Minutes of a regular meeting held on October 14,1974 were read and approved
as read.
Trustee Robert E.Wagner moved that the liquor license renewal application,
submitted by Estes Park Inns,Inc.dba Holiday Inn of Estes Park,be approved.
Trustee H.Bernerd flannels seconded the motion.Upon roll call the motion
unanimously carried.
Trustee Robert E.Burgess moved that the liquor license renewal application,
submitted by Glockenspiel Inc.dba The Clockenspiel Restaurant,be approved.
Trustee Rollen Sutter seconded the motion.Upon roll call the motion unani
mously carried.
Trustee H.Bernerd Dannels moved that the liquor license renewal application,
submitted by E.R.Smith dba Estes Park Liquor,be approved.Trustee Robert
E.Wagner seconded the motion.Upon roll call the motion unanimously carried.
The Clerk read a letter,dated October 15,1974,from Dwight H.Bower,District
Engineer,of the State Department of Highways,advising of a State Highway
Commission session being held in Denver for the purpose of hearing delegations
interested in the highway program for the year July,1975 —June 1976.
Mayor Harry B.Tregent referred the letter to the Public Works Committee,
asking that recommendations be made to the State regarding the construction
on Elkhorn Avenue.
The Clerk submitted a bid from Trail Ridge Ford on a 1969 3/4 ton pickup being
advertised by the Town for sale.Trustee Robert E.Burgess moved the bid
in the amount of $826.00 be rejected.Trustee N.T.Petrocine seconded the
motion.Upon roll call the motion unanimously carried.
Trustee Glenn Prosser,Chairman of the Estes Park Planning Commission,read the
minutes of the Planning Commission meeting held on October 15,1974.
Trustee Robert E.Burgess introduced the following resolution and moved that
it be passed and adopted:
RESOLUTION
WHEREAS,the Town of Estes Park is desirous of developing the Tallant
Addition into an outdoor recreation area;and
WHEREAS,the Town of Estes Park intends to apply for Federal Aid in the
amount of $60,000;and
WHEREAS,the Town of Estes Park has budgeted its matching share of $60,000
for the year 1975;
NOI’4 THEREFOR BE IT RESOLVED,That this Board of Trustees hereby:
Approves the Federal Aid application for the Tallant Park outdoor
recreation area and instructs its staff to file the necessary application
for the project.

passed by the following votes.Those voting “Yes”Trustees Robert E.Burgess,
H.Bernerd Dannels,N.T.Petrocine,Glenn Prosser,Rollen Sutter,Robert E.
Wagner.Those voting “No”none.
Trustee Robert E.Wagner,Chairman of the Advertising and Public Relations
Committee,read the minutes of a meeting held on October 16,1976,and moved
the minutes be approved.Trustee Glenn Prosser seconded the motion.Upon
roll call the motion unanimously carried.
The Clerk read a letter from Darold and Lois Rohrbaugh regarding rising problems
in the Fall River Annexed area.
Trustee H.Bernerd Dannels introduced the following resolution and moved it
be passed and adopted:
RESOLUTION
WHEREAS,certain areas of the Town of Estes Park,Colorado,are subject
to periodic flooding and/or mudslides from streams and rivers,causing serious
damages to properties within these areas;and
WHEREAS,relief is available in the form of Federally subsidized flood
insurance as authorized by the National Flood Insurance Act of 1968;and
WHEREAS,it is the intent of this Board of Trustees to require the
recognition and evaluation of flood and/or mudslide hazards in all official
actions relating to land use in the flood plain and/or mudslide areas having
special flood and/or mudslide hazards;and
WHEREAS,this body has the legal authority to adopt land use and control
measures to reduce future flood losses pursuant to Sections 139—59—7,139—60—1
and 139—60—3,CR5 1963 as amended;
NOW THEREFORE,BE IT RESOLVED,That this Board of Trustees hereby;
1.Assures the Federal Insurance Administration that it will enact as
necessary,and maintain in force for those areas having flood or mudslide
hazards,adequate land use and control measures with effective enforcement
provisions consistent with the Criteria set forth in Section 1910 fo the
National Flood Insurance Program Regulations;and
2.Vests the Town Engineer with the responsibility,authority and means
to;
(a)Delineate or assist the Administrator,at his request,in delinea
ting the limits of the areas having special flood and/or mudslide hazards on
available local maps of sufficient scale to identify the location of building
sites.

