The Board of Trustees proceeded to conduct a public hearing on the pro posed rezoning from R—l Residential District to R—Residential District of Village Acres Addition to the Town of Estes Park.There were no persons present speaking in favor of or in opposition to the proposed rezoning.Mayor Harry B.Tregent declared t1 hearing closed. The Board of Trustees proceeded to conyctea public hearing regarding the rezoning of a portion of AlFresco/AItion to the Town of Estes Park from the existing R—l Residential District to R—Residential Dis trict,Speaking in favor of the rezoning were:Mr.&Mrs.Julson,Mr. March,Mr.Crowley,Mr.Wood,Mrs.Rudolph,Mr.Hutcherson,Mrs.Becker, Mrs.Pagano,Mrs.Keck,Mrs.landers and Mrs.Schmidt.There were no persons present speaking in opposition to the rezoning.Letters read to the Board of Trustees in favor of the rezoning were from the follow— ing:O.L.Hough and Mr.&Mrs.Newman.Mayor Harry B.Tregent declared the public hearing closed. Trustee Robert E.Wagner introduced the following ordinance and moved it be passed and adopted on first and final reading: AN ORDINANCE AMENDING SECTIONS 12,4-1 AND 12.4-7 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO,RELATING TO ZONING AND REZONING. Trustee Glenn Prosser seconded the motion.Upon roll call the motion passed by the following votes.Those voting “Yes”Trustees Robert E. Meeting called to order by Mayor Present:Mayor Trustees:—i Also Present: Absent: the following resolution and moved it be passed and adopted: RESOLUTION WHEREAS,Colorado Revised Statutes,1963,106—2—4 provides for the creation and implementation of a Regional Planning Commission,and; WHEREAS,the Boards of County Commissioners of the County of Larimer,State of Colorado and the County of Weld,State of Colorado have studied the need for the establishment of a Regional Planning Commission and have established the same by joint Resolution dated the 24th day of September,1969,and; WHEREAS,the Town of Estes Park believes that it is in its best interest to join said Regional Planning Commission,and; WHEREAS,the “Articles of Association of the Larimer—Weld Regional Planning Coimnission”have been reviewed by the governing body of the Town of Estes Park and the same are acceptable as rules for governing said Regional Planning Conunission; NOW,THEREFORE,BE IT RESOLVED,by the Board of Trustees that the Town of Estes Park becomes a member of the Larimer-Weld Regional Planning Commission,and; BE IT FURTHER RESOLVED,that the Town of Estes Park adopt the “Articles of Association of the Iarimer-Weld Regional Planning Commission”dated February 24,1972,a copy of which is attached hereto and incorporated herein by this reference and made a part of this Resolution,and that the Mayor and Town Clerk are hereby authorized to execute a copy of this Resolution on behalf of the Town of Estes Park. There were no responses to the Invitation to Bid on the East Riverside Storm Drainage project.Trustee Rollen Sutter moved that the Public Works Committee be authorized to negotiate for the construction and completion of this project.Trustee Glenn Prosser seconded the motion. Upon roll call the motion unanimously carried. Mr.Jerry Iamson,Mr.Russ Ketchum and Mr.Paul Moyers appeared before the Board questioning the provisions of Section 17.28 of the Municipal Code.Mr.Iamson submitted a suggested revision to the code.After a short discussion,Mayor Tregent referred this matter to the Code and Sanitation Committee for their recommendation. Trustee H.Bernerd Dannels introduced the following resolution and moved it be passed and adopted: RESOLUTION WHEREAS,on April 9,1972,certain property belonging to the Town of Estes Park,Colorado,was destroyed by fire,and WHEREAS,the Board of Trustees of the Town of Estes Park believes such destruction to be the act of two said minor children,such act would entitle the Town of Estes Park to recover damages from the parents of such minor children pursuant to the laws of the State of Colorado, and, WHEREAS,such destruction may constitute a violation of the State ‘h’1 ofrn ul Btc5 nrh,Larimer County,Colorado.19. Meeting called to order by Mayor Present;Mayor Trustees: Also Present: Absent: of Colorado or the ordinances of the Town of Estes Park,or both, NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,comliAflo: That the Town Attorneys are and they are hereby authorized to take any or all action necessary to recover damages to property belonging to the Town as the result of said destruction,including,but not limited to the maintenance of a law suit; BE IT FURTHER RESOLVED,that the Mayor and Town Clerk be and they are hereby authorized to sign all necessary complaints to recover dam ages in the amounts recoverable by the laws of the State and to execute releases therefore; BE IT FURTHER RESOLVED that the Town officials be and they are here by authorized and directed to cooperate with the proper juvenile and law enforcement authorities in the investigation of the destruction of the Town’s property and prosecution of the responsible parties.
