Minutes of the regular meeting held June 10,1975 were read and
approved as read.
April chapman,representing the Estes Park Jaycettes,appeared
before the Board of Trustees requesting the use of Bond Park or
the Dark Horse Parking Lot on September 20,1975 for the annual
“Flea Market”.Trustee Glenn Prosser moved the use of Bond Park on
September 20,1975 for the Estes Park Jaycettes “Flea Market”
be approved.Trustee Sutter seconded the motion.Upon roll call
the motion unanimously carried.
Trustee N.T.Petrocine introduced and the clerk read in full the
following entitled ordinance,and Trustee Petrocine moved the
ordinance be passed on first and final reading:
AN ORDINANCE AMENDING SECTION 9.62.010 OF
THE MUNICIPAL CODE OF THE TOWN OF ESTES
PARK,COLORADO,RELATING TO SOLICITING
BUSINESS ON STREETS.
Trustee Dannels seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Trustees
Burgess,Dannels,Petrocine,Prosser,Sutter,Wagner.Those
voting “No”none.Whereupon Mayor Harry B.Tregent declared
said ordinance duly passed and adopted and ordered it numbered
16—75 and published according to law.
Town Administrator Hill explained to the Board of Trustees the
necessary zoning changes that will be required upon final approval
of the ordinance allowing the operation of mobile broadcast vans.
Bob Gaines of KSIR appeared before the Board to request an exten
sion of approval to operate the KSIR mobile radio van.Trustee
N.T.Petrocine moved the extension be granted until July 22,1975.
Trustee Wagner seconded the motion.Upon roll call the motion
unanimously carried.
The Town Clerk presented an application for a change in ownership
of a Beer,Wine and Liquor License from H.Schroeder to a Partnership
of charles Baumhover,Mary Lou Baumhover,and Donald C.Willette
of the Edel Haus Restaurant.Three letters of character reference,
a letter of recommendation from Police Chief Robert W.Ault,a
copy of the partnership agreement and lease were submitted to the
Board.Trustee Robert E.Wagner moved the Board of Trustees grant
the change of ownership of the liquor license.Trustee Sutter
seconded the motion.Upon roll call the motion unanimously carried.
Trustee H.Bernerd Dannels,Chairman of the Public Works committee,
read the minutes of a meeting held June 12,1975,and moved the
minutes be approved.Trustee Prosser seconded the motion.Upon
roll call the motion unanimously carried.

Trustee Robert E.Wagner introduced and the Clerk read in full the
following entitled ordinance,and Trustee Wagner moved the ordinance
be passed on first and final reading:
AN ORDINANCE AMENDING SECTION 9.64 OF THE
MUNICIPAL CODE OF THE TOWN OF ESTES PARK,
COLORADO,RELATING TO OBSTRUCTION AND USE
OF SIDEWALKS.
Trustee Petrocine seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Trustees
Burgess,Dannels,Petrocine,Prosser,Sutter,Wagner.Those
voting ‘No”none.Whereupon Mayor Harry B.Tregent declared said
ordinance duly passed and adopted and ordered it numbered 17—7 5
and published according to law.
Trustee Glenn Prosser,Chairman of the Estes Park Planning
Commission read the minutes of a meeting held June 17,1975.
Trustee Robert E.Wagner introduced and the Clerk read in full
the following entitled ordinance,and Trustee Wagner moved the
ordinance be passed on first and final reading:
AN ORDINANCE AMENDING SECTION 16.16.130
OF THE MUNICIPAL CODE OF THE TOWN OF
ESTES PARK,COLORADO,RELATING TO DESIGN
STANDARDS AS THEY PERTAIN TO LOTS.
Trustee Burgess seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Trustees
Burgess,Dannels,Petrocine,Prosser,Sutter,Wagner.Those
voting “No”none.Whereupon Mayor Harry B.Tregent declared
said ordinance duly passed and adopted and ordered it numbered
18—75 and published according to law.
The Clerk read a Petition for Annexation of an unincorporated
territory located in Section 24,Township 5 North,Range 73
West of the 6th P.M.,known as the Black Canyon Hills Addition;
said petition being submitted by Maurice R.Thompson,Quentin
E.Youngland,Paul H.Van Horn,Melvin L.Wolf,and Billy G.
Fogleman.
Trustee Robert E.Burgess introduced the following resolution
and moved it be passed and adopted:

