Mayor Harry B.Tregent proceeded to conduct a public hearing on the proposed rezoning of Lot 31,Bonnie Brae Addition from the existing R-l Residential to R—2 Multiple Family Residential zoning district. Dave Pearson appeared speaking in favor of the request and briefly discussed his development plans for the property.No one was present speaking in opposition to the request.Mayor Harry B.Tregent declared the hearing closed. Trustee H.Bernerd Dannels introduced and the Town Clerk read in full the following entitled ordinance and Trustee Dannels moved the ordi nance be passed and adopted on first and final reading: AN ORDINANCE AMENDING SECTIONS 17.20.010 4 AND 17.24.010 14 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO,RELATING TO ZONING. Meeting called to order by Mayor Present:Moyor Trustees: Also Present: Absent: Mayor Harry B.Tregent proceeded to conduct a public hearing on the pro posed rezoning of Tract 20,Fall River Addition from the existing R Residential to R—2 Multiple Family Residential zoning district.Leo Baker spoke in favor of the proposed rezoning.There were no persons present speaking in opposition to the request.Mayor Harry B.Tregent declared the hearing closed.Trustee Rollen Sutter moved the Board direct the Town Attorney to prepare an ordinance to approve the rezoning. Trustee Burgess seconded the motion.Upon roll call the motion was declared a tie by the following votes:Those voting “Yes”Trustees Robert E.Burgess,Rollen Sutter,Robert E.Wagner.Those voting “No” Trustees H.Bernerd Dannels,N.T.Petrocine,Glenn Prosser.Whereupon Mayor Harry B.Tregent cast the deciding “No”vote,therefore,defeating the motion. A petition submitted by Rose C.Snyder requesting a land division of Lots 20 &22,Block 10,Town of Estes Park,was considered by the Board of Trustees.Trustee Robert E.Wagner moved the request be granted. Trustee Prosser seconded the motion.Upon roll call the motion unani mously carried. Trustee H.Bernerd Dannels,Chairman of the Public Works Committee,read the minutes of a meeting held November 13,1975,and moved the minutes be approved.Trustee Prosser seconded the motion.Upon roll call the motion unanimously carried. Trustee N.T.Petrocine introduced the following resolution and moved it be passed and adopted: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: That the Mayor and Town Clerk are hereby authorized and directed to sign the lease agreement between the Town of Estes Park and the Estes Park Area Chamber of Commerce for the Tourist Information Center. Meeting called to order by Mayor Present:Mayor Trustees, Also Present: Absent: Trustee Robert E.Wagner introduced the following resolution and moved it be passed and adopted: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: That Ernest G.Hartwell,Town Attorney,and Colton W.Babcock,Jr.Assistant Town Attorney,be and they are hereby authorized and directed on behalf of the Town of Estes Park, Colorado,to enter their appearance and take all necessary action to defend the Defendant,Town of Estes Park,Colorado,in the case of Walter McC.Maitland,et al.vs.Escape Properties Ltd., et al.,Civil Action No.28448 in the District Court in and for the County of Larimer,State of Colorado. A request was brought before the Board of Trustees to allow nursing homes in a C-2 Restricted Commercial zoning district.Mr.Elmer Ogren spoke favorably of a nursing home as a permitted use in a C—2 zone.Town Engineer/Planner Van Horn explained that the current Municipal Code does not state nursing homes as a permitted use in any zone and recommended that it be permitted in a C-2 Restricted Commercial District under special review.Trustee Presser moved that nursing homes be permitted in all zones,excepting DR Developing Resource District,under special review.Trustee Wagner seconded the motion.Upon roll call the motion unanimously carried. Meeling called to order by Mayor Present:Mayor Trustees: Also Present: Absent: Trustee Robert E.Burgess,Chairman of the Public Safety Committee,read the minutes of a meeting held November 24,1975 and moved the minutes be approved.Trustee Petrocine seconded the motion.Upon roll call the motion unanimously carried. Trustee Rollen Sutter,Chairman of the Board of Adjustment,read the minutes of a meeting held November 24,1975. A request to amend Chapter 9.60 of the Municipal Code to permit a carillon was brought before the Board.James Durwood spoke favorably of the amend ment stating that he had received many favorable comments and attitudes towards his installing a carillon.The Board of Trustees directed the Staff to proceed with amending Chapter 9.60 of the Municipal Code in order to allow a carillon yet to maintain the original intent of the Chapter, and to allow this particular use under special review in all zones ex cluding the DR Developing Resource District. A letter was received from the Rocky Mountain Metropolitan Recreation District informing the Board of Trustees that it will exercise its option to extend the lease between the Rocky Mountain Metropolitan Recreation District and the Estes Park Golf and Country Club. Trustee Rollen Sutter moved the following appointment be made to the Estes Park Library Board: Ruth Montgomery Trustee Wagner seconded the motion.Upon roll call the motion unanimously carried. A letter was received from Bob Cheney requesting the use of the parking lot across from the Chamber of Commerce building (Parking Lot #2)for the Boy Scout Christmas Tree sale from November 30,1975 to December 24, 1975.Trustee N.T.Petrocine moved the request be granted.Trustee Prosser seconded the motion.Upon roll call the motion unanimously carried.
