Estes Park Planning Commission,read the minutes of a meeting held May 16,1978. The Board of Trustees considered a petition from Nicky Kane requesting to divide Tract 59,Fall River Addition into two parcels,containing .864 and 13.164 acres.Member Robert E. Burgess moved the lot split be granted subject to Mr.Kane entering into an agreement in which “Parcel B”of the lot split would be combined into one parcel with Tracts 61 and 62 of Fall River Addition.Trustee Dannels seconded the motion. Upon roll call the motion unanimously carried. The Board of Trustees also considered a petition from Fred Steffens requesting to divide a portion of Lot 100 and Lot 101 of Alfresco Place into two parcels containing 1.445 acres and .620 acres.Trustee James H.Swickard moved the lot split be approved.Trustee Rumley seconded the motion and upon roll call the motion unanimously carried. A discussion was conducted on the special review procedures and requirements for amusements.Trustee H.Bernerd Dannels moved the Board accept the recommendation of the Planning Commission and amend the Municipal Code to allow indoor amusements as a per mitted use in C—i and C—2 and to allow outdoor amusements by special review in C—i and C—2 zoning districts.Trustee Swickard seconded the motion.Upon roll call the motion passed by the following votes:Those voting “Yes”Trustees James H.Swickard, H.Bernerd Dannels,Jack T.Rumley.Those voting “No”Trustees Robert E.Burgess,Margaret Houston. The Board of Trustees reviewed the recommendations of the Larimer County Planning Commission to the Estes Park Planning Commission on the Town’s Master Plan.Trustee H.Bernerd Dannels moved the Planning Commission proceed with amending the Master Plan in accordance with the County Planning Commission’s recommendations. Meeting called to order by Mayor Present:Mayor Trustees: Also Present: Absent: Mayor harry B.Tregent recommended Robert L.Dekker serve as the Town’s representative on the Municipal Energy Saving Association which is comprised of the four cities of Platte River Power Authority. Trustee Robert E.Burgess moved the appointment be approved.Trustee Dannels seconded the motion and upon roll call the motion unani mously carried. Mr.R.William Ilendren submitted an application for a 20’driveway permit for Lot 11,Block 5,Country Club Manor onto High Street. The new driveway would provide access for a proposed garage.Trustee 11.Bernerd Dannels moved the driveway permit be granted.Trustee Swickard seconded the motion and upon roll call the motion unani mously carried. A petition was submitted by Steve Nagl dba The Wheel requesting to expand the premises currently licensed under a Tavern liquor license approximately 400 sq.ft.Trustee H.Bernerd Dannels moved the request to expand the premises be approved.Trustee Swickard seconded the motion and upon roll call the motion unani mously carried. Trustee James H.Swickard moved the following liquor license re newals be approved: Elkhorn Lodge Rock Acres Estes Park Liquor Store Lazy T Motor Lodge Lions Club of Estes Park Trustee Houston seconded the motion and upon roll call the motion unanimously carried. Owners of the Timberlane Motor Lodge requested the Town’s permission to place a mobile home on their property which is adjacent to Town property.Prior to placing a mobile home on one’s property,County regulations require consent of 70%.of the property owners located within an 800’radius of the mobile home location.Trustee James H.Swickard moved that the Town not grant permission.Trustee Dannels seconded the motion and upon roll call the motion passed by the following votes:Those voting “Yes”Trustees Robert E. Burgess,II.Bernerd Dannels,Margaret Houston,James II.Swickard. Those voting “No”Trustee Jack T.Rumley. A request was received from the Estes Park Assembly of God Church to use the Municipal Building for church services until they either buy or build a church.Mayor harry B.Tregent referred this request to the Public Works Committee. Millie Davis requested a “Snake Dance”benefiting the Muscular Dystrophy Drive be allowed along Elkhorn Avenue from West Park Center to the Estes Park High School on May 21st at 10:00 A.M. Trustee H.Bernerd Dannels moved the “Snake Dance”be allowed as requested.Trustee Houston seconded the motion and upon roll call the motion unanimously carried.