Colorado,finds and determines that the annexation petition
filed by petitioners Maurice’R.Thompson,Quentin E.Young-
land,Paul H.Van Horn,Melvin L.Wolf and Billy G.Fogleman
On April 15,,1975,with the Town Clerk of the Town
of Estes Park,Colorado,for the annexation of certain land
described in said petition,is in substantial compliance with
the reguirements of section 31—8—107(1),C.R.S.1973;is
eligible to be annexed because there is at least one-sixth
(1/6)contiguity between the municipality and the area seek
ing annexation;and at least two (2)of the following con
ditions exist:
1.More than fifty percent C50%)of the adult resi
dents of the area proposed to be annexed use some of the
recreation,civic,social,religious,industrial or conuner—
cial facilities of the municipality and more than twenty—five
percent (25%)of its adult residents are employed in the
annexing municipality;
2.Less than one-half (1/2)of the land proposed to
be annexed is agricultural,or,if it is agricultural,less
than one—half (1/2)of the landowners of the total area have
expressed an intention under oath to devote the land to such
agricultural use for at least five (5)years;
3.It is practical to extend urban services which
the municipality normally provides.
The Board of Trustees further finds and determines
that said petition has been signed by the owners of one hun
dred percent (100%)of the property proposed to be annexed,
exclusive of streets and alleys;that the requirements of

The applicable parts of sections 31—8—104 and 31—8—105,
C.R.S.1973,have been met;that an election is not re
quired under section 31—8—107(2),C.R.S.1973;and that
no additional terms and conditions are to be imposed upon
said annexation.
Having found that the property described in said
petition is eligible to become annexed,the Board of Trustees
of the Town of Estes Park,Colorado,will undertake further
annexation proceedings.
Trustee Sutter seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Trustees
Burgess,Dannels,Petrocine,Prosser,Sutter,Wagner.Those
voting “No”none.
Trustee Glenn Prosser introduced and the Clerk read in full the
following entitled ordinance,and Trustee Prosser moved the
ordinance be passed on first and final reading upon payment
of proper fees:
AN ORDINANCE APPROVING THE ANNEXATION OF
CERTAIN TERRITORY TO THE TOWN OF ESTES
PARK,COLORADO,TO BE KNOWN AND DESIGNATED
AS “BLACK CANYON HILLS ADDITION”TO THE
TOWN OF ESTES PARK,COLORADO.
Trustee Wagner seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Trustees
Burgess,Dannels,Petrocine,Prosser,Sutter,Wagner.Those
voting “No”none.Whereupon Mayor Harry B.Tregent declared
said ordinance duly passed and adopted and ordered it numbered
19—75 and published according to law.
Mayor Harry B.Tregent proceeded to conduct a public hearing on
the proposed zoning ordinance regarding the Black Canyon Hills
Addition.Paul Van Horn appeared before the Board explaining
reasons for the zoning request.Paul Van Horn stated that E—l
Estate was desired but one lot was less than the one acre
minimum and,therefore,R Residential is requested with an
accompanying covenant preventing further dividing of present
lot areas.There were no persons present speaking in opposition.
Mayor Harry B.Tregent declared the hearing closed.

Town Administrator Hill presented the Board with a Geology Report
prepared by Hogan &Olhausen,P.C.Trustee Robert B.Wagner
moved the Board finds that the property proposed to be rezoned
does not contain “commercial mineral deposits.”Trustee Dannels
seconded the motion.Upon roll call the motion passed by the
following votes:Those voting “Yes”Trustees Burgess,Dannels,
Petrocine,Prosser,Sutter,Wagner.Those voting “No”none.
Trustee Robert B.Wagner introduced and the Clerk read in full
the following entitled ordinance and Trustee Wagner moved the
ordinanc be passed on first and final reading:
AN ORDINANCE AMENDING SECTION 17.16.010
OF THE MUNICIPAL CODE OF THE TOWN OF
ESTES PARK,COLORADO,RELATING TO THE
ZONING OF BLACK CANYON HILLS ADDITION.
Trustee Prosser seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Trustees
Burgess,Dannels,Petrocine,Prosser,Sutter,Wagner.Those
voting “No”none.Whereupon Mayor Harry B.Tregent declared
said ordinance duly passed and adopted and ordered it numbered
20-75 and published according to law.
A request was filed by Carl Vogel to divide a parcel of property
located in Community Addition on Fish Creek Road.Trustee H.
Bernerd Dannels moved the request be denied.Trustee Burgess
seconded the motion.Upon roll call the motion unanimously carried.
Mayor Harry B.Tregent proceeded to conduct a public hearing
on the proposed rezoning of a parcel of land on Fish Creek road
from the existing C—2 Restricted Commercial to R—l Residential.
Glenn Prosser spoke in favor of the rezoning.Paul Van Horn
appeared speaking in opposition.No correspondence was received
either in favor of or in opposition.Mayor Tregent declared
the hearing closed.Trustee N.T.Petrocine moved the request
be denied.Trustee Dannels seconded the motion.Upon roll
call the motion passed by the following votes:Those voting
“Yes”Trustees Dannels,Petrocine,Sutter,Wagner.Those voting
“No”Trustees Burgess,Prosser.
Mayor Harry B.Tregent proceeded to conduct a public hearing
on the proposed rezoning of a parcel of land in Sunny Acres
Addition from the existing R-3 Trailer Court District to R-2
Multiple Family Residential District.No one was present to
speak in favor of the rezoning.Felix Taucher,Dana Taucher,
and Mrs.Chatfield spoke in opposition.Mayor Harry B.Tregent
declared the hearing closed.Discussion followed as to the
reasons for the rezoning request,the purpose of a P.U.D.,and
the advantages and disadvantages of a P.U.D.It was then
decided by the Board of Trustees to take no action at this time.

