Minutes of a meeting of the Board of Trustees of the Town of Estes
Pork,Lorimer County,Colorado.Meeting held in the Town Hall in said Town of Estes Park

Minutes of a regular meeting held on September 25,1972,were read and
approved as read.
Trustee Robert E.Wagner moved the following bills be allowed and paid
and the Clerk be authorized to draw warrants for same.(A Certified
copy of the bills read and allowed are on file in the office of the Town
Clerk under this date and made a part of the record of these proceedings
by reference thereto.)Trustee Glenn Prosser seconded the motion.Upon
roll call the motion passed by the following votes.Those voting ‘Yes”
Trustees Robert E.Burgess,H.Bernerd Dannels,Glenn Prosser,Rollen
Sutter,Robert E.Wagner.Those voting “No”none.
Mayor Harry B.Tregent proceeded to conduct a public hearing regarding
the 1973 Town of Estes Park budget.There were no persons present to
speak in favor of or in opposition to the budget.Mayor Tregent de
clared the hearing closed.
Trustee Robert E.Burgess introduced and the Town Clerk read in full,
the following entitled ordinance and Trustee Burgess moved it be passed
on second and final reading:
AN ORDINANCE ADOPTING THE BUDGET FOR THE TOWN OF
ESThS PARK,COlORADO,FOR THE FISCAL YEAR BEGIN
NING ON THE 1ST DAY OF JANUARY,1973,AND ENDING
ON THE LAST DAY OF DECEMBER,1973.ESTIMTING THE
AMOUNT OF MONEY NECESSARY TO BE RAISED BY TAX
LEVY BASED ON THE SAID BUDGET SO ADOPTED;ESTI
MATING THE AMOUNT OF MONEY TO BE DERIVED FROM
OTHER REVENUE SOURCES;AND SETTING FORTH THE
TOTAL ESTIMATED EXPENDITURES FOR EACH FUND.
Trustee H.Bernerd flannels seconded the motion.Upon roll call the
motion passed by the following votes.Those voting “Yes”Trustees
Robert E.Burgess,U.Bernerd flannels,Glenn Prosser,Rollen Sutter,
Robert E.Wagner.Those voting “No”norE.Whereupon Mayor Harry B.
Tregent declared said ordinance duly passed and adopted and ordered
it numbered 36-72 and published according to law.
Trustee Glenn Prosser introduced and the Town Clerk read in full,the
following entitled ordinance and Trustee Prosser moved it be passed on
second and final reading:
AN ORDINANCE LEVYING TAXES FOR THE YEAR 1972,TO
DEFRAY THE COSTS OF MUNICIPAL GOVERNMENT OF ESTES
PARK,COlORADO FOR THE FISCAL YEAR BEGINNING JANUARY
1,1973,AND ENDING DECEMBER 31,1973.
Trustee Robert E.Wagner seconded the motion.Upon roll call the motion
passed by the following votes.Those voting “Yes”Trustees Robert E.
Burgess,H.Bernerd Dannels,Glenn Prosser,Rollen Sutter,Robert E.
Wagner.Those voting “No”none.Whereupon Mayor Harry B.Tregent de
clared said ordinance duly passed and adopted and ordered it numbered

second and final reading:
THE ANNUAL APPROPRIATION ORDINANCE;APPROPRIATING
SUMS OF MONEY TO DEFRAY EXPENSES AND LIABILITIES OF
THE TOWN OF ESTES PARK,COWRADO,FOR THE TOWN’S
FISCAL YEAR BEGINNING JANUARY 1,1973,AND ENDING
ON THE LAST DAY OF DECEMBER,1973.
Trustee Rollen Sutter seconded the motion.Upon roll call the motion
passed by the following votes.Those voting “Yes”Trustees Robert E.
Burgess,H.Bernerd flannels,Glenn Prosser,Rollen Sutter,Robert E.
Wagner.Those voting ‘No”none.Whereupon Mayor Harry B.Tregent de
clared said ordinance duly passed and adopted and ordered it numbered
38—72 and published according to law.
The Town Clerk submitted an application for renewal of a 3.2%fermented
malt beverage license for Wayne and Leola Richardson dba Wayne Richardson
Super Food Market,350 W.Riverside Drive,Estes Park,Colorado.Trustee
Glenn Prosser moved the application be approved.Trustee H.Bernerd
flannels seconded the motion.Upon roll call the motion unanimously
carried.
Trustee Robert S.Wagner introduced and the Town Clerk read in full,
the following entitled ordinance and Trustee Wagner moved it be passed
on first and final reading:
AN ORDINANCE REPEALING SECTION 1.4 OF THE
MUNICIPAL CODE OF THE TOWN OF ESTES PARK,
COlORADO,RELATING TO MEANING AND DEFINITION
OF TERMS.
Trustee Rollen Sutter seconded the motion.Upon roll call the motion
passed by the following votes.Those voting “Yes”Trustees Robert E.
Burgess,H.Bernerd Dannels,Glenn Prosser,Rollen Sutter,Robert E.
Wagner.Those voting “No”none.Whereupon Mayor Harry B.Tregent de
clared said ordinance duly passed and adopted and ordered it numbered

