Mr.Dunn Krahl appeared before the Board to explain the refunding pro cedures.Trustee N.T.Petrocine introduced the following resolution and moved it be passed and adopted: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO: That the Mayor and Clerk are authorized and are hereby directed to sign the agreement,dated April 17,1972,by and between the Town of Estes Park and Boettcher and Company of Denver,Colorado.This agree ment provides for the refunding of 75l,OOO of water bonds. Trustee Robert E.Wagner seconded the motion.Upon roll call the motion passed by the following votes.Those voting “Yes”Trustees Robert E. Burgess,N.T.Petrocine,Glenn Prosser,Rollen Sutter,Robert E. Wagner.Those voting “No”none. STATE OF COLORADO ) COUNTY OF tARDIER )ss. TOWN OF ESTES PARK ) The Board of Trustees of the Town of Estes Park,Colorado,met in special session,in full conformity with law and the ordinances and rules of the Town,at the Town Hall,being the regular meeting place of the Board,on Monday,the 17th day of April,1972,at 7:30 P.M.There were present and answering at roll call: Mayor:Harry B.Tregent Mayor Pro Tern:Glenn Prosser Trustees:Robert E.Burgess Rollen Sutter Robert B.Wagner Town Clerk:Dale G.Hill Town Treasurer:N.T.Petrocine Absent:H.Bernerd Dannels Thereupon there was read and considered the following Certificate of Determination: STATE OF COLORADO ) COUNTY OF tARDIER )ss. TOWN OF ESTES PARK ) CERTIFICATE OF DETERMINATION WHEREAS,the Town of Estes Park has outstanding certain general obligation water bonds and refunding water bonds,which bonds by ‘ho ‘nftm of gstes arh,Larimer County,Colorado.19. Minutes of a meeting of the Board of Trustees of the Town of Estes Park,Larimer County,Colorado.Meeting held in the Town Hall in said Town of Estes Park on the day of A.D.19....at regular meeting hour. Meeting called to order by Mayor Present:Mayor Trustees: Also Present: Absent: 139-44—1 et seq.CR5 1963,as amended may be refunded by the issuance, without election,of refunding bonds;and WHEREAS,the amount of the refunding bonds to be issued must be determined by the Board of Trustees prior to the issuance thereof; ThEREFORE,BE IT CERTIFIED AND DETERMINED: 1.That the following outstanding general obligation water bonds and refunding water bonds,being in amounts and being numbered as follows, are hereby refunded by the issuance of the refunding bonds hereinafter mentioned: Issue Dated Amounts Refunded Bond Numbers November 1,1963 $151,000 134 -284,md. (Refunding) July 1,1971 600,000 1 —120,md. Total $751,000 2.That general Obligation refunding water bonds in a total prin cipal.amount of $750,000 are hereby authorized to be issued for the purpose of refunding the general obligation water bonds and refunding water bonds described in Section 1 above,and this Certificate of Determination shall be entered upon the records of the Town prior to the issuance of said refunding bonds. Present:Mayor Trustees: Also Pre5ent: Absent: Trustees:Robert E.Burgess - N.T.Petrocine Glenn Prosser Rollen Sutter Robert E.Wagner Those voting NAY:None Five members of the Board of Trustees having voted in favor of said motion,the presiding officer thereupon declared the motion carried and the Certificate of Determination adopted. Thereupon,Mayor Tregent announced that the Board would consider an ordinance authorizing the issuance and sale of $750,000 in General Obligation Refunding Water Bonds. Thereupon Trustee Glenn Prosser introduced and there was read in full the following Ordinance: AN ORDINANCE AUTHORIZING THE ISSUANCE OF GENERAL OB LIGATION REFUNDING WATER BONDS OF THE TOWN OF ESTES PARK,COIDMDO,IN THE PRINCIPAL AMOUNT OF $750,000 FOR THE PURPOSE OF REFUNDING OUTSTANDING GENERAL OB LIGATION WATER BONDS AND REFUNDING WATER BONDS IN THE PRINCIPAL AMOUNT OF $751,000;PROVIDING FOR THE ESTABLISHMENT OF AN ESCROW ACCOUNT FOR THE PAYNENT AND REDEMPTION OF THE OUTSTANDING BONDS;PRESCRIBING THE FORM OF SAID REFUNDING BONDS AND PROVIDING FOR THE LEVY OF TAXES TO PAY SAID BONDS AND THE INTEREST THEREON;AND PRESCRIBING OTHER DETAILS IN CONNECTION THEREWITH,AND DEClARING AN EMERGENCY. It was then moved by Trustee Glenn Prosser and seconded by Trustee Rollen Sutter that all rules of this Board,which,unless suspended, might prevent the final passage and adoption of this Ordinance at this meeting,be and the same are hereby suspended. The question being upon the adoption of said motion and the sus pension of the rules,the roll was called with the following result: Those voting AYE: Trustees:Robert E.Burgess N.T.Petrocine Glenn Prosser Rollen Sutter Robert E.Wagner Those voting NAY:None Five members of the Board of Trustees having voted in favor of said motion,the presiding officer declared said motion carried and the rules suspended. Meeting coiled to order by Mayor Present:Mayor Trustees: Also Present: Absent: Trustee N.T.Petrocine then moved that said Ordinance be.passed and adopted as read.Trustee Rollen Sutter seconded the motion. The question being upon the passage and adoption of said Ordinance, the roll was called with the following result: Those voting AYE: Trustees:Robert E.Burgess N.T.Petrocine Glenn Prosser Rollen Sutter Robert E.Wagner Those voting NAY:Nonç The presiding officer thereupon declared that,five of the Trustees elected having votes in favor thereof,the said motion was carried and the said Ordinance duly passed and adopted. On motion duly adopted,it was ordered that said Ordinance be num bered 12-72,and after approval by the Mayor,be published in the Trail- Gazette,the official newspaper of the Town,and be recorded according to law.
