Pork,L.orimer County,Colorado.Meeling held in the Town Halt in said Town of Estes Park

Absent:None
Minutes of the regular meeting held September 13,1977 were read
and approved as read.
Trustee flannels,Chairman of the Public Works Committee,read the
minutes of a meeting held September 22,1977 and moved the minutes
be approved.Trustee Sutter seconded the motion and upon roll
call the motion unanimously carried.
Trustee N.T.Petrocine,Chairman of the Estes Park Planning Com
mission,read the minutes of a meeting held September 20,1977.
As recommended by the Planning Commission,Trustee flannels moved
the following changes to the off—street parking ordinance be
adopted:
1.Provide for a five (5)year payment schedule without
interest for “in lieu of”payments for off—street parking.
2.Amend the code so that some method of establishing the
cost of off—street parking can be applied to the per
space cost to the developer in an equitable manner.
3.Hire Bill Lamont of the firm Brisco,Maphis,Murray and
Lamont to study and recommend whether or not it would be
practical to consider a possible amendment to the zoning
code that would change the off—street parking require
ments for the central business district.
Trustee Wagner seconded the motion and upon roll call the motion
unanimously carried.
Trustee Robert E.Burgess introduced and the Clerk read the fol
lowing entitled ordinance,and Trustee Burgess moved the ordinance
be passed and adopted on second and final reading:
AN ORDINANCE AMENDING SECTIONS .7.12.040 AND
7.12.090 OF THE MUNICIPAL CODE OF THE TOWN
OF ESTES PAnIC,COLORADO,RELATING TO CONTROL
OF DOGS AND TO VICIOUS DOGS.
Trustee Houston seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Trustees II.
Bernerd flannels,Robert E.Burgess,Margaret Houston,Robert E.
Wagner,Rollen Sutter,N.T.Petrocine.Those voting “No”none.
Whereupon Mayor harry B.Tregent declared said ordinance duly
passed and adopted and ordered it numbered 21—77 and published
according to law.
A formal presentation of the flood hazard mapping for the Town
of Estes Park was made by Thomas Stone and Pat Mulhearn of
Gingery and Associates.They explained the three hazard areas
depicted on the maps as the floodway (red),100 year flooplain
or Zone A (brown),and 500 year floodplain or potential flood

area or Zone B (green).Mr.Robert Shaw of the Federal Insurance
Administration then explained what building could take place with
in the various zones and which insurance rates would apply.The
100 year flood elevations within the Town of Estes Park will be
published in the local newspaper which will mark the beginning
of the 90 day appeal period.At the completion of the appeal period,
the Town will have six months in which to adopt floodplain manage
ment provisions based upon minimum federal requirements.
Mayor Harry B.Tregent proceeded to conduct a public hearing re
garding the application for a Hotel and Restaurant License sub
mitted by Ronald R.and Nancy G.Flory dba Chantilly at 120 West
Elkhorn Avenue.Ronald R.Flory spoke in favor of the license.
There were no persons present speaking in opposition.A letter
dated September 25,1977 was received from Robert M.Mobus stating
his support for the liquor application.Mayor Harry B.Tregent
declared the hearing closed.
Trustee H.Bernerd Dannels moved the Board of Trustees finds that
the Hotel and Restaurant licenses already granted in this locality,
or area are inadequate for the reasonable requirements of the
neighborhood,and that the desires of the inhabitants at this time
are that this license application be granted;and that the license
is granted.Trustee Wagner seconded the motion.Upon roll call
the motion passed by the following votes:Those voting “Yes”

N.T.Petrocine,Rollen Sutter,Robert E.Wagner.Those voting
“No”none.
Mayor Harry B.Tregent proceeded to conduct a public hearing re
garding the application for a Retail Liquor Store License sub
mitted by Odd Lyngholm dba Sunset Liquor at 471 West Elkhorn Ave
nue.Mr.Odd Lyngholm requested a continuance of the public
hearing because several of his witnesses were unable to attend.
Mr.Ron Strahle,attorney representing several opponents,ob
jected to a continuation and then requested that if the continua
tion were granted that Mr.Lyngholm name his proposed witnesses
and be limited only to those witnesses in presenting his case at
the continuation.Mr.Lyngholm agreed and named Mr.Jerry Moore
dba Circle Supers,Nicky Kane dba Nicky’s,Mr.and Mrs.Zipperle
dba Sunnyside Knoll,and Craig Meusel dba The Homestead as his
witnesses.Trustee H.Bernerd Dannels then moved the request
for a continuance be denied and the hearing proceed immediately.
Trustee Burgess seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes’Trustees II.

Sutter,N.T.Petrocine,Robert E.Wagner.Those voting “No’none.

The public hearing continued and Odd Lyngholm,Virginia Zipperle
dba Sunnyside Knoll,and Fred Fatino dba Estes Cottage Inn spoke
in favor of the Retail Liquor Store license application.Mr.
Ronald Strahle,attorney representing the opponents,presented
their case and Michael Rambeau dba Rocky Mountain Discount Liquors,
Eric Ilender dba Estes Park Liquor,Art Hill,and Roy harris appeared
as witnesses opposing the liquor application.Mr.Strahle also
submitted eleven petitions opposing the license which were accepted
by the Board and marked ‘Exhibit #1 (11 attachments)September 27,
1977”.Mr.Don Heinemann dba Park—O—Tel Motel also spoke in op
position.
Odd Lyngholm then rebutted the opponents’evidence and Mr.Strahle
ended the opponents’presentation with a closing statement.Mayor
Harry B.Tregent declared the hearing closed.
Trustee Robert E.Wagner moved the Board of Trustees finds that
the Retail Liquor Store licenses already granted in this locality

The Board of Appeals considered a variance request submitted by
John E.Schwery to allow a spiral staircase with a 9”rise within
his residence at 720 Black Canyon Drive.Standard spiral stair
cases are constructed with a 9”rise according to the 1976 U.B.C.
but the 1973 U.B.C.adopted by the Town of Estes Park only allows
an 8”rise.Building Inspector Dave Cooper recommended the variance
be granted and that the Board of Trustees consider adopting the
1976 U.B.C.at a future date.Trustee Robert E.Wagner moved the
variance be granted.Trustee Burgess seconded the motion.Upon
roll call the motion unanimously carried.
There being no further business,the meeting adjourned.