Mayor Harry B.Tregent proceeded to conduct a public hearing
on the proposed rezoning of Out Lot 1,Country Club Manor from
the existing R-2 Multiple Family Residential District to C—l
Commercial District.There were no persons present speaking
either in favor of or in opposition to the amendment.Mayor
Tregent declared the hearing closed.Trustee Robert E.Wagner
moved the Board direct the Town Attorney to prepare an ordinance
to approve the rezoning.Trustee Dannels seconded the motion.
Upon roll call the motion unanimously carried.
Trustee Glenn Prosser introduced the following resolution and
moved it be approved:
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF
ESTES PARK,COLORADO:
That the Town Administrator be appointed to prepare the
budget for 1976.
Trustee Sutter seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Trustees
Burgess,Dannels,Petrocine,Prosser,Sutter,Wagner.Those
voting “No”none.
Trustee Glenn Prosser introduced the following resolution and
moved it be approved:
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF
ESTES PARK,COLORADO:
That the authorization granted by the Board of Trustees
on June 10,1975 regarding the agreement with the Northern
Colorado Water Conservancy District is hereby rescinded and
that the amended agreement between the Town of Estes Park and
the Northern Colorado Water Conservancy District is approved
and the Mayor and Clerk are authorized and directed to sign
this agreement.
Trustee Wagner seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Trustees
Burgess,Dannels,Petrocine,Prosser,Sutter,Wagner.Those
voting “No”none.
Town Administrator Hill read aloud a letter received from
Director of Public Works Van Horn reporting two cases of sub
division ordinance violations.In order to enforce the municipal

and moved it be approved:
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF
ESTES PARK,COLORADO:
That Ernest C.Hartwell,Town Attorney,Colton W.Babcock,
Jr.,Assistant Town Attorney,and Gregory A.White,Assistant
Town Attorney,be and hereby are authorized and directed on behalf
of the Town of Estes Park,Colorado to take whatever legal action
necessary to enforce the Municipal Code in regard to the apparent
violations of Frank Williams,Tract 80,Fall River Addition and
Carl Vogel,Fish Creek Road,Community Addition.
Trustee Burgess seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Trustees
Burgess,Dannels,Petrocine,Prosser,Sutter,Wagner.Those
voting “No”none.
Town Administrator Hill and Director of Public Works Van Horn
discussed with the Board of Trustees a prior meeting with
representatives of the Upper Thompson Sanitation District in
which the Sanitation District requested the Town of Estes Park’s
participation in the repair of East Riverside Drive.Van Horn
pointed out three options available to the Town concerning this
request:(1)Nonparticipation on the part of the Town in which
the Sanitation District would perform the required patching;
(2)participation of the Town to overlay patch work performed
by the UTSD with a 1”mat costing the Town $4170;or (3)combined
effort of the Town of Estes Park and the Upper Thompson Sanitation
District to overlay the road with a 2”mat costing the Town $4170.
Trustee Wagner moved the Town join in a combined effort with the
Upper Thompson Sanitation District to repair East Riverside Drive
by overlaying it with a 2”mat.Trustee Sutter seconded the motion.
Upon roll call the motion unanimously carried.
There being no further business,it was regularly moved,seconded
and carried the meeting adjourn./
