Minutes of a meeting of the Board of Trustees of the Town of Estes
Park,Larimer County,Colorado.Meeting held in the Town Hall in said Town of Estes Pork

Meeting called to order by Mayor

Absent:H.Swickard
Minutes of the regular meeting held July 10,1979 were read and
approved as read.
Trustee Robert E.Wagner,Chairman of the Water Committee,read
the minutes of a meeting held July 12,1979 and moved the minutes
be approved.Trustee Rumley seconded the motion and it passed
unanimously.
Trustee Jack T.Rumley,Chairman of the Code &Sanitation Com
mittee,read the minutes of a meeting held July 13,1979 and
moved the minutes be approved.Trustee Swickard seconded the
motion and the motion unanimously carried.
Trustee H.Bernerd Dannels,Chairman of the Public Works Committee,
read the minutes of a meeting held July 19,1979 and moved the
minutes be approved.Trustee Houston seconded the motion and it
passed unanimously.
The minutes of the Estes Park Planning Commission meeting held
July 17,1979 were read.
A plat of the Fairway Resubdivision was submitted to the Board
of Trustees for consideration.Trustee Robert E.Burgess moved
consideration of the plat be tabled because the final plat,
Attorney’s certificate,and petition for exception have not been
received.Trustee Wagner seconded the motion and it passed unani
mously.
Bill Van Horn,on behalf of Helmut Brunner,presented the Brook
Drive Subdivision which divides Lot 1,Twin View Addition according
to a previous illegal division.Bill Van Horn explained the
history of the division and that Mr.Brunner obtained the easterly
portion of Lot 1,Twin View Addition through a foreclosure and
was unaware of the illegal lot division.He stated that if the
lot were in one ownership,the zoning would allow a duplex which
would create the same density and demand on the water system as
would result from the lot split.Town Engineer/Planner Widmer
discussed the Town Attorney’s letter which states that all owners
of the parcel being split must sign the plat.Robert Ault and
Janet Romer,residents of the neighborhood,spoke in opposition
to the lot split.Letters in opposition were received from Mr.
Robert Ault dated March 31,1979 and from Harry J.and Janet S.
Romer dated April 2,1979.Correspondence was also received from
the Town Engineer/Planner dated June 12,1979,the Water Super—
intendent dated June 5,1979,the Light &Power Director dated
June 1,1979 and the Town Attorney dated June 8,1979.Trustee
James H.Swickard moved the lot split be denied.Trustee Dannels
seconded the motion and the motion passed by the following votes:
Those voting “Yes”Trustees Robert FL Burgess,H.Bernerd Dannels,
Margaret Houston,James H.Swickard,Robert E.Wagner.Those voting
“No”none.Trustee Jack T.Rumley abstained with permission from
the Board of Trustees.
Bill Van Horn,representing the Schusters,presented the Schuster
Subdivision which proposes to divide Lot 8,Buenna Vista Terrace
into two parcels of .743 and .484 acres each.Trustee H.Bernerd

Dannels moved Schuster Subdivision be approved subject to the
final plat and Attorney’s certificate regarding ownership being
submitted.Trustee Rumley seconded the motion and it passed
unanimously.
The Board of Trustees considered an application for a change in
ownership of the Retail Liquor Store License for Mountain Dew
Liquors from Edward and Clayre Dragon to Robert and Connie
Gappa.Trustee Jack T.Rumley moved the change of ownership be
approved.Trustee Houston seconded the motion and it passed
unanimously.
Trustee Robert E.Wagner introduced the following resolution and
moved it be passed and adopted:
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN
OF ESTES PARK,COLORADO:
That in compliance with Section 3.05.040(2)of the
Municipal Code of the Town of Estes Park,Colorado,the per
centage of rental payments to be refunded to the elderly
citizens shall be .43 (.43%)of the rental payments made during
1978.
Trustee Swickard seconded the motion and the motion passed by
the following votes:Those voting “Yes”Trustees James H.
Swickard,Jack T.Rumley,Robert E.Burgess,Margaret Houston,
H.Bernerd Dannels,Robert E.Wagner.Those voting ‘No”none.
Trustee Robert E.Wagner moved the liquor license renewal for
Heidi’s Hideaway be approved.Trustee Rumley seconded the motion
and it passed unanimously.
Trustee James H.Swickard introduced the following resolution
and moved it be passed and adopted:
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN
OF ESTES PARK,COLORADO:
That the Mayor and Clerk are hereby authorized and directed
to sign the agreement by and between the Town of Estes Park and
the Boulder Hunter Jumper Club regarding performances at Stanley
Park on August 8 —12,1979.
Trustee Wagner seconded the motion.The motion passed by the
following votes:Those voting “Yes”Trustees Robert E.Burgess,
Robert E.Wagner,James H.Swickard,Jack T.Rumley,H.Bernerd
flannels,Margaret Houston.Those voting “No”none.

Because the previous appointee to the Larimer County Community
Action Board is unable to serve,Mayor Tregent recommended Robert
Ault be appointed.Trustee Jack T.Rumley moved the appointment
be approved.Trustee Wagner seconded the motion and it passed
unanimously.
The Town Administrator reported that a traffic count report had
been received from the State Highway Department which showed
the traffic on Highway 34 during June 1979 to be 20%less than
June 1978.
Trustee Robert E.Wagner suggested that the Planning Comission
consider requiring that notification of proposed subdivisions and
lot splits be sent to adjacent property owners.
There being no further business,the meeting adjourned.