(b)Provide such information as the Administrator may request concern
ing present uses and occupancy of the flood plain and/or mudslide area.
(c)Cooperate with Federal,State and local agencies and private
firms which undertake to study,survey,map and identify flood plain or
mudslide areas,and cooperate with neighboring communities with respect to
management of adjoining flood plain and/or mudslide areas in order to pre
vent aggravation of exisiting hazards.
Cd)Submit on the anniversary date of the community’s initial
eligibility an annual report to the Administrator on the progress made
during the past year within the community in the development and implemen
tation of flood plain and/or mudslide area management measures.
3.Appoints the Town Engineer to maintain for public inspection and
to furnish upon request a record of elevations (in relation to mean sea level)
of the lowest floor (including basement)of all new or substantially improved
structures located in the special flood hazard areas.If the lowest floor
is below grade on one or more sides,the elevation of the floor immediately
above must also be recorded.
4.Agrees to take such other official action as may be reasonably
necessary to carry out the objectives of the program.

Trustee Robert E.Wagner introduced the following resolution and moved it be
passed and adopted:
RESOLUTION
WHEREAS,the Town of Estes Park,Colorado,has adopted and is enforcing
the Uniform Building Code,1973 Edition,issued by the International Conference
of Building Officials;and
WHEREAS,Section 301 of the aforesaid prohibits any person,firm or cor
poration from erecting,constructing,enlarging,altering,repairing,improving,
moving or demolishing any building or structure without first obtaining a sepa
rate building permit for each building or structure from the Building Official;and
WHEREAS,the Building Official must examine all plans and specifications for
the proposed construction when application is made to him for a building permit.
NOW,THEREFORE,BE IT RESOLVED by the Board of Trustees of the Town of
Estes Park,Colorado,as follows:

1.That the Building Official shall review all building permit applications
for new construction or substantial improvements to determine whether proposed
building sites will be reasonably safe from flooding.If a proposed building
site is in a location that has a flood hazard,any proposed new construction or
substantial improvement (including prefabricated and mobile homes)must (i)be
designed (or modified)and anchored to prevent flotation,collapse or lateral
movement of the structure,(ii)use construction materials and utility equip
ment that are resistant to flood damage,and (iii)use construction methods and
practices that will minimize flood damage;and
2.That the Town Engineer shall review subdivision proposals and other
proposed new developments to assure that (i)all such proposals are consistent
with the need to minimize flood damage,(ii)all public utilities and facilities,
such as sewer,gas,electrical and water systems are located,elevated and
constructed to minimize or eliminate flood damage,and (iii)adequate drainage
is provided so as to reduce exposure to flood hazards;and
3.That the Town Engineer shall require new or replacement water supply
systems and/or sanitary sewage systems to be designed to minimize or eliminate
infiltration of flood waters into the systems and discharges from the systems
into flood waters,and require on—site waste disposal systems to be located
so as to avoid impairment of them or contamination from them during flooding.
Trustee Rollen Sutter seconded the motion.Upon roll call the motion passed
by the following votes:Those voting “Yes”Trustees N.T.Petrocine,GThnn
Prosser,Rollen Sutter,Robert E.Wagner,Robert E.Burgess,H.Bernerd Dannels.
Those voting “No”none.
Trustee Robert E.Wagner introduced the following resolution and moved it be
passed and adopted;
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,
COLORADO:
That Ernest C.Hartwell,Town Attorney,and Colton 11.Babcock,Jr.,
Assistant Town Attorney,be and hereby are authorized and directed on behalf
of the Town of Estes Park,Colorado,to enter their appearance on behalf of
the Town of Estes Park,Colorado and answer the summons and complaint served
upon the Town of Estes Park in the case of Frank E.Williams vs.Town of
Estes Park,a Municipal Corporation,and to take any and all action necessary
in such defense.
Trustee H.Bernerd flannels seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Glenn Prosser,Rollen Sutter,

be passed and adopted:
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,
COLORADO:
That Ernest C.llartwell,Town Attorney,and Colton W.Babcock,Jr.,
