Minutes of a meeting of the Board of Trustees of the Town of Estes
Park,Larimer County,Colorado.Meeting held in the Town Hall in said Town of Estes Pork

Town Administrator Margaret Houston,Jack T.
Absent:Rumley
Minutes of the regular meeting held January 23,1979 were read
and approved as read.
Trustee H.Bernerd Dannels moved the following bills be allowed
and paid and the Clerk be authorized to draw warrants for the
same.(A certified copy of the bills read and allowed are on
file in the office of the Town Clerk,under this date and made
a part of the record of these proceedings by reference thereto)
Trustee Wagner seconded the motion.The motion passed by the
following votes:Those voting “Yes”Trustees Robert E.Burgess,
Margaret Houston,James H.Swickard,Robert F.Wagner,Jack T.
Rumley,H.Bernerd Dannels.Those voting ‘No”none.
Trustee Margaret Houston,Chairperson of the Advertising and
Public Relations Committee,read the minutes of a meeting held
January 25,1979 and moved the minutes be approved.Trustee
Rumley seconded the motion and it passed unanimously.
Trustee H.Bernerd Dannels introduced the following resolution
and moved it be passed and adopted:
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF
ESTES PARK,COLORADO:
That the Mayor and Clerk are hereby authorized and directed
to sign the agreement by and between the Town of Estes Park and
the Estes Park Area Chamber of Commerce regarding the 1979
Advertising Agreement.
Trustee Houston seconded the motion.The motion passed by the
following votes:Those voting “Yes”Trustees James H.Swickard,
Margaret Houston,Robert E.Wagner,H.Bernerd Dannels,Jack T.
Rumley,Robert E.Burgess.Those voting “No”none.
Trustee James H.Swickard,Chairman of the Public Safety Committee,
read the mintues of a meeting held January 25,1979 and moved the
minutes be approved.Trustee Wagner seconded the motion and it
unanimously carried.
Trustee Robert E.Burgess,Chairman of the Light &Power Committee,
read the minutes of a meeting held February 1,1979 and moved the
minutes be approved.Trustee Swickard seconded the motion and it
unanimously carried.
Trustee Jack T.Rumley,Chairman of the Code and Sanitation Com
mittee,read the minutes of a meeting held February 6,1979 and
moved the minutes be approved.Trustee Burgess seconded the
motion and the motion unanimously carried.

Trustee Robert E.Wagner,Chairman of the Water Committee,read
the minutes of a meeting held February 7,1979 and moved the
minutes be approved.Trustee Dannels seconded the motion and
it unanimously carried.
Trustee Jack T.Rumley,Chairman of the Estes Park Board of Adjust
ment,read the minutes of a meeting held on January 24,1979.
Lee Goracke of the Lions Club of Estes Park submitted a financial
report on the Lions Club Concession Stand at Stanley Park for 1976,
1977,and 1978.He also presented to the Mayor three checks
totalling $5,764.43 as the Town’s share of the profits for the
three years.
Trustee H.Bernerd Dannels introduced the following resolution
and moved it be passed and adopted:
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF
ESTES PARK,COLORADO:
That the Mayor is hereby authorized and directed to sign
the Temporary Use Agreement between the Town of Fetes Park and
the Northern Colorado Water Conservancy District regarding the
renewal of the use permit for 95 acre—feet of water.
Trustee Wagner seconded the motion.The motion passed by the
following votes:Those voting “Yes”Trustees Robert F.Wagner,
Robert E.Burgess,James H.Swickard,Jack T.Rumley,H.Bernerd
Dannels,Margaret Houston.Those voting “No”none.
Rex Miller,representing Miller Enterprises,submitted a request
for a 20’driveway onto Big Horn Drive from the former Lewiston
property located at 321 Big Horn Drive.Trustee James H.Swickard
moved the curb cut request be granted.Trustee Wagner seconded
the motion and it passed unanimously.
Joseph P.Jenkins,attorney representing Frank Williams,appeared
before the Board requesting the Town accept and maintain the
James-McIntyre Road (Old Fall River Road).Mr.Williams had
previously filed suit against the Town claiming that the road is
public but the District Court dismissed the case.The law suit
is now before the Court of Appeals but a judgment will not be
rendered prior to February 25,1979.Mr.Jenkins explained that
his client is unable to obtain financing because the property does
not have public access and that Mr.Williams will lose possession
of the property on February 25,1979 if financing is not obtained.
Mr.Williams also appeared and commented on the direct benefits
the Town would receive from his proposed development of the prop
erty.Trustee H.Bernerd Dannels moved that the Town deny the
request to accept and maintain the James—McIntyre Road.Mayor
Harry B.Tregent declared the motion “dead”for lack of a second.

Trustee James H.Swickard then moved that the Board of Trustees
meet with attorneys John Chilson and Joseph Jenkins as soon as
possible and prior to February 25,1979 to further study the
request.Trustee Burgess seconded the motion and the motion
unanimously carried.
Trustee James H.Swickard introduced and the Town Administrator
read in full the following entitled ordinance and Trustee
Swickard moved it be passed and adopted on first and final
reading:
AN ORDINANCE AMENDING CHAPTER 9.54 OF THE
MUNICIPAL CODE OF THE TOWN OF ESTES PARK,
COLORADO,THE SAME RELATING TO DISORDERLY
CONDUCT.
Trustee Rumley seconded the motion.The motion passed by the
following votes:Those voting “Yes”Trustees Jack T.Rumley,
H.Bernerd Dannels,James H.Swickard,Robert E.Burgess,
Robert E.Wagner,Margaret Houston.Those voting “No”none.
Whereupon Mayor Harry B.Tregent declared said ordinance duly
passed and adopted and ordered it numbered #3-79 and published
according to law.
Trustee Robert E.Burgess introduced and the Town Administrator
read in full the following entitled ordinance and Trustee Burgess
moved it be passed and adopted on first and final reading:
AN ORDINANCE AMENDING CHAPTER 2.48 OF THE
MUNICIPAL CODE OF THE TOWN OF ESTES PARK,
COLORADO,THE SAME RELATING TO ORGANIZATION
OF THE POLICE DEPARTMENT.
Trustee Wagner seconded the motion.The motion passed by the
following votes:Those voting “Yes”Trustees Margaret Houston,
James H.Swickard,H.Bernerd Dannels,Robert E.Wagner,Jack T.
Rumley,Robert E.Burgess.Those voting “No”none.Whereupon
Mayor Harry B.Tregent declared said ordinance duly passed and
adopted and ordered it numbered #4-79 and published according
to law.
Three different requests were received from Larimer County
regarding parking for the Sheriff’s office and for potential
customers in front of the Park Lane Building.Mayor Harry B.
Tregent referred these parking requests to the Public Safety
Committee.
There being no further business,the meeting adjourned.
