Trustee Rollen Sutter,Chairman of the Water Committee,read the minutes of a meeting held April 14,1977 and moved the minutes be approved.Trustee flannels seconded the motion.Upon roll call the motion unanimously carried. Trustee Margaret Houston introduced the following resolution and moved it be passed and adopted: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: WhEREAS,tEe Town of Estes Park has determined that all water users both within and without the corporate limits must be metered by May 1,1977;and WhEREAS,it is apparent some water customers will not have accomplished the necessary metering by this date; THEREFORE,the Board of Trustees of the Town of Estes °ark, Colorado,determines the following: 1.The Town of Estes Park Water Department max’at its discretion meter these customers and charge for and collect these costs in the regular manner. 2.The Town of Estes Park Water Department may elect to discontinue water service to those customers not metered by June 1,1977. Meeting called to order by Mayor Present:Mayor Trustees, Also Present; Absent: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: WHEREAS,the residential water metering program becomes effective June 1,1977;and WHEREAS,the present flat rate water customers have paid their accounts to June 30,1977;and WHEREAS,the Town of Estes Park Water Department will be required to make small adjustments in water customers’bills because of the difference in time periods for flat rate cus tomers and metered customers and also small variations in actual meter reading dates: NOW T1REFORE,the Town of Estes Park Water Department shall use the June 1st and October 1st meter reading dates as are now required in the Municipal Code and adjust former flat rate customers to this period. Trustee Sutter seconded the motion.Upon roll call the motion passed by the foliwoing votes:Those voting “Yes”Trustees H. Mayor Harry B.Tregent conducted a public hearing on the proposed rezoning of 201 E.Riverside Drive from the existing R—2 Multiple Family Residential to C—i Commercial.Roy Ring,petitioner,spoke in favor of the request.There were no persons present speaking in opposition and no correspondence was received.Mayor Harry B. Tregent declared the hearing closed. Trustee Robert E.Wagner introduced and the Clerk read in full the following entitled ordinance,and Trustee Wagner moved the ordinance be passed on first reading: AN ORDINANCE AMENDING CHAPTERS 17.24 AND 17.32 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO,RELATING TO THE REZONING OV A PORTION OF LOT 29,RIVERS1DE SUBDIVISION,TOWN OF ESTES PARK,COLORADO. Trustee Sutter seconded the motion.Upon roll call the motion passed by the following votes:Those voting “Yes”Trustees N. T.Petrocine,Rollen Sutter,Margaret Houston,Robert E.Wagner, H.Bernerd Dannels.Those voting “No”none. Special Review Request #12 was submitted by Roy L.and Judy A. Ring to allow a residential use at 201 East Riverside Drive which is being rezoned to C—i Commercial.Trustee H.Bernerd Dannels moved that Special Review Request #12 be approved. Trustee Houston seconded the motion and upon roll call the motion unanimously carried. The final plat of Prospect Village Subdivision was submitted to the Board of Trustees for its consideration.Trustee Robert E. Wagner moved the final plat be approved.Trustee Petrocine seconded the motion.Upon roll call the motion unanimously carried. Meeting coiled to order by Mayor Present:Mayor Trustees: Also Present; Absent: dba Lions Club Concession Stand at Stanley Park is April 26, 1977 and it is hereby ordered that a public hearing on said application shall be held in the Board Room at the Municipal Building,170 MacGregor Avenue,on June 7,1977 at 7:30 p.m., and that the neighborhood boundaries for the purpose of said application and hearing shall be the area included within a radius of 3.33 miles as measured from the center of the appli cant’s property. The Town Clerk presented an application for a change in owner ship of a Hotel/Restaurant liquor license from Erika Downing to The Surrey Restaurants,Inc.dba La Casa Del Estorito. Trustee N.T.Petrocine moved the change of ownership be granted. Trustee Sutter seconded the motion and upon roll call the motion unanimously carried. Trustee Rollen Sutter,Chairman of the Board of Adjustment,read the minutes of a meeting held April 21,1977. The following asphalt paving bids were received for the 1977 street improvements: Flatiron Paving Company ....$38,606.20 Sterling $26,736.80 Best—Way Paving Company ....$25,473.90* *The original bid was reduced by $664 because it included an additional 40 tons of 2”mat that are unnecessary. The following bids were received for the construction of a re taining wall just south of the Public Works Shop building: Pinson Concrete ....°5/cu.yd. $88.90,Tom’s Concrete ‘Cu.yd. A total of 70 to 85 cubic yards of material is estimated for the project. Trustee H.Bernerd Dannels introduced the following resolution and moved it be passed and adopted: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: That the Mayor and Town Clerk are hereby authorized and directed to sign a contractual agreement by and between the Town of Estes Park and Tom’s Concrete regarding the construction of a retaining wall for the Public Works Shop upon final approval of the contract by the Town Attorney. Trustee Wagner seconded the motion.Upon roll call the motion passed by the following votes:Those voting “Yes”Trustees N. T.Petrocine,Rollen Sutter,Margaret Houston,H.Bernerd Dannels, Robert E.Wagner.Those voting “No”none. Robert Young,representing Metry Wood,Inc.,withdrew the driveway permit application for Lot 2,Lake View Tracts,in order to resub mit it at a later time. A letter was received from the Colorado Municipal League inquiring as to whether or not the Town of Estes Park would like to partici pate through the League in opposing the Public Service Company’s rate increase application.Merle Abrams of Public Service Company in Estes Park commented on the need for the increase and recommended the Town not participate in the opposition.Trustee N.T.Petrocine moved the Town forward to the Colorado Municipal League its desire to oppose Public Service Company’s rate increase.Trustee Dannels seconded the motion.Upon roll call the motion was defeated by the following votes:Those voting “Yes”Trustees N.T.Petrocine, H.Bernerd Dannels.Those voting ‘No”Trustees Rollen Sutter, Robert E.Wagner,Margaret Houston. The Town Clerk read aloud two letters addressed to Chief of Police Robert Ault dated April 4,1977 and Finance Officer Lloyd Duncan dated April 12,1977 from the International Brotherhood of Police Officers (IBPO).Trustee Rollen Sutter moved that the Board of Trustees not recognize the International Brotherhood of Police Officers.Trustee Wagner seconded the motion.Upon roll call the motion unanimously carried. The next Board of Trustees meeting scheduled for May 10,1977 has been rescheduled for May 16th. There being no further business,the meeting was adjourned. Town Administrator and Clerk
