Wagner Also Present:Town Administrator Dale G.Hill Town Attorney Ernest G.Hartwell Town Engineer/Planner Van Horn Absent:Trustees Robert E.Burgess &H.Bernerd flannels Minutes of a regular meeting held on January 14,1974,were read and approved as read. Trustee Glenn Prosser,Chairman of the Estes Park Planning Commission,read the minutes of the meeting held on January 15,1974. The Clerk read in full,the petition for annexation signed by Lynn W.and Dorothy N.Kinnie.An original and four copies of the proposed annexation map was sub mitted to the Board. Attorney Joseph P.Jenkins represented Mr.and Mrs.Kinnie and spoke to the Board of Trustees regarding the proposed annexation. Town Attorney,Ernest G.Hartwell,informed the Board that the petition was in compliance with the law,and that the plat had minor changes that could be made prior to the final action of the annexation.Attorney Hartwell had questions on the plat which dwelt with the Power of Attorney and the proper location of the signature of the lienholder,Mr.James P.Johnson.Mr.Hartwell also pointed out the need to annex the abutting streets. Trustee Petrocine introduced the following resolution and moved it be passed and adopted. RESOLUTION BE IT RESOLVED BY TIE BOARD OF TRUSTEES OF TIE TOWN OF ESTES PARK, COLORADO: That the Board of Trustees of the Town of Estes Park,Colorado,does not desire to annex the territory described in the petition filed by the petitioners,Lynn W.Kinnie and Dorothy N.Kinnie,on January 18,1974, and will undertake no further annexation proceeding pertaining thereto. Trustee Glenn Prosser seconded the motion.Upon roll call the motion passed by the following votes.Those voting “Yes”Trustees N.T.Petrocine,Glenn Prosser,Rollen Sutter,Robert B.Wagner.Those voting “No”none. The Board of Trustees proceeded to conduct a public hearing regarding the proposed amendments to Chapter 17 of the Municipal Code of the Town of Estes Park. Engineer/Planner Van Horn spoke in favor of the proposed ordinance.There were no persons present speaking in opposition.Mayor Harry B.Tregent declared the hearing closed. tEnhut at !stes }nrh,Lorimer County,Colorado.19. Meeting called to order by Mayor Present:Mayor Trustees: Also Present: Absent: Trustee Robert E.Wagner introduced and the Town Clerk read in full,the following entitled ordinance,and Trustee Wagner moved it be passed on first reading: AN ORDINANCE ANENDING CHAPTERS 17.08,17.16,17.20,17.24, 17.28 and 17.40 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COlORADO,RElATING TO ZONING DEFINITIONS,PERMITTED USES,DWELLING AREA,lOT AREA PER FAMILY AND MINIMUM lOT WIDTH. Trustee Glenn Prosser seconded the motion.Upon roll call the motion passed by the following votes.Those voting “Yes”Trustees Glenn Prosser,Rollen Sutter, Robert E.Wagner,N.T.Petrocine.Those voting “No”none.Whereupon Mayor Harry B.Tregent declared said ordinance duly passed on first reading. The Town Clerk submitted a petition for an exception to the provisions of Chapter 16 of the Municipal Code of the Town of Estes Park in regards to Lot Divisions.This petition requested that the existing Lots 29,30 and the East 100 feet of Lot 11,University Heights subdivision,be amended by dividing the above described property into two lots;namely Lots 1 and 2, Sanders Addition. Trustee Robert E.Wagner moved the petition for exception be granted.Trustee Glenn Prosser seconded the motion.Upon roll call the motion was passed by the following votes.Those voting “Yes”Trustees Rollen Sutter,Robert E.Wagner, N.T.Petrocine,Glenn Prosser.Those voting “No”none. Trustee Glenn Prosser introduced and the Town Clerk read in full,the following entitled ordinance,and Trustee Prosser moved it be passed on first reading: AN ORDINANCE AMENDING CHAPTER 16.12 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COlORADO,RElATING TO SUBDIVISION AND ANNEXATIONS -THEIR ADMINISTRATION AND ENFORCEMENT. Trustee N.T.Petrocine seconded the motion.Upon roll call the motion passed by the following votes.Those voting “Yes”Trustees Robert E.Wagner,N.T. Petrocine,Glenn Prosser,Rollen Sutter.Those voting “No”none.Whereupon Mayor Harry B.Tregent declared said ordinance duly passed on first reading. Trustee Robert E.Wagner introduced and the Town Clerk read in full,the following entitled ordinance,and Trustee Wagner moved it be passed on U first reading AN ORDINANCE AMENDING SECTION 3.08.230 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COlORADO,RELATING TO SALES TAX AND SCHEDUlE FOR COLlECTION THEREOF. Trustee Rollen Sutter seconded the motion.Upon roll call the motion unanimously carried. Trustee Rollen Sutter introduced and the Town Clerk read in full,the following entitled ordinance,and Trustee Sutter moved it be passed on first reading: AN ORDINANCE AMENDING CHAPTER 13.32 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COlORADO,RELATING 10 WATER RATES AND CHARGES. Trustee Robert E.Wagner seconded the motion.Upon roll call the motion passed by the following votes.Those voting “Yes”Trustees Glenn Prosser, Rollen Sutter,Robert E.Wagner,N.T.Petrocine.Those voting “No”none. Whereupon Mayor Harry B.Tregent declared said ordinance duly passed on first reading. A petition dated January 28,1974,from the Park Hospital District requesting certain street improvements near the proposed hospital was presented to the Board of Trustees.There appears to be some question as to the right—of—way for a portion of the proposed street.Mayor Barry B.Tregent referred the matter to the Public Works Conunittee for recounnendation. Trustee Glenn Prosser read the minutes of the Public Works Committee held on January 17,1974,and moved that the minutes be approved and adopted with the following amendments: 1)That on the bottom of page 1,item 2),the words “No refresh ments”be stricken from the minutes;and 2)That in regards to the Upper Thompson Sanitation District’s Construction Program,the four month period is to be changed to read “the four months beginning October 15th.” Trustee N.T.Petrocine seconded the motion.Upon roll call the motion unanimously carried. Trustee N.T.Petrocine,Chairman of the Administrative Conunittee,read the minutes of the meeting held on January 24,1974,and moved that the minutes be approved and adopted.Trustee Robert E.Wagner seconded the motion.Upon roll call the motion unanimously carried.