Trustee Robert E.Wagner introduced the following resolution and moved
it be passed and adopted:
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,
COlORADO:
That Ernest G.Hartwell,Town Attorney,and Colton W.Babcock,Jr.,
Assistant Town Attorney,be and hereby are authorized on behalf of the
Town of Estes Park,Colorado,to enter their appearance and to take all
necessary action to defend the Town of Estes Park,Colorado,in the
cases of N.R.Field,Plaintiff,vs Town of Estes Park,Colorado,a
Municipal Corporation,and McStain Corporation,Defendants,Civil Action

In accordance with the lease,dated December 9,1957,by and between
the Town of Estes Park and the Rocky Mountain Metropolitan Recreation
District,the Recreation District submitted a request,dated October 2,
1972,in which they request permission to construct the following im
provements:open air picnic shelter,two tennis courts with fence,
multi-purpose court,parking lot and playground equipment.Mayor Harry
B.Tregent referred this request to the Public Works Committee and
directed the following pieces of information be provided:the location
of all improvements,the proposed completion date of these projects
as well as the rifle range and plot plan.
Trustee Robert E.Wagner introduced the following resolution and moved
it be passed and adopted:
RESOLUTION
WHEREAS,there will appear on the November 7,1972,general election
ballot proposed Constitutional Amendments 7 and 12;and
WHEREAS,local officials have long supported and worked for con
stitutional revision and modernization to enable local governments to
meet community needs and 20th Century problems;and
WHEREAS,local government was modernized and home rule self—deter
mination for municipalities was strengthened by passage in 1970 of
Constitutional Amendment Three;and
WHEREAS,adoption of either Amendment 7 or 12 would:
I.impair lOcal authority to raise necessary revenues to
finance local services and programs,
2.limit cherished municipal home rule powers granted by
Article XX of the Colorado Constitution,
3.encourage encroachment by the General Assembly and State
of Colorado on revenue sources relied upon by local
governments,
4.risk fiscal or legislative chaos in the allocation of
restricted property tax revenues among counties,munici
palities and special districts,
5.impose inflexible tax formulas in the Colorado Constitution,

eliminated by the Amendments,and
7.result in major tax shifts and altered tax burdens for
Colorado taxpayers.
NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF ESTES PARK,COLORADO,AS FOLLOWS:
1.That the Town of Estes Park goes on public record as opposing
adoption of Constitutional Amendments 7 and 12;
2.That the Town of Estes Park urges its citizens to become
acquainted with and vote No on Amendments 7 and 12;
3.That a copy of this Resolution be mailed to the Colorado
Municipal League office.
Trustee Glenn Prosser seconded the motion.Upon roll call the motion
passed by the following votes.Those voting “Yes”Trustees Robert B.

Trustee H.Bernerd Dannels introduced the following resolution and
moved it be passed and adopted:
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,
COLORADO:
That the Agreement between the Town of Estes Park and the Breeder
Reactor Corporation,dated October 9,1972,is approved and that the
Mayor and Clerk are hereby authorized and directed to sign this Agreement.

and moved that the minutes be approved and adopted.Trustee Robert E.
Wagner seconded the motion.Upon roll call the motion unanimously
carried.
Trustee Glenn Prosser,Chairman of the Water Committee,reported on a
meeting as itemized in the minutes of October 2,1972,and moved that
the minutes be approved and adopted.Trustee H.Bernerd Dannels seconded

minutes of the meeting on October 5,1972.
Trustee Glenn Prosser,Chairman of the Special Retirement Connnittee,
reported on a meeting as itemized in the minutes of October 6,1972,
and moved that the minutes be approved and adopted.Trustee Robert
E.Wagner seconded the motion.Upon roll call the motion unanimously
carried.
Trustee Robert E.Wagner reported on a Light and Power Committee meeting
as itemized in the minutes of October 6,1972,and moved that the minutes
be approved and adopted.Trustee Rollen Sutter seconded the motion.
Upon roll call the motion unanimously carried.
A letter from the Chamber of Commerce was read to the Board of Trustees.
The Chamber of Commerce requests the Board appoint a representative to
serve on their Centennial Committee.Mayor Harry B.Tregent appointed
Trustee Robert E.Wagner to serve on this Committee.
The Town Administrator presented an ownership map of the Fall River
area showing the response of the latest survey.The following informa
tion is a summary of the results of the Fall River property owners:

(SO owners with 301.4 Acres counting Shewfelt)

The Board discussed the proposed annexation at length.Trustee Robert
E.Burgess moved that the Town of Estes Park proceed with the annexation.
Trustee H.Bernerd Dannels seconded the motion.Upon roll call the
motion unanimously carried.

be as outlined on the ownership nap plus the Shewfelt property,Parcel
77,and that the Circle A property,lanelle Clements,be included in
part or total,if this is the desire of Mr.Clements.Trustee Robert
E.Burgess seconded the motion.Upon roll call the motion unanimously
carried.
There being no further business,it was regularly moved,seconded and
carried that the meeting adjourn.
