Mayor Harry B.Tregent proceeded to conduct a public hearing regarding the application for a 3.2%Fermented Malt Beverage (beer) License submitted by I &A Inc.,dba Super Food Market,350 West Riverside Drive,Estes Park,Colorado.Attorney Henry F.Pedersen appeared before the Board representing the applicants and spoke in favor of the application.Mr.James Swickard,owner of the property,appeared and told the Board he would furnish the Town Administrator with a copy of the assignment of the original lease. The Clerk submitted and read letters of reference on the applicants Cimpl,Sims and the Duncans and informed the Board of two tele phone calls of reference on the Duncans. There were no persons present4peaking in opposition and the Clerk reported no correspondence had been received in opposition to the application. Mayor Tregent declared the hearing closed.Trustee Robert E.Burgess moved the Board of Trustees finds that the reasonable requirements of the neighborhood are such that a 3.2%Fermented Malt Beverage license should be granted and that the license is granted.Trustee Glenn Prosser seconded the motion.Upon roll call the motion passed by the following votes.Those voting “Yes”Trustees Robert E.Burgess, H.Bernerd Dannels,N.T.Petrocine,Glenn Prosser,Rollen Sutter and Robert E.Wagner.Those voting “No”none. Trustee Robert E.Wagner moved the liquor license renewal application, submitted by Park Wheel Co.,be approved.Trustee H.Bernerd Dannels seconded the motion.Upon roll call the motion unanimously carried. Trustee Glenn Prosser moved the liquor license application,submitted by Mcconnell &Kelley,Inc.,dba the Range Restaurant,be approved, changing the ownership from a partnership to a corporation.TrusteeRobertF.Wagner seconded the motion.Upon roll call the motionunanimouslycarried. Mayor Harry B.Tregent informed the Board and members of the audience of his intention to send the 5th Revised Sign Code proposal to the Town’s Attorney,Ernest Hartwell,for legal corrections and revisions. Meeting called to order by Mayor Present:Mayor Trustees: Also Present: Absent: The following persons appeared speaking in opposition: Herb Blessman Doris Herzog Larry Zeilner Gene Brough Lois Schmidt E.R.Smith Fred Efken Chas.Herzoq Mr.Bob Mobus,Vice President of the Chanter of Commerce,appeared thanking the Council and those members of the Planning Commission present for the time spent on the sign code proposals. Mayor Harry B.Tregent proceeded to conduct a public hearing regarding the proposed rezoning of a portion of Lot 34 Bonnie Brae Addition from the existing R—l Residential District to C—2 flRestrictedCommercialDistrict.Mr.Louis Moore appeared before the Board,representing the petitioners,and spoke in favor of the rezoning.There were no persons present speaking in opposition and the Clerk reported no correspondence received either in favor of or in opposition to the rezoning request.Mayor Harry B.Tregent declared the hearing closed.Trustee Glenn Prosser moved the rezoning be approved,and an ordinance be drawn changing the zoning. Trustee H.Bernerd Dannels introduced and the Clerk read in full the following entitled ordinance,and Trustee Dannels moved the ordinance be passed and adopted on first and final reading: AN ORDINANCE AMENDING SECTIONS 16.28.210, 16.28.230,16.36.010,16.36.030,16.36.040, 16.36.050 AND 16.36.140 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO, RELATING TO SUBDIVISIONS AND IMPROVEMENTS THEREIN. Trustee Glenn Prosser seconded the motion.Mr.Paul Van Horn appeared before the Board to speak in opposition to the ordinance. After a short discussion,a vote was taken,and the ordinance was passed by the following votes.Those voting “Yes”Trustees H.Bernerd Dannels,N.T.Petrocine,Glenn Prosser,Rollen Sutter, Robert E.Wagner,Robert E.Burgess.Those voting “No”none. Meeting called to order by Mayor Present:Mayor Trustees, Also Present:- Absent, Trustee H.Bernerd Dannels introduced the following resolution and moved it be passed and adopted: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: The Board of Trustees of the Town of Estes Park,Colorado, finds and determines that the annexation petition filed by petitioners Lynn W.Kinnie and Dorothy M.Kinnie on November 8,1974,with the Town Clerk of the Town of Estes Park,Colorado,for the annexation of cer tain land described in said petition,is in substantial compliance with the requirements of Subsection (1)of Section 139—21—6 of CR5 1963,as amended;is eligible to be annexed because there is at least one—sixth (1/6)contiguity between the municipality and the area seeking annexation;and at least two (2)of the following con ditions exist: 1.More than fifty percent (50%)of the adult residents of the area proposed to be annexed use some of the recreation,civic,social, religious,industrial or commercial facilities of the municipality and more than twenty—five percent (25%)of its adult residents are employed in the annexing municipality; 2.Less than one-half (1/2)of the land proposed to be annexed is agricultural,or,if it is agricultural,less than one— half (1/2)of the landowners of the total area have expressed an intention under oath to devote the land to such agricultural use for at least five (5)years; 3.It is practical to extend urban services which the munici pality normally provides. The Board of Trustees further finds and determines that said petition has been signed by the owners of one hundred percent (100%) of the property proposed to be annexed,exclusive of streets and alleys;that the requirements of the applicable parts of Sections 3 and 4 of Article 21,Chapter 139,CR5 1963,as amended,have been met;that an election is not required under Section 6(2)of said Article 21;and that no additional terms and conditions are to be imposed upon said annexation. Having found that the property described in said petition is eligible to become annexed,the Board of Trustees of the Town of Estes Park,Colorado,will undertake further annexation proceedings. AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN TERRITORY TO THE TOWN OF ESTES PARK,COLORADO,TO BE KNOWN AND DESIGNATED AS “KINNIE ADDITION”TO THE TOWN OF ESTES PARK,COLORADO. Trustee Robert E.Wagner introduced the following resolution and moved it be passed and adopted: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: That the Town Administrator Dale G.Hill,be,and he is hereby authorized and directed,to make application under the Urban Planning Assistance Program authorized by Section 701 of the Housing Act of 1954,as amended,for Federal Funds and assistance and for a Federal grant in order to provide the Town of Estes Park with a Comprehensive Master Plan.Be it further resolved that the Town of Estes Park as sponsor has or will have sufficient funds to defray,with the requested grant,the cost of the project.
