Present:Mayor Harry B.Tregent Trustees:Robert E.Burgess,Glenn Prosser,N.T.Petrocine, H.Bernerd Dannels,Rollen Sutter,Robert E.Wagner Also Present:Town Administrator Dale G.Hill Absent:None Minutes of the regular meeting held September 23,1975 and the special meeting held September 26,1975 were read and approved as read. Trustee Glenn Prosser moved the following bills be allowed and paid and the Clerk be authorized to draw warrants for same.(A Certified copy of the bills read and allowed are on file in the office of the Town Clerk under this date and made a part of the record of these proceedings by reference thereto.)Trustee Wagner seconded the motion.Upon roll call the motion passed by the following votes:Those voting “Yes”Trustees Robert E.Burgess, H.Bernerd Dannels,Glenn Prosser,N.T.Petrocine,Rollen Sutter, Robert E.Wagner.Those voting “No”none. The Board of Trustees proceeded to conduct a public hearing re garding the proposed 1976 budget for the Town of Estes Park. There were no persons present to speak in favor of or in opposi tion to the budget.Mayor Harry B.Tregent declared the hearing closed. Trustee Robert E.Wagner introduced and the Town Clerk read in full the following entitled ordinance and Trustee Wagner moved it be passed on second and final reading: AN ORDINANCE ADOPTING THE BUDGET FOR THE TOWN OF ESTES PARK,COLORADO,FOR THE FISCAL YEAR BEGINNING ON THE 1ST DAY OF JANUARY,1976,AND ENDING ON THE LAST DAY OF DECEMBER,1976.ESTI MATING THE AMOUNT OF MONEY NECESSARY TO BE RAISED BY TAX LEVY BASED ON THE SAID BUDGET SO ADOPTED; ESTIMATING THE AMOUNT OF MONEY TO BE DERIVED FROM OTHER REVENUE SOURCES;AND SETTING FORTH THE TOTAL ESTIMATED EXPENDITURES FOR EACH FUND. Trustee Sutter seconded the motion.Upon roll call the motion passed by the following votes:Those voting “Yes”Trustees H. Bernerd Dannels,Robert E.Burgess,Glenn Prosser,N.T.Petro— cine,Rollen Sutter,Robert E.Wagner.Those voting “No”none. Trustee Rollén Sutter introduced and the Town Clerk read in full the following entitled ordinance and Trustee Sutter moved it be passed on second and final reading: AN ORDINANCE LEVYING TAXES FOR THE YEAR 1976,TO DEFRAY THE COST OF MUNICIPAL GOVERNMENT OF ESTES PARK,COLORADO.FOR THE FISCAL YEAR BEGINNING JANUARY 1,1976,AND ENDING DECEMBER 31,1976. Trustee Dannels seconded the motion.Upon roll call the motion passed by the following votes:Those voting “Yes”Trustees H. Trustee H.Bernerd Dannels introduced the following resolution and moved it be approved: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: That the Mayor and Town Clerk are hereby authorized fl and directed to sign the Contract by and between the Town of Estes Park and Professional Design Builders,Inc.re garding construction of Public Rest Rooms in parking lot #4 and the Tourist Information Center. Leonard Murphy appeared before the Board on behalf of Barbara Murphy,Lucille Younglund,Quentin Younglund and himself to re quest a curb cut from Highway 7 onto Lot 3,DeVille Subdivision. Seymour Graham also appeared in favor of the request.Conflicting information was received from the Colorado State Division of High ways,and,therefore,the request was tabled for further discussion with the Highway Department and further investigation into various alternatives to the proposed curb cut. Trustee Rollen Sutter,Chairman of the Board of Adjustment,read the minutes of a meeting held October 6,1975. Trustee N.T.Petrocine,Chairman of the Light &Power Committee, read the minutes of a meeting held October 7,1975 and moved the minutes be approved.Trustee Wagner seconded the motion.Upon roll call the motion unanimously carried. Trustee N.1’.Petrocine introduced and the Town Clerk read in full the following entitled ordinance and Trustee Petrocine moved the ordinance be passed andadopted on first and final reading: AN ORDINANCE AMENDING SECTIONS 13.12.010,13.12.020C, 13.12.030 C,13.12.040 C,13.12.050 C AND D,l3.12.060 C AND D,13.12.070 B AND D,13.12.080 C AND D,AND 13.12.090 C OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO,RELATING TO LIGHT AND POWER RATE SCHE DULES CONTAINING CHARGES FOR THE SERVICE OF ELECTRIC POWER AND ENERGY BY THE LIGHT AND POWER DEPARTMENT OF THE TOWN OF ESTES PARK,COLORADO. An announcement was made of a Colorado Municipal League District #2 annual meeting to be held on October 24,1975 at the Hewlett- Packard facility in Loveland. Meeting called to order by Mayor Present:Mayor Trustees: Also Present: Absenh Miss Helen A.Lindell submitted a request to the Board of Appeals for a variance in rail height for her new house and appeared before the Board stating her reasons for the exception to the required 42” height.Trustee N.T.Petrocine moved that the variance be granted. Trustee Wagner seconded the motion.Upon roll call the motion passed by the following votes:Those voting “Yes”Trustees H. Bernerd Dannels,N.T.Petrocine,Rollen Sutter,Robert E.Wagner.
